You said that sometimes in eviction court the defendant will say they failed to make service and that the just sometimes says, "well you are here now" so if this happens does the defendant have any recourse? How should a defendant protect their statutory right to dismiss the eviction if the landlord failed to make the statutory requirement of service?
Did the tenant follow the lease 100% . They wouldn’t be evicted if they did . Many times I get tenants who do not follow any of the lease or rules but yet they want the landlord to. Don’t hold a persons feet to the fire if you don’t want or can’t follow rules .

They are taking a very loose interpretation of the declaration stating that it requires resident to relenquish a copy of this private document. They allege no other rules have been broken and the resident owes them no money. It appears to be retaliatory after resident had to get municipal health inspector involved to deal with a rodent infestation.
Cops told me it was civil when for two months she had front gate security bar entrance to any visitors, including food deliverys when I was sick..two months later....she turned off power and water. for 5 days I had no water during COVID-19 Stay At Home Order. Now I'm being legaly evicted since she is now allowed to here in SC.

What if they mail my notice to themselves? Does there need to be a chain of custody of mailed notices? In other words, they put it in the Federal control of the USPS. It comes to the address, but the letter carrier delivers it to the property manager/assistant. Now back in the custody of management, who then puts it in a slot where every employee has access to it (no locked mail boxes) I do not have access to my mail until they are ready to forward it to me.
The best defense is to pay on time,don’t damage the property,don’t cause disturbances or become a nuisance but sometimes you get forced out because of greed!!!!
Obviously. The problem is that you can be THE picture perfect tenant and do absolutely everything you are supposed to do and STILL run into a slumlord. It’s just not as black and white.

Why would there be a sixty day notice for non payment of rent. Are landlords really expect to lose a quarter of a year rent because of stupid laws designed to protect deadbeats????

@Peace and Joy be with You This is one reason I always tell family and friends to be cautious about renting a home from someone. You never know the status of the landlords loan. They could be going thru a foreclosure or be thinking about selling the home which will put you in a bad situation at the last minute. It sounds like you feel that by paying your rent on time and never missing a payment in the past has bought you some type of equity or "brownie points" with the landlord but it doesnt. You have to remember to not include your feelings in business situations. The only thing that you may be able to do is take the landlord to court so that you can stay until your lease is up. If you have a month to month lease you will probably have 30 days to move. Depending on the state you're in they may only have to give you a 30-90 day notice. If they want to sell they will need time to do any repairs so they can start showing the house to potential buyers. If you do go to court I would confirm prior to the court date if the house is even listed for sale. If its not the landlord may have to provide the reason they want you out.
We are being evicted by an Administrator who gave up her right by quitclaim on 2005. We live in California and the eviction lawyers filed a EJ130 based on a 60 day notices, no advance written notice was given or reason why we are being evicted. We never got a chance to reply to the proper forms because we thought the 60 day notice was a joke. We have now a default against us and a lockout is going to happen tomorrow at 6 am. The judge did not stop it based on what he said we were late. I also asked about jurisdiction but he still left things as they were. Regardless of the jurisdiction of it, they didn't follow proper procedure to evict. We are not renters, the house belongs to the person who was willed it and in the trust as executor, beneficiary and administrator. Yet regardless of all the faux pas, we are going to be locked out tomorrow.
As an honest landlord, I have no problem following all of the legal steps. One thought: the more complex and expensive the process gets, the more landlords will be forced to charge for rent for all tenants. There is no free lunch for anyone. This may sound harsh, but realistically if I am at risk for greater loss due to laws, delays, or for any reason, I need to charge more to offset the risk. you can't run a business taking on risks and absorbing losses with nothing to offset that. A second thought is that I observed this video seems to advocate using every possible oppertunity to delay a judgment. If the tenant has a strong case, there is no need to delay this. It seems you are implicitly advocating tenants take advantage of these opertunities for a few extra days of free rent.
I got the same feeling after listening to her talk. It’s literally a crash course about how to game the system. If they really care about tenants, more people should be encouraged to invest in a greater amount of housing supply so that the price/rent will drop naturally due to competition. Many of these self declared “compassionate” middle people are doing more harm in the name of doing good, while getting pretty fat paychecks to line their own pockets. I used to donate a lot to nonprofits that claim they help the homeless etc. Later I realized these people are often using certain people’s sufferings to enrich their own careers.
I didn't pay directly, I performed the bill by claiming the interest in the account and sending them a notice and tender of payment via a letter of instructions telling them to apply the Principal's balance to the Principal's account for set off. It's called a Performance. That counts as payment. How do enforce my rights as the agent to the principal and a breach of contract because the lease was created and being held in trust. The apt is the Trustee and they have violated the contract by holding on to the interest.

You don't need an eviction notice if the lease says no notice is necessary. That he has giving enough time (e.g. 10 days) to pay rent and rent was not paid and so he could go ahead without further notice.
You have no idea what you are talking about. It depends on the State where you live, but by law landlords have to give notice. And the law is very specific on this.
It is important to understand that you are not asking for "Pay or Quit" here. You are asking for a summary ejectment based on a BREACH OF LEASE. It's different! And it's a very important difference. This is on the back of the complaint form: "In filling out number 3 in the complaint, if the landlord is seeking to remove the tenant for failure to pay rent when there is no written lease, the first block should be checked. (Defendant failed to pay the rent due on the above date and the plaintiff made demand for the rent and waited the ten (10) day grace period before filing the complaint.) If the landlord is seeking to remove the tenant for failure to pay rent when there is a written lease with an automatic forfeiture clause, the third block should be checked. (The defendant breached the condition of the lease described below for which re-entry is specified.) And "failure to pay rent" should be placed in the space for description of the breach. If the landlord is seeking to evict tenant for violating some other condition in the lease, the third block should also be checked. If the landlord is claiming that the term of the ease has ended and the tenant refuses to leave, the second block should be checked.
Here is what my lease says: Payment of Rent: The rent is $530 per month including utilities which is due in advance on the first. Rent is for one person and not more than one car. Landlord’s acceptance of partial rent shall not waive the tenant’s breech for which a summary ejectment proceeding may be instituted. There is a 10 day grace period so if rent was not paid on the first, an eviction filing may be made on the 11th.. If, after a court filing, you pay the rent plus court fees, the tenancy will be redeemed. The 10-day written notice of demand for payment required by North Carolina law is hereby waived.
Here in Texas, the law is very specific about notices. It is unlawful to put in the lease that the tenant is waiving his or her rights of an eviction notice. Not because you are tricking your tenants to sign something it means that you are a fair landlord. Tricking somebody is not going to make you being right. If that is the way you like, and you are able to sleep at night, then good for you. Have you ever thought about being a good, fair landlord? or is it that you only see money when you deal with a new customer?
The lease clearly says a breach occurs after 5 days late then you can file an eviction on the 6th day late for breach of lease because it's after 5 days late. You are filling for breach of lease. No tricks here. Just want to do it right and not do something that the judge would not allow. If the tenant does not pay rent in full and on the date that it is due, the landlord may begin eviction proceedings by serving a demand for nonpayment of rent on the tenant. That, however, is the default rule. Whether or not a landlord is required to make such a demand and give notice depends on whether the lease or rental agreement contains a forfeiture clause and a notice clause. A forfeiture clause is a clause that gives the landlord the right to terminate the lease or rental agreement earlier than it would have expired naturally. A notice clause outline the kind of notice the landlord must give the tenant before beginning eviction proceedings

We've always paid our rent, never EVER been late, i make it a point to pay early. They are trying to boot us because they want to sell the house. It's been hell with the strangers parading through.
Best option of defense is be responsable tenant. Don't have any negative behavior. Or any negative issued. And even if landlord need his him .. good tenants just to an find another place. My lease says "no couples". She had a girlfriend staying with her. My lease says "no parking in the street". Her girlfriend was parking the street while she took up the only driveway parking space I had. Parking in the street is violating the association covenants which could result in me getting fined. I had no choice but to get rid of her.

Always go to the hearing. You have a good case for dismissal, you must be served in writing with notice to cure then quit .

@Peace and Joy be with You This is one reason I always tell family and friends to be cautious about renting a home from someone. You never know the status of the landlords loan. They could be going thru a foreclosure or be thinking about selling the home which will put you in a bad situation at the last minute. It sounds like you feel that by paying your rent on time and never missing a payment in the past has bought you some type of equity or "brownie points" with the landlord but it doesnt. You have to remember to not include your feelings in business situations. The only thing that you may be able to do is take the landlord to court so that you can stay until your lease is up. If you have a month to month lease you will probably have 30 days to move. Depending on the state you're in they may only have to give you a 30-90 day notice. If they want to sell they will need time to do any repairs so they can start showing the house to potential buyers. If you do go to court I would confirm prior to the court date if the house is even listed for sale. If its not the landlord may have to provide the reason they want you out.

We are being evicted by an Administrator who gave up her right by quitclaim on 2005. We live in California and the eviction lawyers filed a EJ130 based on a 60 day notices, no advance written notice was given or reason why we are being evicted. We never got a chance to reply to the proper forms because we thought the 60 day notice was a joke. We have now a default against us and a lockout is going to happen tomorrow at 6 am. The judge did not stop it based on what he said we were late. I also asked about jurisdiction but he still left things as they were. Regardless of the jurisdiction of it, they didn't follow proper procedure to evict. We are not renters, the house belongs to the person who was willed it and in the trust as executor, beneficiary and administrator. Yet regardless of all the faux pas, we are going to be locked out tomorrow.

As an honest landlord, I have no problem following all of the legal steps. One thought: the more complex and expensive the process gets, the more landlords will be forced to charge for rent for all tenants. There is no free lunch for anyone. This may sound harsh, but realistically if I am at risk for greater loss due to laws, delays, or for any reason, I need to charge more to offset the risk. you can't run a business taking on risks and absorbing losses with nothing to offset that. A second thought is that I observed this video seems to advocate using every possible oppertunity to delay a judgment. If the tenant has a strong case, there is no need to delay this. It seems you are implicitly advocating tenants take advantage of these opertunities for a few extra days of free rent.

If they really care about tenants, more people should be encouraged to invest in a greater amount of housing supply so that the price/rent will drop naturally due to competition. Many of these self declared “compassionate” middle people are doing more harm in the name of doing good, while getting pretty fat paychecks to line their own pockets. I used to donate a lot to nonprofits that claim they help the homeless etc. Later I realized these people are often using certain people’s sufferings to enrich their own careers.

I didn't pay directly, I performed the bill by claiming the interest in the account and sending them a notice and tender of payment via a letter of instructions telling them to apply the Principal's balance to the Principal's account for set off. It's called a Performance. That counts as payment. How do enforce my rights as the agent to the principal and a breach of contract because the lease was created and being held in trust. The apt is the Trustee and they have violated the contract by holding on to the interest.

You don't need an eviction notice if the lease says no notice is necessary. That he has giving enough time (e.g. 10 days) to pay rent and rent was not paid and so he could go ahead without further notice.
You have no idea what you are talking about. It depends on the State where you live, but by law landlords have to give notice. And the law is very specific on this.
It is important to understand that you are not asking for "Pay or Quit" here. You are asking for a summary ejectment based on a BREACH OF LEASE. It's different! And it's a very important difference.
This is on the back of the complaint form:
"In filling out number 3 in the complaint, if the landlord is seeking to remove the tenant for failure to pay rent when there is no written lease, the first block should be checked. (Defendant failed to pay the rent due on the above date and the plaintiff made demand for the rent and waited the ten (10) day grace period before filing the complaint.)
If the landlord is seeking to remove the tenant for failure to pay rent when there is a written lease with an automatic

Here in Texas, the law is very specific about notices. It is unlawful to put in the lease that the tenant is waiving his or her rights of an eviction notice. Not because you are tricking your tenants to sign something it means that you are a fair landlord. Tricking somebody is not going to make you being right. If that is the way you like, and you are able to sleep at night, then good for you. Have you ever thought about being a good, fair landlord? or is it that you only see money when you deal with a new customer?
The lease clearly says a breach occurs after 5 days late then you can file an eviction on the 6th day late for breach of lease because it's after 5 days late. You are filling for breach of lease. No tricks here. Just want to do it right and not do something that the judge would not allow. If the tenant does not pay rent in full and on the date that it is due, the landlord may begin eviction proceedings by serving a demand for nonpayment of rent on the tenant. That, however, is the default rule. Whether or not a landlord is required to make such a demand and give notice depends on whether the lease or rental agreement contains a forfeiture clause and a notice clause. A forfeiture clause is a clause that gives the landlord the right to terminate the lease or rental agreement earlier than it would have expired naturally. A notice clause outline the kind of notice the landlord must give the tenant before beginning eviction proceedings

I am a mother of 8 and have filed and won a small claims court case against the very apartments that have tried to evict me 3 times at least and this last time, yesterday. They finally won. I am a landlord and my last eviction hearing lasted more than an hour and a half.
That is not common. It happens, but it is not usual. I have been going to eviction courts recently, and they see like 10 cases in an hour.
The tenant always paid the rent. She had a lot of arguments to make about the association covenants, why I was evicting her. and the reasons she should be allowed to stay even though I didn't want her to.
A lot of landlords would be so happy of having a tenant who pays his or her rent every month. As you said, you built a case with all your experience and tricks to evict a woman that was a good tenant, but you evict her anyway because: "you didn't want her to stay" That is despicable!
My lease says "no couples". She had a girlfriend staying with her. My lease says "no parking in the street". Her girlfriend was parking the street while she took up the only driveway parking space I had. Parking in the street is violating the association covenants which could result in me getting fined. I had no choice but to get rid of her.
