    I'm trying to figure out how in Florida heat is required but air conditioning isn't. I'm about to withhold rent because my AC/heat pump isn't working properly and they won't fix it. But my lease says we're supposed to have air conditioning.

    I live in Pace Florida area and yes you are right we have no rights at all. Even if we pay rent on time for years and years of paying rent again on time.

    I was a live in caregiver for elderly man, 24/7. For 14 mos. He recently passed in November 22. His niece who is to get the property, said starting on April 1st, they are going to charge 100/ mo. rent which is fine with me to cover taxes. Just this past weekend she came and rummaged through his belongings and took what she wanted and left. She just put the property up for sale, been 5 days, got a call from her cousin who was power of attorney in the last months he was living, that she told him they got an offer, and the buyer wanted to close by end of month(February 23) that only gives me 15 or so days, my husband works 6 days a week and which only 1 car is available to us. Can i request more time to arrange and find somewhere else to live? She didn't notify me personally by phone, letter, email, message. We had to hear thru a family member, is that right to do that? Thanks for any help you can offer, its in archer fl.

    I have a question I just paid my rent and my landlord just gave me a 7 day notice now I have to go to court I have all my paper work for payment how can I fight this

    What if they have an unsafe tenant living with you (roommate) of which you have warned him is incendiary? Does that fall under putting you in a non peaceful and livable environment?

    My home is definitely not safe or habitable. My heat has stopped working, there is mold growth in the kitchen cabinets, there's no smoke detector, no ventilation, one door won't close all the way, water drips in the bedroom window when it rains. The worst part is the roaches have taken over the whole front half of our home since it has gotten cold. No matter how much we clean, they are everywhere. We can't even sit in the living room anymore and watch tv without roaches crawling on us. I'm also pretty sure they have formed a colony in the back of our tv. I'm planning on writing letter about withholding rent this month.

    Oh by the way, i recieved no money for my services, but in turn, the old man gifted me. 994 ac. lot. We've been taking care of 4 ac. property ,home and him for the 14 mos. I talked about in earlier discussion.

    I've been asked to leave a home I've been renting a room in and find that the house is unsanitary and almost unlivable. There's animal feces and urine on the counters from cats, the AC doesn't work right and there's windows missing from the front of the house. Can I fight this?

    i lost my job in October of 2018 and been out of work and i draw
    unemployment can my landlord evict me for living on the property and not
    working ..

      @Chesapeake Bay no he never give me a statement , i asked because back in September. the landlord tried to evict everyone in the building. saying he was canceling. our lease and the whole building got together and went to a lawyer and we won. because it was a illegal move on his behalf and his lawyer, and they withdrew the eviction notice.

    What about non-renewal of lease for no reason? Obviously there would be a reason but the property management company is not disclosing the reason. But the management company has a reputation of non-renewal with tenants who complain. I've heard of such because of tenants complaining about the management deferring maintenance of the dwelling. In my case, the system they use for us to pay rent is at fault for any late payments. I have to pay through a vendor they use called Paylease. The system often declines my payments despite the funds being available. In which case, the other option is to go to Wal Mart customer service and pay there. The first time I attempted this, the vendor lost the payment but it did come out of my bank account. I immediately had an eviction notice on my door, not from the courts but from the management company. I was told, "you are still responsible for the payment." That was despite proof that the payment came out of my account and on time. I had to do all the work trying to find out where the payment went despite this not being my business. I use an Android to do my computer work and the platform does not work so well with the system online as it hides menu options. Why pay for internet at home when my phone carrier charges me enough as it is to have unlimited internet and a tablet with their services? This management company company charges $10 for dropping off a check. They charge a $100 late fee if the rent is paid after the 3rd day of the month. I had to pay a late fee even though my direct deposit was not until the 5th and they still charged me. I was told, "you should have enough money saved for two months rent!" This was right after Christmas and during the slowest period of my business in Florida. I managed to Hotspot my tablet to my laptop and was able to make payments online but then the hard drive in the laptop needed replaced. I was issued a card to pay at Wal Mart. I know by now that it can require me an entire day off from work to pay my rent and I also work alot. I went to Wal Mart and the card did not work. I took a picture of the computer screen for proof that I attempted to pay the rent, which was on a weekend, and picture mailed to the management company and dropped off a check. I was hit a $100 late fee anyway. A month later it increased to $200. I went to the office and stood up to them. I told them I refused to pay that and did not owe it. I went to pay online in April and it said "Declined." I went to Wal Mart and the new card I was given did not work. I moved in 4/15/17. I didn't realize my lease was up 3/31/18 as I was under the impression my lease was a year and not 11 1/2 months. I received a notice on my door stating they were not going to renew the lease with me and I had to be out by this May 31. I called and they did not give a reason but stated that "the owner decided not to renew the lease." Umm, I am in real estate as well. I looked this owner up. He is like 80 years old and lives in Germany and has never even seen this place besides in pictures. They aren't renewing the lease simply out of retaliation and are being vindictive. I went to the office to cover some guideline and steps to take upon moving out. They have refused to work with me on resolving any issues and claimed to have waived the late fee in which they said, "the owner agreed to waive the late fee." My rent is paid and has been paid on time with the exception of the one time because of the date of my direct deposit or because the malfunctions of their system. They would not talk with me, held the door open and were kicking me out and threatened to call the police on me. I have nowhere to live now and I'm not going to pay $1200/month for what everyone else is asking for rent. I also have to leave my job because of this. For the record, this is Pinellas Country, Seminole/St Pete area. The management company is All County Property Management Suncoast. I was warned about them and my neighbors have told me horror stories about their experiences as well. They simply lie, collect, and won't fix anything or will take several months to do so. They also don't have the units professionally cleaned as my place was not clean when I moved in.

      I was late but never spilled over to another month. I paid all of my landlords late fees and other things they should have fixed. From out of the blue I get a none renewal letter. Then a few days after I get a, 3 day to Vacate notice. How can I pay there rent for this month and find a place to love after living here for over 10 years. Is there anything I can do about at least getting a little more time? They are selfish and won't to fix this place up and rent or sell the duplex I live in.

    Florida is a right to work state. And tenants have no rights in Florida. God forbid you lose your job you will be homeless.

      @@playnejanehernandez3173 Not in Florida we don't. All the rights mentioned are imaginary ones. I have personally witnessed tenants evicted from a home they lived in most of their lives and not even be informed they were in danger of eviction. The person died in jail after contracting COVID. They were put in jail for trespassing in their own apartment. The landlord just decided they didn't want unemployed elderly sick people living on his property and filed court documents for evicting a tenant for not payment, DURING THE IMAGINARY MORATORIUM ON EVICTIONS. Then he got the sheriff's deputies to evict the guy. 70+ years old, lost his job because the governor ordered all us senior citizens to remain home and then the landlord kicks him out for it. I saw him carted away in handcuffs. They arrested him for trespassing after the one hour notice to vacate expired. They gave him 60 minutes notice to vacate and move five rooms of furniture and other belongings that he lived with there for most of his adult life. He'd been living there for over 20 years. This and other things I have witnessed or experience has proven beyond any doubt that in Florida, tenants have zero rights. We live at the whim of our landlords. Mine for example requires cash payments for rent and accepts no other form of payment and refuses to provide receipts. A lawyer I talked to said that A) that is perfectly legal as no tenant has the right to evidence proving they paid rent and B) the law is designed to make it easy for a landlord to evict for non payment and all a landlord has to do to evict is tell the court no rent was paid and so they make sure tenants can't prove they paid their rent. Mine has admitted as much. He said "I don't give receipts, that way if you don't behave the way I want I can just evict you for non payment even if you paid." I cant record him saying this because in Florida it is a felony to record someone's voice without written consent.

    If the manger or landlord ask for a security deposit from the tenant . if landlord or manger.deposit security deposit in the bank. And again interest from tenant security deposit it sure be though cise covid-19 .if you give me a security deposit and I The landlord or manger I'm gaining interested off your money I'm holding in the bank the tenant is gaining nothing off their money take a tenant who rent from landlord or manger for 10 or 15 year look the interest that the is pocket from the tenant.it really sure for the landlord or manger.i really think that when a landlord or manger enter your money into a bank they sure to give you half of the interest.landlord the manager make the tenant and the tenant security deposit.

    LOL. Tenants have no rights in Florida. I know, I live here. We don't have a right to receipts or any evidence or proof we paid rent. This way landlords can evict us instantly without notice for trespassing. We don't have a right to a habitable apartment. If we don't like the shack without electricity nobody is keeping us here. Landlords can inspect any apartment 20 times every day at all hours of the day and night without any notice just to make sure we are behaving ourselves. Landlords have the right to search our apartments including the contents of a safe, closets, dressers and the pockets of the pants we are wearing. Landlords have the right to rent out our apartment behind our back, toss our belongings into the dumpster while we are at work and change the locks without using the courts. Landlords can evict a tenant if they get sick, are discovered to be gay or transgender or if they find out the tenant is an atheist. How do I know? 15 years of experience renting apartments in Florida has taught me this. The moment any attorney starts talking about tenant rights I laugh. We have no rights. We are completely at the mercy of the landlord. This is because all relevant laws are specifically designed to only benefit landlords. During the pandemic when there was an imaginary ban on evictions, two of my neighbors were evicted for non payment of rent. Both lost their jobs. One was elderly and very vulnerable to COVID 19 so they could not work in the crowded factory where they had worked for 40 years. The state's malfunctioning unemployment system delayed his unemployment benefits to the extent where he could not pay rent so the landlord got an eviction hearing in court, didn't bother notifying the tenant and so the tenant was surprised when the sheriff's deputies showed up to evict him and he hadn't even been informed he was in danger of eviction. he was given an hour to get his things together. He had lived in that unit for most of his adult life. He had five rooms of antique furniture he was ordered to move out himself or forfeit all in one hour. After he was dragged away in handcuffs crying the landlord auctioned off all his belongings and made a killing. I heard the old guy's great grandmother's China sold for thousands. I didn't attend the auction by one of my neighbors did. He thinks the landlord got rid of him so he could make money of the poor guys belongings. I heard from another neighbor the guy got COVID in jail and died. Like I said, tenants have no rights in the third world country known as Florida.
