    Hi again, Joy.
    My application back at the local field office after DDS for non-medical review was taking more than 8 weeks. So I called the local field office and inquired (complained). They apologized and told me, yes, I am approved for SSDI, and I should receive my award letter in the mail very soon. So thank heavens - took 9 months for me in nyc. And mine is another case to show your channel constituents that if the application goes back to the field office for a non-medical review (after DDS), the odds of approval are good. I will still follow your channel 😃. Thanks for your dedication to ‘All Things Social Security’.

    I applied back in August 2022. Finally after close to 2 years of waiting and speaking with a non medical reviewer I was finally approved this Wednesday my Notice Of Award will be coming in 2 weeks.

      I knew a girl a while back that got so much money from her back pay that she was able to buy a house.

      @@tiffneyhale6422 Occasionally we see 6 figure back pays. Often it is due to that stressful, very long, repetitive appeal situation though. However, it IS true that had they won early, they'd not have and they'd have spent each month as they went along, as they will not prospectively - but NOT have then been able to 'force save' for that house.
      Even a 50k or less back pay can be used for something they can't take away. Some people use it to pay down debt that accumulated during the bad times... I am NOT sure that is what I would do... I'd make priorities for the #1 business - myself.
      Even SSI back pay - if huge - can be used to buy a home they can afford to carry OR pay down a mortgage on a house in their name, so the benefits pay them FOREVER.

    Just received the same message, last week. i had a hearing with an ALJ on May 3rd, this year. The judge ruled in my favor fully. I was diagnosed with PTSD (loss of sleep) from a deployment in Iraq some years ago. Now, I have to use the social security as more evidence for my VA case which they messed me over with. I have lawyers for both cases and the social security was easier to deal with than the VA.

      @AllThingsSocialSecurity An Administrative Law Judge completed reviewing your appeal on May 28, 2024. On May 28, 2024, a representative in Memphis Tennessee started a final review to make sure that you still meet the non medical requirements for disability benefits.

      @@dlawso23 OK, so that message does not say the ALJ found you fully favorable - perhaps he TOLD you verbally at hearing, which is a good sign although not 100%. The second part of the message is what has been disturbing people b/c it implies the person prevailed on the big battle - the medical battle/review - yet we are finding they are issuing that language to both those denied and those awarded. BUT, if your ALJ said you prevailed (do you have a copy of the hearing audio?) then super good sign, b/c that rarely gets flipped.

    I just went to the SSA portal and checked the status of my application last week it said it went back for a non-medical review and now it's in a final review to make sure I still meet the non-medical requirements. I didn't want to get excited but then I noticed it says I am enrolled in Medicare starting November 2024. I was like weird, then I decided to check the Verification Letter (it used to say no, I am not receiving any SSI or SSDI benefits. Now it says I'm approved and start getting paid SSDI benefits August 2024. And back benefits for December 2023 to July 2024. Woohoo! I was getting worried because "everyone gets denied the first try", but I have a Spinal Cord Injury but I was still nervous cuz it's my first time applying... I am so relieved now. Thank goodness! Good Luck Everyone, keep the faith! There is a light at the end of the tunnel, keep pushing forward.

      Wow! So happy for you! So, this makes me wonder if those that get the original message, don't then get the ADDITIONAL info you received (that seems detailed as to pertinent 'win' details), may be the ones who need to remain distrusting of the first message, unless and until that rest shows up - at least until the SSA fixes this terrible messaging to the masses. Thoughts?

      @@AllThingsSocialSecurity yes, I think the second message a definitely sign and after seeing that the SSDI non-medical review was being done at Baltimore Maryland but SSI non-medical review was at the Buffalo NY Field Office (my hometown) I scrolled down further to the Benefits Medicare Section and it said "Social Security (Disability) Active" once I saw that I scrolled down more and it said "Medicare Hospital Insurance Enrolled" November 2024. That made me open the verification letter, that used to say no I don't get SSDI and SSI Benefits but now it said they will start August 2024. My onset date September 1, 2021. But they are only paying back pay for December 2023 to July 2024. I was wondering why I won't get 12 months backpay but I applied in January 2024.

      Where did you go to see the Medicare thing because I just today got changed to the non-medical thing My lawyer says she was told or she could see that a decision had been made I don't see that she hasn't been very helpful anyway. I was just wondering if you could give me more detail on where you saw your other information.

    great video…. just had my video hearing with the judge 24 Oct…. he actually told me he was approving me during the hearing, the vocational expert stated i was unemployable, just as the VA Did recently.
    my message on my account when i log on states non-medical review being conducted 2-4 weeks. my lawyer said that the judge giving a decision during the hearing doesn’t happen often… but i still have to wait to ensure i still meet requirements i guess.

      I LOVE when a Judge does that! My last hearing was like that, and I and my client SO appreciate. Most do not go that way, probably b/c the ALJ is a tad un-read on the file or his attorney advisor has recommended a denial... (which a hearing can sometimes flip)... I am VERY happy for you! It is like Christmas in October :) and you don't start 2024 with the stress of 2023 hanging over you - at least in this regard.

    My husband 's online account said DDS finished, sent to field office for non medical review then another 2 weeks later, field office switch to Baltimore, MD, then another 2 weeks they approved...i heard ppl said if it's a denial, you will get a denied letter 2-3 days after DDS finish medical review. It would not go for another round of non medical review

    Thank you Joy for your quick response. I got approved!! For SSDI. 3 days after I got that message. Not only that they found I was disabled back on January of 2021. I get my first paycheck in February. My question is since my attorney has not called me Back, in January 2021 my two sons one was still a minor but now since the process took 3 years do I get back pay for both of them? Because one he turned 19 he moved out but 12 yeared old is still with me. And also due I get back pay as well for that time? Because in my letter it just states the monthly payment amount. Thank you so much for calming my nerves with your response.

    Hello Joy, Great information and thanks for the plain language. The below information may help some of your viewers.
    I did do some research online and while I don't know the validity of this response - (saw it on reddit), I can say that there were many people that responded favorably when they received the step 4 message which included a 2-4 week processing time. If the 2-4 week processing time did not show, the claim was denied two days later. If it showed, they received a positive outcome. Again, this was one person contributor but many people responded. Not sure if it was the same for your viewers or in your experience.

      I forgot to add - The reddit contributor added - If the 2-4 weeks does not show, the message disappears the next day. I also want to mention that during my case, the SSA has been top notch. So professional and accommodating. My case manager and field office have been amazing. The backlog of work is astronomical.

      I need to see a picture of the language. I mean, does it say, Step 4 in it, or are they presuming they are for some reason at Step 4. My concern is, what about STEP 5?

      @@AllThingsSocialSecurity That is what shows when you sign in. There is a dropdown tab you click into "Show Disability Benefits Applications Details". When you click into that dropdown tab - you are at Step 4. Step 5 is your determination letter. I sent the snips to you in email. I hope this helps. Thanks for all your great videos.

      OK, so to be clear, and thank your for the emailed view, those are not LEGAL STEPS. The LEGAL steps (sequential evaluation process) is WITHIN that notice you see back in 2-3. That notice is just a communication which can change in verbiage at any time - ie. a,b,c,d, or none at all.
      There are 5 steps (before you get that notice) to determining if one is MEDICALLY disabled and they don't spend wasteful time telling someone which of those steps they are on, it is internal... . I have a feeling (could be wrong) that SSA has committed a faux pas if they are sending those little notices out about non-medical review for those that never passed the MEDICAL review satisfactorily. It DOES go back to field office, yes, but NOT for non-medical review but for the denial letter to be issued - the adjudicator does not issue any letters since he does not provide the answer as to whether one will receive benefits. He only communicates to the other office(s) whether the person was found to have met the portion of criteria relevant to the first necessary finding - medically proven to be disabled - which does not address the final question that only applies to those that met the medical criteria, about, did she meet the non- medical - both sets have to be YES.
      But, it wouldn't be the first time they tried to do something, only for it to flop.

    Mine says this aswell after i had a hearing and says seeing if i "still meet non medical requirements for benefits , typically takes 2-4 weeks"

    My hearing was December 4 of 2023. I checked my account today and my case has moved from step 3 to step 4.
    It says that "A representative in Gainesville, GA started a final review to make sure that you still meet the non-medical requirements for disability benefits."
    Gainesville is where my local office is. The hearing office and adjudication office are out in Alpharetta, GA.
    Does this potentially mean anything that i can read into? Or is that just some generic language that it's showing me?

      @@AllThingsSocialSecurity I have not received an official decision letter yet. However, I contacted the Gainesville office and the person I spoke to looked into my account and told me that I've been denied.
      As of this moment, my SSA account now shows that I have been denied for SSI. It hasn't updated to show the denial for SSDI yet, but I'm sure that will show up soon.

    I had this same thing happen sent back for non medical review .. 2 weeks later I was denied I was told this happens . In my explanation letter I was told there were limitations to what I can do but that I can adjust to other work . Found out more bad news maybe I will get lucky ? I miss being able to work had 4 surgery’s in last 2 years a few months ago I found out I have cervical stenosis and a bunch of slipped vertabrae . I’m guessing you can meet multiple listings but it not matter ..I got both shoulders operated on .. scoliosis herniated discs in lower back with s1 nerve root impingement and degenerated disc disease and degenerative joint disease multiple sites , osteoarthritis and didn’t get it . Good luck everyone

      If you meet a listing, as per SSA, you do prevail, so they found you did not. Thank you for sharing the fact that SSA communications fail via the (probable?) ssa online message. If this is on initial, if you don't have a lawyer, now may be the time to get one.

      @@ChadHawkins-d7v oh my gosh I cannot believe that!!!! You need to get a lawyer you need to reapply again but this time get you a lawyer I had to use one that I didn't have to pay him the only way he would win is if I would win. Sometimes it's hard to find lawyers that will take SSI cases or that's how it is here in Pensacola Florida where I live. But I got blessed when I felt my lawyer and his secretary was a sweetheart she helped me out to you a lot. I just cannot believe with all of the stuff you have wrong with you that you wasn't able to get it!!! Please take my advice and find an attorney in your area that will take your case, I promise you if you can find the right attorney you will get it!!! I'll be praying for you...🙏 It took me almost 4 years to get mine and I didn't get an attorney up until like a month before my phone hearing and then when I had my phone hearing there was some kind of messed up about not having all of my records so they had to reschedule it for a couple of months later oh my gosh I was so mad about that. But I finally got it and I was so so so so so happy just to have my Medicaid backcuz it sucks not having insurance whenever you have all these medicines that you're on and doctor's appointments!!!! I'll be praying for you I pray that you will get it one day please take my advice and try to find a good attorney I promise you if you find the right attorney I really do believe that you would get it!

    Thought there was hope. Saw the status change yesterday to “sent back to field for final non medical review “. Low and behold the status changed today to denied.

      Got the message on the portal “sent to local office for non-medical review to see if I still qualify for disability” in the disability section of the portal where the SSDI info was.
      Then, in the lower, SSI section of the portal, it said it was denied.
      I was confused, so I went to the local office and the guy at the window told me that I was denied medically for both SSDI and SSI.
      Why the message that says “to see if I’m still non-medically eligible”?
      I’m still so confused.

    I got same message on ssa portal the 2-4 week message for non medical review next day the message wasn't there and it said that it was denied (ssi)

      Jeez Quintin, I think that message is being sent erroneously (ergo confusingly) because I have heard on here too many folks with same recent experience. There should be NO online portal message that it is being nonmedically reviewed - b/c it is not. It should not say a thing until denial issues. Period. I am sorry this is happening. A True non-medical review means one survived/prevailed on the big battle, which is medical review.

      My attorney and I applied for both SSDI/SSI back in April on August 9th I got a phone call from SSA for I'm assuming it was the nonmedical I was told that it was now being sent to the DDS to determine if I was disabled I went to SSA portal on 1/23/24 and seen that the ssdi determination was at 100 percent at all 5 levels were denied but the SSI was bout 77 percent at level 4 it said on 1/23/24 that it is bring sent to my state ssa office to see if i still qualify for nonmedical and that it takes 2-4 weeks however I checked SSA portal 1/24/24 and that message wasn't there anymore it now says in the SSI part 5th level final decision denied.

      I was told that it was now being sent to the DDS to determine if I was disabled - RIGHT, this means you were not yet at Medical (the big fight) but between April and Aug they were getting this "stuff" together, slowly to get you moved onto to medical work up office (state agency that is outsourced to by feds).
      I went to SSA portal on 1/23/24 and seen that the ssdi determination was at 100 percent at all 5 levels were denied -- Sorry.
      but the SSI was bout 77 percent at level 4 it said on 1/23/24 that it is bring sent to my state ssa office --- (you mean local field office, which is federal not state) --- to see if i still qualify for nonmedical and that it takes 2-4 weeks however I checked SSA portal 1/24/24 and that message wasn't there anymore it now says in the SSI part 5th level final decision denied. -- Do you have a REMOTE DLI?

      @@rosachavez6394 I'm at the same stage 3rd step of 5 and I've heard that this is the sever impairments level we've gotten past 1-2 let's hope we're allowed at this level.

    You helped me figure out what to do with my case. You told me to call so I did and found it was sitting there near me. I called and I got approved for ssdi. Now if my disability only lasts for one yr will my amount go back to smaller retirement amount ? I received early retirement at 62 and 3 months.

      So glad to hear. Whatever months you collect early SSR instead of SSD or not collecting any but waiting, will all incrementally reduce your benefit amount below your PIA. So it would really depend on what you do. That said, if you just prevailed and are breathing down the throat of mid 60s, it would probably be rare for someone to either be diaried for a CDR so soon (although I am sure some impairments are the exception) or for that to be able to take place before full retirement age.     Unfortunately, I already know I don't meet the nonmedical requirements, as I waited too long to apply. My disability happened all the way back in 2013. I tried applying in 2015 but never appealed the first time. Now, in December 2023, I had a ALJ hearing for my second application, from April 2022.
    SSI was denied (Don't know the reason, yet). SSDI now pending a "non medical review." Unless they go back to when I last worked, in 2013, I'm completely screwed.

      @@AllThingsSocialSecurity Google tells me that is 5 years after I last worked. The last time I regularly worked was prior to my first foot surgery in May of 2013.
      I started trying to do DoorDash/Uber/Postmates in 2020, and again all throughout 2023 (never made over 1100 a month, and never had more than $1700 banked; also had $400+ in credit card debt)
      As far as I know, they check for work credits in the 5-10 years prior to your application date; rather than when you were actually made disabled. Since I was disabled in 2013, but my application date was 2022, I'll have pretty much none.
      I still don't know what their reasoning was for declining my SSI; no letter yet. The judge seemed like he was helping me out, during the hearing. The VE said there were no jobs who could reasonably make the accommodations, and my lawyer said I'd probably get SSI, but not SSDI.

    Hi so I received a denial letter in the mail, but my online account is still saying that it's at my local field office, so this morning I called the 1-800 number and it says that no decision have been made that it's still at the dd office,so I called my local office and the lady said that no decision have been made that in fact it's still at my local office, now im completely confused... what could be the reason for a denial if no decision has been made?

    I appealed my ssdi as I was denied then was encouraged to file for SSI and I did. I received a letter today that ssdi denied my appeal, SSI also sent a letter saying the also denied me because of ssdi but when I log in to my account for SSI it says the are reviewing non-medical requirements and it will take 2-4 weeks at my local office. I’m confused. I decided not to appeal ssdi as I don’t have enough work credits but want to appeal SSI. But I’m confused by the letter and what online says

    I received that message in my SSA online account. 2 days later, I received a denial notice in the Reconsideration step. I have been in the Hearing step for over 3 months. I have been attorney rep since the initial SSDI application in April 2022. I'm 61 years old and have had 3 cardiac surgeries. They want to do a 3rd cardiac ablation. They implanted a cardiac pacemaker over 2 years ago.

    I would like to say thank you for your very informative videos. I am stumped though...
    Nov + Dec 2022: Applied with a SSA rep.: financial, work history, medical. Per the rep, "2-3 months decision."
    Dec 2022- App in DDS hands.
    August 2023- Sent adjudicator work and activity forms.
    October 23, 2023: After pleasantly requesting an application update twice, my adjudicator called back and stated she was just updating my medical records and a decision should be reached by the end of the month.
    I understood (finally) when you said that SSDI does not focus on wealth. I was very surprised that she said she would have a decision so soon. Is it standard to update medical records?

      Yes, if they ordered records back in 1/2023 but the case has sat unworked (due to staffing) for 6 months, I am seeing them re-ask for updates from providers. Of course, you should be submitting updated information so they know you returned to any doctor after 1/2023 or whenever. Your lawyer should be, that is. Good luck, fingers crossed for you :)

      In my experience it 'generally' means the DDS found the person disabled, and the random audit (or other process) kicked in to double check. FIngers crossed! @@kimdyer6100

      @@roycecolvard4449 Best sign is flat out win :) But, you are still in the game and clearly someone in DDS then found there sufficient evidence... DBQ probably pulled due to age rules (46 is young :) and want to double check. Sometimes narcolepsy is tough if there is not sufficient evidence of extent of day time issues, safety events, etc. So it may be they look at many this way. Fingers crossed!

    Has been strange for me too, did have my 1st CDR back in 2017, and I passed that. but then earlier last summer, I got a notif that I had another through the mail and did answer some questions that they sent and I sent it back, expecting to get another form. Then later just a few weeks ago, they said that the review wouldn't continue, thinking that they made a mistake a mistake or something considering I had one already in 2017.

      I doubt it was a mistake. You were up for another CDR, possibly on the 5 year track (but delays are frequent due to understaffing etc); so in 2023 you were probably getting that pre review to see if a full CDR should take place. Your answers, along with what they know your impairments to have been, made them feel pretty confident that you did not improve OR improve enough to be not disabled under the definition.
      I am glad for you that this went smoothly and did not require a full blown CDR with long forms, etc.

      HI Petro, it may depend. Your SSI could be denied b/c you didn't pass financial criteria, even if you were found medically disabled. That same finding of medical disability would still apply to the SSD insurance you applied for, so yes, you could prevail on the latter while being denied on the former. If you were NOT medically found disabled, then you'd be denied on both.

      @@katienunya when you said "it said it was sent", do you mean your online view/message? If so, this is what I consider their MAJOR cruel glitch. It means your ALJ denied you (unless it is a double glitch) and while there is NO non-medical to review if there is no medical award, there SHOULD be a denial Decision letter issue by ALJ, not by local office. Your local reps are NOT at fault here.

    I'm at the recon stage for SSI (since Feb 9, 2024) and I received this nail-biting message that says they've completed the medical part and now it is at the local office for non medical review. It's so nerve wrecking. Why cant they just put whether or not you passed the medical part (step 3) on the detailed information. It would save so many from so much stress! Maybe it will change tomorrow, probably to denied since I have a serious lack of medical documentation having to rely on a low income clinic for medical care.

      The medical part actually requires you get through step 5 (unless you win at a listing at the start of step 3)... don't confuse the steps... the steps in the messaging are faux... That said, you are SPOT on. Their messaging has been nuts since I think late 2023. Work on that Medical treatment!! I know it is not easy. And if that will take a few years, try to earn the minimum needed CREDITS so you can stay SSD insured endlessly, and thereby ALWAY have an opportunity to file for SSD once you have good evidence. Otherwise, you will be barred.

But since the same person is making the medical decision, it applies to BOTH programs so there is not more work for you as a claimant. Why were you thinking of letter the SSDI go?

    My SSI denial letter came in and stated im not disabled in their eyes. But my Disability Benefits are still under a final review by a local representative in which could take 2 to 4 weeks. Its been 20 days since my SSI denial and my online progress is still at 90% for disability benefits on the website. Im confused on why disability benefits haven't changed to denied as well by now since SSI said I'm not disabled. Any advise???

      There IS mis-messaging. Terrible. Of course, one could be not found disabled under SSDI due to time frame limitation of evidence, and then be found disabled for SSI alone for a period after their SSDI insured status expired. BUT, that is not as common as being mis-messaged :( Important thing - read you denial letter and follow directions in it to appeal. I am sorry you received it.

    The SSA is terrible with how they communicate with the public. Logically speaking a claim sent back to the local office for a final non medical review should mean that your medical portion was approved, but sadly that isn’t always true. Everyone gets those step 4 responses on the SSA portal whether denied or approved. The reality is that this message gets generated for both approvals and denials at both the DDS and Hearing levels. I know this because I went through it and experienced it first hand. On a final note, is it surprising our govt would have such a confusing step 4 message? The answer is no!

      To not have been reduced for BACK pay, you had to have had a verbal or other lease agreement with Grandma - where even though you couldn't pay in real time in those back years/months, the firm, unconditional agreement was that you were borrowing 'in kind' shelter from Grandma and would pay it back, slowly or fast, once you got back on your financial feet - this could be winning lottery, becoming health enough to work again, or prevailing on claim.
      If you both can't attest to a PRIOR agreement, that back benefits are probably correct. However, you can ALWAYS change your future agreement, starting NOW. At least then going forward, you would be eligible for the 943. Write a lease up, is easiest, for some amount greater than that minimum they have come out with - better to get the $$ and pay grandma then not, most likely, and collect less.

      It sounds positive if it OUTRIGHT says you were found disabled... but now they are checking to make sure you NEED the SSI, that you are poor. It is only for the poor who do not have the resources or income to self-support.

    This is for SSI, and it's also my very first application so no appeals. My portal says, a representative at the local office near me has started a final review to see if i still met the non medical requirements. It showed up yesterday August 6, 2024, hopefully that means I passed the medical review part, it does show a check mark by where it says for part 3, they completed a medical review August 6, 2024. I'm not sure. I hope this is a good sign. They haven't told me I needed to see one of their doctors like they did my mom, my mom had to go see two of their doctors. They never told me to do any of that yet and they are already on non medical review again to see if I still met the requirements.
    Update: On the portal, It says I've been denied.

      Did you know that lack of communication/responsiveness, for ma entire long career inside and outside of SSD was the single biggest basis for complaints about lawyers? It is also a violation of our ethics rules.
      It is also rampant in the SSD/SSI field with NON-ATTORNEY reps, except they don't have to answer to bar rules, so they have less incentive to put out :) particularly those that are not self employed where they can implement best practices, but are stuck in a company where they can only be as helpful and competent as their companies weakest practice policies. Same is true for law firms of course, not just non-attorney companies. @@robertsoto442

      Yes, so true it seems like they don't care. They don't feel your pain, their only their for the money. I mostly done all the work. The decision has been their at ssa since the 18th of this month. And yet I don't here any thing from my attorney. You know I only have talked to him once. It's been almost three years I been fighting, for him to talk to me once. If I get denied would you look at my case to see if you would like to apeal for me. Since I been waiting for the ALJ to decision I had another MRI and they found 3 more bulging disks in my back. I already had to fusion 1 in the cervical and the other at lumbar. And severe nueropathy. Also my doctors have written letters of support stating I'm disabled. Your an angel responded to me when no one else does. Looks like you care without even know the person behind the screen thank you so much.

      OK, that is only 1 business day ago, really, so to be clear, the rep does NOT get notice from SSA that decision is uploaded, if it is uploaded, so there is no way for him/her to KNOW. You, however, apparently got notice. The rep clearly cannot go into ERE everyday for every case to see if something has changed or been added, since they will get it in the mail, or else they'd not have time to do actual work. Just sharing that to be fair. Also to be fair, the amount of work behind the scenes that you are not present for, cannot be unstated, it can be incredibly high hours of legal work. Poor communication is, as I said, a common and troubling issue, that is so easy to remedy but many companies and law firms struggle greatly with it.
      Let's think positive about your results and cross a bridge when we get to it. I am always here for later review if needed, but you may have a very good work up of your case by your lawyer, so think positive, notwithstanding lack of communication. Fingers crossed! @@robertsoto442

    DDS sent my case back to my local field office for a non medical review for DWB( disabled widow benefits) under my spouse's work credits. I had a prior fully favorable from a ALJ for SSI benefits years ago but i loss my SSI benefits because of my spouse's income. I am 58 and I havent worked since 2014 due to my disabilities. Question: Is it hard to get DWB and are my chances good because im nearing 60 yrs of age?

      People our age, yes it is "easier" b/c a certain lack of adjustment to other work tends to beset us... but you will have to prove with current evidence you are disabled today... and of course meet whatever other criteria apply.

      Not sure - the AC has 60 days to decide to review the judge, I believe, but I think they know right away if they are, so the ALJ decision doesn't get sent at all to the claimant. May not be a legal requirement, but seems to be in practice. Can you imagine getting a fully favorable ALJ decision in mail, only to then get a notice that it has been yanked by AC or by quality review and overturned?

      3000 pages of medical evidence, disability placard, student loan was forgiven because of it..status changed Friday evening,like 7:30 she got the email "Judge has made a decision ,sent to field office for final review that you meet nonmedical requirements " just nervously awaiting her lawyer to send us some news ..

      All requirements you have to meet EXCEPT for the medical Q of whether you are disabled... that last part was DONE and they "allowed" you to be found disabled... This should be GOOD news, so long as you are insured for SSD or poor enough for SSI and any other requirements for either

    My ssa.gov account said your file has been sent to your local field office for further review to see if you see still meet non-medical criteria but in addition to all of that I was denied SSI, received paperwork 5 days later I was denied SSI and SSDI from a hearing ALJ just 3 months ago. With that said, why the mind games? It needed to go back to local office for further review for what?

      I know. It should NEVER have gone out, in my opinion. I think it is a glitch in the system, although I could be wrong, since I don't know that they have spoken on it. However, now I am hearing of it FOR MONTHS. Why the delay in the correction? I am sorry this happened to you.

      Can not say since I am not involved in your case. But if SSI was denied (due to finances hopefully, not medical) and you didn't get a denial on SSD but did get CE cancelled, this sounds hopeful.

    The SSA is deliberately refusing to acknowledge all appeals at every stage so without receiving a decision continue to appeal all the way up to federal court before the two years statute of limitations expires.

      Just so you know, there is no 2 year SOL :) The SOLs, for lack of a better term, are 60 days at best. And I don't think you mean SSA is not acknowledging appeal, they are just not determining that you have the evidence to prevail on appeal, and thus you have to appeal again if you disagree.

    Hello, two weeks ago I got a letter from disability which said that I qualify for the medical part and just have left the no-medical part, yesterday I got another letter from, they need proof of worker’ compensation/state disability benefits EDD ( eg pay stubs ) if I don’t send them those paper by 10 days, they will use the max withholding rate for my state. Can you please help me with this, what’s the meaning? Thanks

      It means if you get or got or will get Workers Comp, you must give them a copy of your workers comp proof of what you received and we]hen. If you received state disability payments, they need to see those. This is because sometimes you must have a degree of offset so there is no double windfall in a month where you received 2 such benefits, exceeding a max that would make it financially lucrative to be 'disabled.' If you never had WC or STD benefits, in any month, retro or otherwise, for which you retro or forward receive SSD (or SSI perhaps), you will say so. However, if they asked you for this, it sounds like it appears you got one or the other, whether you answered that correctly on your application or not.
      If you don't produce proof to the contrary, SSA assumes you received the max your state WC or STD had to offer, and will offset accordingly.
      You need to reach out to SSA and get this taken care of if you want them to be able to confirm the numbers and start paying you.

      @@mandor8759 Most likely, yes. Do tell the of the STD though. Sometimes people accidentally click in their application that their condition is related to their lifetime of work, which likely triggers the later WC inquiry and it is a pain b/c it is very hard to prove a NEGATIVE. "Prove you have received no WC payments." What??!
      Consider filling out a SS-795 with your statement that you have not and will not be receiving WC b/c your condition did not arise out of work. It is under penalty of perjury and they should accept it barring any proof to the contrary.

      Yes. The ONLY reason why they even medically worked up and made a determination was b/c he was potentially 'poor' enough for SSI. People who have neither SSD (no sufficient credits) nor other notable income/resources, but are disabled, fall back on SSI. I expect he is in good shape unless he has notable income or resources the SSA wasn't make aware of before.

      @@AllThingsSocialSecurityThe file was missing the onset date. So was sent to field office to correct. It was corrected as of September 5th. Then on Thursday another code was placed on file. I believe this sold be final step. Because the onset held it up from being processed. They are putting me back into pay since I was on social security before. That should be all they needed to do, then when payment has been released the site should show active and steps should disappear?

    Hello I also received this message stating that the Ssd office started a final review to make sure that you still meet the non-medical requirements for Disability Benefits. I have been fighting for 2 years now and I had an attorney at the hearing. Does it mean the medical part was approved?
    My hearing with ALJ was March 12th 2024 and I just received this message on yesterday April 24th 2024 at step 4. So is it misleading? Or is it a simple denial?

It has been since June and I just want to make sure you are not waiting on something from me that I may have missed? I don't want to hold you up". It is likely they are just so swamped so all takes longer, so I don't think it wise (not that you would do this!) to go in defensive, like critical of the delay, because it is likely no one's fault there... just an agency that our federal government has not chosen to fund well these last couple of years. So bees/honey concept. Or, you could write a letter and fax it to them essentially saying the same thing. If you don't have the fax number, give me the zip code (or yours) and I may be able to get that for you.

      This video is full of bologna. It is not straight forward and does not admit the broken SSA system. I am having the same problem over here in corrupted Capital State of Chicago, Illinois . I filed a Non -Medical appeal and the SSA failed to acknowledge this appeal so with out receiving a decision I filed with the SSA a request to appeal to a SSA Administrative Law Judge and the SSA continues to fail in acknowledging also my appeal to an SSA Administrative Law Judge so I am going to, again, next without a decision from the SSA, I am going to request an appeal before a " Review Appeal Counsel" and if the SSA continues for a third time to ignore my appeals, I am very soon going to take my case before a Federal Court, where I believe the SSA will STOP ignoring my appeals. Keep appealing even if you don't receive a "Decision". Because you don't want the two years statute of limitations to expired from the date your Non -Medical issue began. Keep appealing and keep good records about how the SSA is refusing to acknowledge your appeals.

      Dearest John, this video is NOT intended ot discuss as top issue, the far less than perfect parts of SSA - but if you listened well and didn't cherry pick, you'd find I often point out weaknesses in the SSA system. If you read the title, this is specifically in answer to the question about what a NonMedical review is - you are talking about appeals again and a non-medical review has ZERO to do with appeals. I realize you are having a tough time and it sounds like you are self-representing. But I believe you may be doing yourself a disservice - you speak of a 2 year SOL - that is your first problem. If you waited anything after 60 days, you likely violated your deadline that is clearly noted in your denial letter(s). Consider finding yourself an experienced Rep who you may be able to listen to and work well with, to help you. They don't charge a retainer, if they find they can take your case, by and large, so it is almost a no brainer, right?       Yes, if they received, there SHOULD be an acknowledging letter. But the problem is if you do not get that confirmation - But if they say they are working on a Recon appeal or an ALJ level appeal, then you know they got it, so that is good. What else do you need and why?

    Hello. I was reading most of the comments and many people have actually had a hearing. I am actually on the RECONSIDERATION phase after an initial denial. I received this message on my SSA portal and my attorney believes it’s a good sign: On April 24, 2024, a representative in MICHIGAN started a final review to make sure that you still meet the non-medical requirements for Disability Benefits.
    A Social Security Representative will contact you if in need of further documentation. My attorney feels I was approved at the RECONSIDERATION level by DDS and now the file goes back to make sure I have enough work hours to qualify and that I hadn’t worked since my disability date. Your thoughts?

      Actually, there is a mix in there, as their should be because we always have to have non-medical review. Your attorney, I believe, is correct in that is should be a good message - however, if you have seen the subsequent video to this, SSA has been, mistakenly in my opinion, sending these message out even to those denied at medical. I feel it is a big glitch,but getting Goliath to fix anything, even as simple and obvious as this, seems to take forever.
      That said, yes, if you prevailed on medical I agree that those issues are what they are confirming, along with any federal debts needing to be offset, or other legal offsets required. Fingers crossed!

      If your Date Last Insured for SSDI is in the past, you could be denied for it but prevail on SSI as of a date after the DLI, if the evidence fits. Or, if you have too much money you could be denied for SSI which requires a level of poorness that SSDI doesn't require and then prove disabled and prevail on the SSDI.

      @@LadyD-kf2zj Can't say for sure but USUALLY that means the SSI was denied for a reason that does not apply to SSD - so that would mean financial reasons - you have too much to not be eligible for the SSI welfare. But, they are still deciding if you are disabled medically, to see if you are eligible for SSD, which does not require poorness b/c it is insurance you worked and paid for.

      @@theletsbehonestatheist6131 99.9% guaranteed it was a medical denial and the 2-4 week letter, again, continues to go out erroneously (since it implies you have past medical review positively). The work credits would have been determined before it ever went to medical review office (DDS). That is why when SSA does something RIGHT, the subseqeuent post medical office review 2-4 week non-medical review is largely a formality (and or a check for debts to offset).

IN addition, this has sequel videos b/c much has happened since this video came out, in the SSA goings ons. But in a nutshell: I.e. SSDI and whether you were even INSURED at the date they found you disabled, whether you are a fugitive, whether you owe federal debts or childsupport/alimoney, etc... SSI - a TON of financial stuff to see if you are subject to reduced SSI amount due to other income or assets (aka the PERC interview).
      Now more importantly is that this mis-message is no longer a sign you were AWARDED b/c they have been, incorrectly in most experienced opinions, including my own, b/c they are sending them to those that were denied, so they are NOT checking non-medical stuff, despite saying so in the message. They are ONLY pumping out a denial letter. So go figure.
      When it became clear they were screwing up this messaging, I put a video out to alert.

      Hi Tictocc, OK, so this is generally seen when they, often in a random audit type thing, pull a case to audit the decision to award. To make sure it should be. It can happen at any stage (initial, recon, ALJ.) I am not sure, but it may be that they audit denials too, but I do not know.

      Hi Katina. Non-Medical criteria are all the rules we must pass/comply with outside of the big criteria of being found medically disabled. I.e. After we are found medically disabled: Are we insured for SSD? Are we poor enough for SSI? Are we earning too much at part time job for SSD or SSI? Have we used up any TWP? Are we in our TWP? Has our TWP expired, thereby already being in our EPE? (THere are videos on all these areas.) What are our living arrangments that will effect how much SSI we get (but doesn't effect SSD)....

      No, it sounds like the SSA clerk simply thinks you were a person with work ethic... better work ethic in our lifetime that coincides with steady paycheck over lifetime, tends to lead to a higher Primary Insurance Amount, which then effects what we get at retirement or if we are proved disabled prior to retirement. On a separate issue, and generally, the more skilled our work history, the higher a disability burden we have to meet, b/c we have all those skills that may be able to transfer to an easier job, unlike an unskilled worker who has no skills to transfer. @@katinaparker5923

    Hi, Joy,
    My SSD application is back at the field office, after DDS, to make sure I still meet the non med requirements for benefits. During the the application process early on, my former boss, out of pity, paid me $500 per week for 8 weeks so I could pay my rent and not get behind in bills. But I did not work at all. I filed in March, had received that pity pay from March-May, so is SSA likely to deny my application for receiving that
    much money during the “5 month” waiting period?

      Hi Sal, No, but you need to prove that it was NOT pay for work. Did your boss give you a letter about it? Did he call it severance or sick pay, or bonus pay due to great work performance during your employment? Can you prove you were't working? Because that will probably show up as wages, and SGA wages, implying current work, and you will have to show otherwise potentially.
      If you can't, it is not the end of the world, but then they'd have to push your onset date (EOD) to the day after those payments stopped... then your 5 month no pay waiting period would be the following 5 months, with your first back benefit check being due for month 6 and on.

      I see you haven't been following along with the news and our follow ups, aside from the rudeness :). You're forgiven, and I appreciate you taking note. I am not wrong (at least not here :) b/c that is what the letter is supposed to and did go out for, until the SSA glitches have been abounding, as we have come to understand it - the SSA has been as we all see it, mistakenly sending the WRONG message out and it is a train wreck. But you make a good point - I am going to see if this OLD video discussing what the SSA message MEANS, but that is being improperly sent to ALL, vs. only those ACTUALLY getting a non-medical review - can have an added clip or something, about how they have a glitch and are sending them willy nilly. It is horrendous! Stay tuned, let's smack an update right on the video. It will be pulled down then put back up with the update attached. Thanks Stacy, and I am sorry you have a Denial. Keep at it.

      Ugh there is a glitch with that? Yesterday mine went into stage 4 and said this with the 2 to 4 weeks. I havent receieved a letter yet for approved or denied and i didnt have a lawyer. Sucks there is a glitch was praying it was approved. ​@AllThingsSocialSecurity

      Both were denied!

      No, not at all. In fact, to get SSD you have to HAVE SSDI insured status.
