Woman Kicks Officer during DWI Arrest

  • Around 9:49 PM on December 18, 2022, officers from the Teaneck Police Department were called to the scene of a motor vehicle collision involving a 2022 Kia SUV and 2018 Dodge at the intersection of Queen Anne Road and Fort Lee Road. Teaneck Police Officer Donejia Somerville arrived on scene and she saw the Bogota Police Officers (neighboring town) Luciano and Hondros were already on scene. She was briefed on the situation by Officer Luciano and she proceeded to make contact with the driver who was struck by the other vehicle. After he declined further medical attention, she proceeded to make contact with 23-year-old Emily Mendez, who was the driver of the 2022 Kia.
    Around this time, Officer Alexander LaVacca and Sergeant Jason Hosey also arrived on scene to assist. As Officer Somerville approached Emily, she noticed that Emily seemed irritable and she was unwilling to answer her questions. As she was questioning Emily, Officer Somerville detected the odor of alcohol and asked Emily if she had been drinking. Emily denied consuming alcohol in the hour prior, but refused to answer questions about where she was coming from.
    Based on her suspicion of impairment, Officer Somerville offered her an opportunity to perform field sobriety exercises. The first exercise was the Walk and Turn test. During the Walk and Turn test, Emily failed to walk heel-to-toe and did not count her steps out loud. The second exercise was the One Leg Stand test, and Emily did not raise her foot in the proper fashion while failing to count aloud as she had been instructed.
    Based on the traffic accident, the odor of alcohol on her person, and her inability to adequately complete the field sobriety exercises, Officer Somerville placed Emily under arrest for driving under the influence. As she was being arrested, she became combative with Officer LaVacca and assaulted Officer Somerville by kicking her in the shin with her right leg. Her vehicle was searched by Sergeant Hosey but he did not find any open containers of alcohol. Officer Somerville subsequently transported Emily to Teaneck Police Headquarters for initial processing.
    At police HQ, Emily was uncooperative and refused to answer questions. Officer Somerville also read her the Standard Statement for Motor Vehicle Operators, but Emily refused to submit breath samples for testing. Officer Andino-Doran entered the refusal into the Alcotest machine. After Emily was processed, she was released to her sister after she signed the Potential Liability Warning form on her behalf.
    Emily was issued the following summonses: Operating under the influence, refusal to submit to chemical test, and reckless driving. She was also charged with Simple Assault under N.J.S.A 2C:12-1A(1). Court records indicate that on April 27, 2023, Emily pleaded guilty to operating under the influence and refusal to submit to chemical test. She was fined $640 for operating under the influence and $690 for refusal to submit to chemical test. She was also ordered to spend 12 hours at an intoxicated driver resource center and use an ignition interlock device for 3 months. The other citation for reckless driving and the assault charge were dismissed as part of the plea agreement.

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.

    Personally, I am sick of watching various law enforcement personnel having to be so patient with people who are under the influence of any substance. Being so patient with these people causes a huge waste of time and resources. That's time that could allow officers to be elsewhere protecting other citizens. If they don't adequately respond to officers' commands after 2, or maybe 3 attempts, i say go straight to the arrest of such violators.

      It’s quite simple why they’re overly patient. They don’t want to escalate. If you’re aggressive towards a drunk, they’re going to take the level of uncooperativeness to a heightened place. Most likely a physical level. Clearly, that should be avoided at all costs. Its a good thing you’re not a cop.

      Officers are trained to do this for a reason. Defense attorneys - even court appointed ones - are good at their jobs and know how to tear down charges with even the minutest of officer missteps. Lack of FST's a sure-fire way to get charges dismissed. I yell ARREST HER over and over too but these guys know what they're doing. I also THINK they get certifications for doing so many FST's so they do everything they can to be able to mark each off as completed.

    Every drunk idiot who acts like this, like a petulant spoiled child should have their license revoked for 3 years, be forced to sit and watch their video and spend that 3 years cleaning the scene of every drunk driving incident within a 50 mile radius, then sit with the families who've lost their loved ones due to being hit by a drunk driver, listen to their stories, and then explain to them why she thought she had the right to do what she did, and act the way she did. People who do this and act this way are disgusting.

      I don’t understand why DUIs aren’t automatically criminal. Reckless endangerment is a crime, cars are considered a deadly weapon in other criminal cases, combine the two and make it a misdemeanor the first time and felonies every time after.

      She will become more comfortable each time she does a FST. I’m sure we all remember being new in a job and having to do a power point, presentation, demonstrate how to perform a specific test or how to operate a new machine in front of your boss.       She was emotionally consistent, but her performance on instructing her on the field sobriety tests were terrible. "raise your leg 6 feet off the ground" having issues counting herself despite that sorta thing is a red flag for intoxication for the suspect and reading off the manual instead of demonstrating, definitely lacks training.

    Thanks for always posting these videos. They remind me of what I used to do as an alcoholic all the time. Neither the 4 DUI's nor 6 months in jail could stop me from drinking. Today it's different and judges can put someone in treatment and or AA. I got help over 4 years ago from AA, and I am still sober today. Other friends who are still sober after 10 to 20 years were not as lucky as me. One friend killed her 4 year old daughter in a car accident. Another friend's husband was driving drunk and killed himself and the other driver, leaving my friend with massive head injuries, every bone broken, as well as being in a coma. This is what alcoholism does. It's a horrific disease and what most people don't understand is that we cannot stop. It has nothing to do with willpower.

    This nasty drunk woman is bad enough but what was hardest to stomach was the officers' coddling, lenient treatment of her. Maybe the depts are scared of lawsuits, etc., but I'm pretty positive that if I knocked a cop's hand away and screamed "I don't have to listen to you, b___ch", I'd be in handcuffs in 5 seconds. That also was in the top 3 worst FST instructions I've ever heard. She needs to stop focusing on her perfect manicure and learn to do her job and to not say "I'm gonna AXE you some questions".
