Not really. In most cases CPS relies on people’s ignorance. You don’t have to let them in your home no matter what they threaten you with; no warrant, no entry. The burden of proof is on the agency and in most cases they get “proof” when people let them in their home. Also, don’t sign anything. Once you sign any agreement or sign away your parental rights you’re locked into the system. Just don’t cooperate, and, if possible, get an attorney.

I and my baby brother were taken by CPS. If not for CPS taking us away, we would have suffered from malnourishment and us constantly being sick (our home was absolutely filthy and we didn't get proper food to eat). The judge gave my parents ways to improve the living conditions, go to marriage counseling, and many options to change themselves so they could have us back. I think giving them ways to change to keep their kids is fair as in the end, it can be heartbreaking on the kid when the child realizes they were forcefully taken. A good chunk of kids end up in awful foster homes, like my brother and me. We ended up in a god awful foster home that didn't truly treat us right, getting angry at us for things out of our control as we were YOUNG CHILDREN. They didn't feed us good food at that and gave special treatment to others. For a parent to fight to have their kids back and they know they'll change, is completely fair to me.

That dude called CPS on us, because I homeschooled my children, claimed that we had no food in the house and because there was a stain on the carpet. Thankfully, after showing compliance with homeschool laws, and them interviewing my kids (and inspecting our very full fridge), she left. However, she kept on trying to push Medicaid on us, even though my husband made way too much money to qualify, even applied for us, which is simply stupid and it would have meant that we would have committed fraud if we would have used that insurance. Maybe that was what she was trying to get us to do - break the law so that they had a reason to come and take our kids. i got two horrible CPS stories. they were called on my dad because he’s a drug addict and we were living with him (16 me, 19, 21). they didn’t call my mom, who had no idea that anything was going on. they interviewed all of us and let our dad take us back after he was 3 days sober, then he of course went and got high again and we struggled for two more months until we gathered the courage to ask for help from family. they were INCREDIBLY neglectful in that case. i didn’t go to school because i didn’t have anyone to take me, we were without food for weeks because my dad spent his money on drugs. it was awful
and now the next one.....my moms friend had his kids dropped off at CPS by his abusive drug addict ex wife while he was at work, and they won’t give his kids back because he had meth in his hair (from his ex) and are forcing him to take class after class and keep on adding more after they tell him when can get his kids back and keep delaying it. so he’s having to hire a lawyer to prove that he didn’t do anything wrong so he can get his kids back, or he’ll go to prison. it’s a ridiculous corrupt system they have in place

Being an African American family we were completely stripped of Rights, lawyers wouldn't even help us it seemed like everyone was connected and our entire family was denied kinship rights, my nephew was placed and abused and that foster care was allowed to keep other children and was never reported until I forced an online report after being denied the ability to report her and nothing was done. My nephew was hospitalized behind her care for 7 days. My sister was stripped of legal representation, the entire County and Hospital fabricated reports which are all on record and show what was done to us by the agency and medical professionals. Court records show what was happening and no one stopped this. My sister and I continue to fight, my sister was threatened to stop fighting or all of her children would be removed. By the grace of God we were able to overcome this. Awareness needs to be brought to this because no family should ever have to endure this. Ever!!

I am a forensic nurse that works in private practice. I see parents get buried by CPS constantly for accidental injuries. I have seen them strip a week old infant out of a mother's arms because the 5 year old face planted at the child care facility. The facility claimed the child came to school that way to avoid responsibility and ended up destroying a family. It took the family 9 months to get their children back. The infant now has severe behavioral and emotional issues after being bounced to 12 foster families in that short period of time. CPS needs significant oversight which is completely lacking. While children are abused and we do need to intervene, CPS takes their bully tactics and frank ignorance to a whole new level.

They want adoptable kids. They get a federal bounty for every kid removed, plus monthly maintenance which is enhanced if they can get a mental health disability rating, then bonus upon adopting them out to strangers. It may be unintended consequences, but there are some serious Federal incentives for taking, keeping, and adopting out marketable kids. Not to mention the more than half a million kids that “disappear” out of foster care unreported, mostly trafficked.

My son is a deputy and my fiancé’s nephew who is an amazing dad and has. Wife and 4 children, excellent provider. There son fell and hit his head playing, is was 2 years old. CPS was called and came at night to take all of the children. Thank goodness my son was called and he helped in this situation. He remained calm and spoke to CPS about the family and was able to have the children stay with grandparents. The children were traumatized and scared. They later said “will those bad people come back and take me away” this was a fear because of how COS handled it, they came with aggression and no regard for the children’s fears. It was unprofessional and they had no proof any abuse happened. The doctors stated they did not know and just asked for their opinion, but CPS came in charging and uncaring of their role and how it affected the children. That is my concern as a clinical therapist, is how CPS handled this concerning the welfare of the children. They caused harm and had no education. I saw a young women early 20’ s with a high school education come in and dictate what she thought. These workers do not have any real therapeutic training, they have HighSchool diplomas, that’s it. The standards are getting lower all the time. Currently where I live a caseworker doesn’t need a degree in social work. She could have a degree in French films and they hire her. Removing a child should only be done in the most extreme cases. Growing up believing your mommy and daddy will protect you from anything is a huge part of a happy childhood but for these kids they find out that that’s not true. A stranger can come rip them away and there’s nothing the parents can do. Destroys their sense of security. One of the worse parts is CSB isn’t held accountable. In a case I know of the worker actually forged a signature and got a naughty note in her file. There should be a bipartisan agency that’s a watchdog over them because there certainly isn’t now!

"CPS" is not a person or being, but consists of many people who do not always make the best choices or follow protocol. The public should take careful thought before making generalizations that actually do more damage by spreading misinformation. Hopefully the CPS agents in this case were dealt with appropriately, but a few people do not represent the whole.

This happened to me when my son was 7 months old. I was at work and my now ex husband was watching him, and no, he didn't hurt him, but everyone thought he did. The only thing my ex did wrong was keep him in the jumparoo too long and we didn't adjust it the way it should have been.
I come home and my baby is in his chair that rocks or you can make it still and he looked pained. I knew something was wrong, my ex husband said he just woke up and wasn't acting the same. We called an ambulance because we weren't sure if he injured himself and if putting him in a car seat would injure him more. This was our first child and we didn't know much.
When we got to the hospital they took x-rays and then CPS was called. He had a healing fracture in his tibia, mainly closer to his ankle, but there's a special name for this so called fracture because at the time I was a medical coder and it wasn't exactly a fracture, it was a bending or buckling of the bone, which could lead to a fracture, but the one he recently had was near his hip and growth plate area, it was fractured. After he was released we were allowed to take him, but we had to take him to CPS and they took him from us into foster care, my mom wasn't allowed to have him because she had been babysitting within that 48 hour period of the fracture. I can honestly say the foster home he lived in for 5 months was good because the woman taking care of him was a respectable attorney and has become a judge. They believed my ex hurt him and it took 5 months for me to get custody, I missed out from his 7 months to after he turned one, but I was allowed to have him on his first birthday. I thought I would never get him back by the way CPS treated me, my ex, and my mom. All because of a simple accident of having him play with such joy in his jumparoo and not realizing we hadn't adjusted it correctly although we thought we had.
CPS goes after the innocent and the poor or whomever they think they could potentially steal their kids from and place in a better home. They don't understand accidents happen and then what their deception costs these families. I literally was depressed and wanted to end my life a couple of times because at the time in my state if your child is taken away from you forever then if you have another child CPS will automatically take that child away too. All I have ever wanted was be a mom and if they took him away what was the point anymore, those were my thoughts. CPS lied to all of us and made us go through unnecessary hoops to get custody back. Hell, even after having my second child, basically 4 years after that incident, they re-entered briefly because my ex-husband went to jail for 5 months and was on probation for 4 years for this incident because they thought he did it since he was home alone with our son, and had the authority to say whether my youngest was allowed to go home with us or stay in the hospital. They allowed us to take him home, but made sure my mom was watching both kids while I worked and she would check up on us every week for the next 30-60 days. After that CPS was out of my life, but it was a painful ordeal, and wasted their time on us when they should have been helping other children that sadly needed it and weren't getting it.
Sorry for anyone that has to go through this, it's a rough journey.

I'm praying this never happens to anyone else. i would and have done everything that i can for my children. if it wasnt for me pushing to go to another hospital my son wouldnt be here right now. knowing hes healthy and loved and alive because of my actions means the world to me even though im not able to be around to love him back.

I just read your story and I'm so sorry you had to go through that. You don't deserve that, especially if you were trying to protect yourself and your children by getting away from an abusive situation and doing everything you could to get to the hospital. They shouldn't have taken your children especially over something like money, they should have found a way for you to get help if they thought you didn't have enough. Like you said, if it wasn't for your actions then your son may not be here and if it weren't for the ignorance of the doctors maybe they would have figured out what was wrong sooner instead of saying everything was fine. It's so wrong that they take children away from so many that don't deserve it. They tried to mess with me over an accident that resulted in an ER visit with my daughter and lied on reports and falsified. They didn't take my children but they indicated me for neglect and I think they may have tried to in the future had I not done an appeal. I got a lawyer and won the appeal and the supervisor got in trouble since she was the one who lied on the reports and she never even talked to me! The case worker was nice and had all info correct, the hospital had most info correct when interviewed, but somehow the supervisor who never spoke with me or hospital staff took everyone's statements and twisted and falsified them! The judge could tell what she had done since he had all original statements and he was furious. He said these are the kinds of people who ruin the lives of innocent families. It's ridiculous. Thankfully I had family to front me the attorney fees and won but so many aren't as fortunate and it's so sad. I'm so sorry your situation didn't turn out better. It's not fair for them to break families apart that don't deserve it. I wish you the best and I hope some day you get the chance to be in your children's lives like you deserve. Sending hugs your way! ❤

I got interviewed in 6th grade after my school reported 99% lies about my parents. This was in 2001 or 2002. My dad spanked me before school that day, and I showed up sobbing. Apparently the school counselor reported WAAAYYY more than just the slaps my dad would regularly give me - all lies. Luckily the CPS people in my area at the time were actually super awesome! They interviewed me, my sister (i think), and my parents all separately. They told my dad he can't hit my sister and I and offered for them to open a case to receive help with parenting (I wish my parents had done that - there was still verbal and emotional abuse going on. Mum wanted to, Dad panicked that they'd just take us). Unfortunately, because the social worker only had proof that dad hit us and he agreed to stop, he did have to close the case. I think he suspected the emotional abuse tbh but had no genuine proof and myself and my family honestly didn't even know that was inappropriate until it was too late.
My school, however, reported that my dad beats us and my mom. They said my mom was on hard drugs. I don't even know what else; there might have been a lie about my mom being a prostitute too. CPS was already VERY used to false reports being made by my school system to such a degree that they started to not even take them very seriously eventually. My parents threatened the school system with court if they ever put in a false report on me or my sister again; not many people actually stand up for themselves with that school system. That bitch counselor was TERRIFIED of me until I graduated high school after that. I have friends who have kids in that school now, I told them if they pull something with them to bring me with them to meet with the faculty - they'll listen.

      Part 1
So my oldest son was 4.
It was summer before he started Kindergarten. I was in Nursing school...
His Dad and his Dads family were in real tight with all the higher ups in our county. My son's Grandpa was the high school principal, then he was on school board, his wife was Kindergarten teacher for 30 something years, and he went to high school with the judge and any of the other higher ups as well as they all farmed.
So I was ordered to share split custody of my son when he was 4 months old and I was still breastfeeding.

      Part 2
Anyway, fast forward to I'm on my way home to pick son up from Dads bc it's my turn...
I was driving back from class when my sons dad called me.
"Just let him stay tonight if you dont mind? He wants to go to church AND we're going fishing!"
I was tickled that my son wanted to do all that stuff with his dad bc usually he hated going over there and his Dad never spent any time with him. (My son didnt even really stay with him, he stayed at his Grandparents. )
Anyway I agreed bc I was trying to show cooperation.
Later that night my sons dad called me and - 'while we were on the phone my son 'fell out of bed'.
      Supposedly.
The story I was given was that my son rolled off his bed without even waking up.
So his dad told me he just put him back in bed...

And they dont get for keeping the kid there...see, CPS would have to actually pay up for that to work...and they never do...
Source: I have worked in nursing for a decade now, and have seen the process. CPS jumps on the cases where the report made is 'nothing is amiss' but they ignore the 'this kid has been in for 'nanny elbow' four times in six months' reports...
When a child does wind up staying at the hospital, the state NEVER pays, or they only pay a small percentage, and the hospital ends up footing a massive bill, and depending on the state, they be required to provide tens of thousands in care, for a child that came in for a bump on the head because they ran into a door. (ever seen a toddler do that? i have, several times. My daughter once sat in the corner when she was three, and just bounced her head off the wall for a solid ten minutes because she 'was bored')
Hospitals dont want to file these reports half the time.
But we are literally required by law to submit a report EVERY SINGLE TIME a child comes to the ER. They catch you not reporting, and the nurse and doctor in charge could lose their license to practice, face criminal charges, and the hospital will face fines that range from thousands, to tens of thousands.

I work in healthcare, as an RN, and most people dont know about this.
99% of the time, nothing comes of the reports. Even if the doctor explicitly states they suspect abuse.
In a decade of nursing, ive never seen CPS respond to an actual report of abuse, but i have seen them respond to incidents with no evidence of abuse, as if the staff had called them and shouted 'abuse abuse!'
I understand at least, the idea behind the reports. If a child is taken to multiple hospitals, the records might not come connect, but with the reports, its supposed to act like a safety net of sorts, the hospital might not catch repeated visits, but the reports that are submitted will.
As for the medicaid system, you are correct, in that, bu since most people dont quite understand the different branches and systems of government, i didnt really feel like breaking that down.

It's called being a Mandated Reporter. If a Dr/Nurse/WHATEVER doesn't make the call, it can cost them their license to practice and so much more. The reason THIS was taken so seriously, was because it falls under potential Abusive Head Trauma with the multiple skull fractures. Since the Drs couldn't come to a determination of what/how, they did their job to report it. CPS mishandled this situation, and jumped the gun with assumptions. There is no supplement for intuition and working knowledge/experience, when you have someone who thinks they're doing what's best for the kids. The kids were placed in Kinship care by the sound of the report, not in the custody of the hospital.
CPS agencies across the US have extremely high turnover, high degree requirements, the workers often aren't paid much. It can take years to build a case against the families that hop from coverage area to coverage area, and on top of that you have to keep in mind what's feasible. The likely cause here was a CW who was still young in their career with CPS, has too high of a caseload, and not enough time or resources to be effective and fair. Working WITH CPS agencies, I can assure you, without context of what goes on within these agencies... it will always look like they're doing the wrong thing, or are too late for the ones who needed the help. All of the attention towards CPS function in the light of Jerry Sandusky, and changes to CPSL have made an already tough and messy subject even more so.

She said that the injury looked like it was caused by “excessive pulling” (I fell off a chair, remember), like my mom abused me, and my mom could tell by the concern in her voice. I understand that it is a doctor’s job to make sure a patient is okay, but it’s crazy to me how some doctors will just assume that a child’s injury is caused by abuse. They’re children. When I was in 3rd grade the counselor would come and talk to me privately in the vice principal’s office every Wednesday. Like on our 3rd or 4th visit, the state counselor tried to coarse me into saying that someone I knew had touched me inappropriately(which they never did). She interrogated me with drawn picture of a female body and kept pointing at “private areas” asking if anyone had touched me. The more I told her no, the more she asked if I was sure or if I was lying or if I was scared. This continued for about two hours until it made me cry and she couldn’t get me to stop. Needless to say I didn’t see her anymore after that.
Now I’m grown, I turn 19 in a few months, and I have a 1 year old son. I’m extra cautious about people being around my son because I know the things that could happen if someone decides that I have pissed them off and they try to call CPS on me. It really scares me when I think about how easily possibly it is for my son to be forced to go through the same thing. He’s a very smart and loving baby, and such a momma’s boy. I would kill someone if I thought they’d try to get my son taken from me, I won’t allow him to go through CPS and state custody, it’s a load of twisted, sadistic bullshit for real.

Cps is quick to take children away from good parents but love trying to keep the ones who are strung out and actually abusing their children together. If they parent says they don't want the child they try to put them in parenting classes and everything to help get them back. Actually love and want your child and they will fight tooth and nail to keep them away from you. Child gets hurt and you scared to get them medical help cause they will accuse you of knocking them upside their head.

They only did something when I tried to kill myself (one of many attempt's) and went to the hospital at 13.

I share this same sentiment that most do. CPS and DCF are HORRIBLE! And its scary to think that bc of an accident your child may be taken away. Watched a something other day of father being accused of abusing his son bc they claimed the child suffered from shaken baby syndrome at 9 days old but a doctor testified and said that injury can occur during child birth not just from being shaken. At 3 months old my first born was taken to ER by my mom for his foot that he always cried about. Same day while I was at work my mom called erratically crying telling me to rush home. Cps was at my home after my sons ER visit because the doctor determined it was a "foot fracture". I was mortified with myself and my children's care takers. I blamed everyone including me because how could a 3 month old have a fractured foot? We were immediately signed into a contract with him being taken away (luckily my grandma was able to house him) and it was only 3 days but we followed up with a bone doctor who found out he had a rare condition called osteochondroma which are TUMORS in the body! His foot was never fractured but 2 weeks later he got surgery to get it removed. Hes 5 now and has had about 20 of these tumors removed. I still fear going to the hospital or him going to school without everyone being aware of his condition.

That so called worker threatened me and my husband and took everything bad that happened in my life and twisted it as something to make me want to harm my son! The cops decided my husband and I were "allowing" a man to break into our home. He attempted a few times and successfully got in once and was shot at. He then broke into a garage that wasn't attached. The cop lied and stated we drugged ourselves to the point we couldn't hear him break into our "house" again and that we were allowing him to do so and signed our 2 children into emergency protective custody. They took the kids from school without our knowledge on a Friday at like 11 am waited until 4pm to show up at door which is when they would be getting off the bus and 30 minutes before the CPS office closed. We got lucky and were able to place the kids with friends but we weren't allowed to have any contact with them at all.
Monday the day before we were due in family court our case worker called and said let us look at your house so you can get your kids we don't know why we even have them in the first place. We got them back an hour later. CPS then jointly and separately reported the police officers involved to the state and they got in major trouble. 2 officers were fired and 3 more were demoted because of their actions, one of them the detective that was supposed to be catching the guy breaking into our house. The day after we got the kids back he had the nerve to call and ask us to come look at mug shots, even though I already told him who it was. I know CPS wasn't the bad guy in my story but I'm still paranoid anytime the kids bus runs late, the doorbell rings or we see a cop car behind us. (We're persona non grata to our local sheriffs department because of what happened)

She refused to keep her head down, and would throw her head back while she was on your shoulder, that was right after she was born! I'd tell everyone to hold her head, but they thought I was joking. A few times I thought for sure she was gonna be in the floor, and at 3 months she was rolling over. Now at 5 months I'm a nervous wreck!! Someone called CPS on my mom when I was little, and I'll never forget how they treated her. The threats they made in front of the 3 of us kids....then they put each of us up on the table and stripped us to our underware. We had no bruises, no scratches, no scars, our hair was clean and brushed, but that upset them. We moved not long after that and never heard from them again, but it's something I'd not wish on anyone....CPS isn't to help children, it's there to make money for the state by adopting kids out. My dad said no. So they left and came back with a sheriffs deputy. My dad said having that deputy with you changes nothing. The deputy got puffy chested and tried to bully my father in to letting them in our home and the male CPS guy actually grabbed me and tried to drag me out of the house and that’s when my dad pulled his Glock. He didn’t Point it at them but they knew what he was thinking because he let go of me.
The deputy was smart enough not to draw his service pistol. Because my grandpa was in the barn that faces the house with his old M1 Garand.
They seriously did all that for nothing when all they had to do was ask me where the bruises came from. Gymnastics is a hard sport. We fall off the beam a lot. We don’t stick landings a lot. I fall off the uneven bars. There is padding yes. But it only helps so much.
And no they didn’t ask me. They asked my dad.
All they had to do was be polite. Come to our door acting like God and telling my dad they’re here for his kid because they have reports of abuse is not being polite or courteous.

By highschool I had a whole lecture that made anyone pushing the issue of "are you sure that's how u got those marks" feel like complete idiots.
I've worked on a farm (and loved it) my whole life, planned to be a large animal vet so I looked at it like extra education XD
I think one teacher gave me a look freshman year at the fact I had multiple bruises and was only in band....
Because YES no one EVER forgets what part of the March we r on and turns and slams into someone else... when ur playing ur instrument that generally means a nicely split lip.
And no I don't have 2 sisters in softball that I'm pitching for after school so they can practice with someone that knows how to pitch...
      Our jv pitcher sucked.
And no animals EVER run into and knock over their ppl in a rush for food, let alone the fact that I drop heavy things quite regularly...
Let's not forget I've got ag class too, and since the welding machines hate Me and start acting up.... I wind up moving all our materials around or working on the wood projects, which include hammers.
Did I mention ah class has a lot of kids that don't pay attention before they move crap?
Idk how many times I got slapped by a piece of metal that someone went to move while I was walking by, and didn't watch where the back end of the slab was going -.-'
Plus any volunteer work I do with my church kids or the local animal shelter...
Nope, none of those things could cause scratches or bruises....
I think I annoyed quite a few ppl by logic-ing them to death...
Plus I was highly sarcastic when I was tired....
And those questions got tiring FAST.
Especially since I don't bruise easy, so I could remember what happened with each mark -.-'
I did appreciate that they cared enough to ask tho.
But sometimes it was over the top.
I remember in the winter I'd always be an Eskimo.
Every day a different teacher would ask me to pull up my sleeves....
I also was happy they didn't report my marks, that would have been a fiasco and a half.
But Dr's can't not report it...
I mean if an injury doesn't make sense I get it.
Heck I remember bringing in a dog of ours that had been shot within sight of the house, on our property, in the pitch dark...
And the emergency vet warned that they would be looking into our report with the county just to make sure we made one...
Hell yeah we called the sheriff's office.
