Filing a false DMCA takedown is an act of federal perjury. It is already illegal as fuck. The issue is the total lack of enforcement. UA-cam doesn’t want to ask people for proof and are happy to enable these crimes as part of their “hands-off” approach as they mistakenly believe it indemnifies them.
Honestly, I disagree. While the DMCA system is certainly lagging behind, the more driving issue is UA-cam's implementation of it. They decide that the accused carries burden of proof instead of the accuser, mainly in the interest of big media companies, music labels, and publishers. They don't want their claims to be fought, they want to have their way, right or wrong. And to an extend, it's fair to throw them a bone in regards to illegal reuploads of their stuff. But because UA-cam makes that the entire modus operandi for the system in place, it's insanely easy to abuse it with falseflagging. I could go and slap a DMCA claim on this video right now, claiming to be a rep of the creator. It would go through first and flag the video, no verification required whatsoever. And the worst that could happen to me as a consequence is my account getting banned, and even that doesn't happen consistently.
Or have actual lawyers work on the copyright strike abuse issue. We can't have AI do it... we need actual computer literate people. Fat chance of UA-cam ever doing that. It's too cheap... Or Google's too cheap.

I found you through the most indirect method. I saw "Give me $40,000: The Video Game" on sale on Epic Games when I went to claim the current free game. I made a joke to my friend in a Discord call about the price of the game. They then got curious and looked the game up, wondering what it was about. From there, we saw the bare bones Steam page, the fairly suspicious positive reviews, and the more accurate negative ones, one of them being yours. We saw the dev response on your review, and you mention that you had a video on this game, and we got curious once more, and watched your video on the subject and were surprised to learn the game was even more of a scam than we suspected. Anyway, at least something good came out of this game, because we started watching the rest of your videos, and look forward to more. Hope you beat this awful dev at their own "game"!
I remember Jim Sterling going through the same thing, and of course, Sid Alpha too. What I learned is that the moment you say "ok, let's go to court", the user issuing the strike will drop it immediately.
I am from Turkey and I am an individual who majors in computer science and reads about game design (as a hobby but i want to go abroad and major in it after i graduated from my current university) that dreams about making an unique game in the future. So, seeing this turkish “game” broke my heart since it represents my country badly. We (passionate game devs and gamers from turkey) already had to deal with a lazy “game” called Erzurum last year that primarily uses nationalism to trick people into buying basically a bad clone of the long dark (and it worked to some extent sadly) and now I guess we have to deal with this so called game too… I apologize as a Turkish person to all of the people who fell for this game and want to say that please don’t think that all of the game devs in Turkey are shady, there are lots of passionate devs in Turkey, i know this because i’ve met many of them in game dev conventions. And thanks for the video, I think you are doing a great job by pointing out these games, you earned a new subscriber!
I was just thinking Jauwn, I'd love to see one of your full breakdown videos on some of the recent MMO scams (Dreamworld, Earth 2 etc.) and where they are now?
Wait until he realizes he can't sue you for uploading a video about his game and that most courts would just throw that case right out of the court room if he actually pressed you for a court judgement. Whilst if you took it to court I'm pretty sure it would come down to him "settling" out of court or pretty much losing his company and going bankrupt.
I think the sad thing about scammers like this is they will eventually make it more difficult for legit indie developers to release good games that required lots of hard work, they will eventually bring more and more legal regulation onto the industry so that devs will have to jump through more and more hoops. Good luck exposing this stuff.
Yea, but not always since this situation is due to the scummy tactic they used to sell their “game” Legit Indie Developer usually don’t overprice their game this much and also the majority of them that I know of has demo of their game.
They could have went with "this is hurting sales and that's why we're taking it down" or "this is helping us actually so nyeh" but it makes zero sense to do both. They took down a video that was helping sales? Alright.
@@jauwn maybe the “legal notification” was also AI-generated? A generative AI trained on other frivolous DMCA claims seems like a likely source for such a bizarre complaint. I would like to think that an actual attorney would be smarter than to create a paper trail documenting a distinct lack of harm prior to legal action. Then again, there was that story about the lawyers who used ChatGPT in their filings and forgot to fact-check it. This led the attorneys to submit motions based on case precedents for cases _that never happened_ and getting into extremely hot water with the court.
As a law nerd and video game fan, I've looked into a looot of these instances and stuff and 1. it's always funny seeing game devs intentionally misuse the law and 2. I have NEVER seen a developer cope this much in their email to someone raising an issue lol

Advice to Game Devs: Just take your licks. You can bounce back from a bad game, maybe listen to criticism to make something better. Being known for false DMCA claims? That's when you're burning your own reputation and you're going to have a very hard time going back from that, not to mention the Streisand Effect.
The biggest discounts are still on Epic (sometimes also GoG) though: 100%. 😂 Well, Steam has up to 98% rebates on former AAA titles (or more on lesser ones) from time to time, but a game is rarely free to keep there.

I would urge you to use a virus scanner etc to make sure your PC is cleaned. Recently there have been scammers from Turkey very busy to get information of people by stating they have a game they want you to play and or test. This way they manage to get inside your pc without your firewall etc to say anything. I was also on the receiving end, these scammers are however not smart, so getting your accounts back should there for be fairly easy. Please spread the word to make sure no one falls for this and secures their online accounts, bank accounts etc.
This sounds more like recruiting children to a malicious distributed network. I expect that the individuals who do attempt this 3024 achievement, will receive a link to download a script that then uses their computers in a DDOS attack or a parallel brute force attack on something. There's a reason why you have to exit the game in order to participate since there are far easier ways to handle verification than the equivalent of a CD key.
I only just read the title, and I have to say, you go out of your way to freely promote this guy’s game, and he has the nerve to sue you for it? Talk about ungrateful.
Glad you got your video back, would have been, amusing to see him try to take you to court over this. Given your clear legal right. Granted I don't know the copyright laws in Turkey, he would have had to fight it in US court under US copyright.
Wait, isn't impossible for him to claim copyright on AI generated game content? I don't even know how what he's doing is remotely legal, if you put aside the abuse of the copyright claiming system.
I found this channel because I had also purchased this game from Steam and was confused about the whole concept. Then I saw a review for this game saying "Jauwn sent me here." And here I am. Crazy that the dev is a POS.
Easiest thing, they have to put money for that in a safe location, which goes to the accoused. I would say, they have to say the damage that the violention males, and half of thst has to be deposited (maybe full). Than the accoused can do the same, or leave it in 2 ways: saying is okay, and the other sides get the money back (and the video goes down), or can say please sue, and the money stays looked, but the video goes down. After the court, if the video is allowed to stay up, the money goes to the attacked. If it has to stay down, the attacker gets the money back, plus a small fine for the sttacked. (If the attacked take the money to counter, than the video stays up, and the attacker gets the money back until the court decides, and of it has to go down, the attacker gets the money the defender put into it, and if the video is allowed to stand, than the attacked gets the money back (+fine for the attacker)

...This is hilarious. Their logic on why their game isn't 'criminal' is because no one stopped them. That's not how Civil suits (which all suits related to this game would likely fall under...maybe some criminal suits from the government if they looked into it and even then it'd likely only become a criminal trial due to them not paying taxes) work, Civil suits need to have caused harm to someone (physical or financial) before anyone can even sue and the law gets involved and investigate what's going on and determine if what the dev did was legal or not (and take further action if need be). And as for the DMCA issue we all know UA-cam's DMCA system sucks as it lets basically anyone copyright someone else's video if they wanted and is easy to abuse...as for other video services they're probably about as bad besides on a few sites that don't alloy as much abuse with their DMCA system.

I’ll probably watch some more before I sub but I’m starting to like this channel. I like these kind of channels where they talk about games. I follow one that does list type videos about games and then another that goes into deep detail about singular games. They talk about regional versions and cuts it into section’s talking about gameplay, music and whatever else. This channel goes into great detail on horrible games you shouldn’t buy and I find that awesome!

I do hope things don't get too out of hand tho. A legal battle is still a battle after all. Good luck Jauwn.
I saw a game that was just black visuals (with a few dots of light now and again) but at least that one made sense to have none since you play as a blind girl and it acts like an interactive audio book having voice acting and sound effects to let you imagine what’s happening. However that game doesn’t seem like a scam at all unlike everything said about this game in the video. I just find it funny someone managed to make a good game that didn’t require visuals by just putting a bit of effort into audio and the game mentioned in the video couldn’t even do that having to use AI voice and try using an ARG as a lure to try to get people to give them money, the fact they ever charged $50 to begin with for a game they couldn’t even bother spending time on literally the only thing in the game (being audio) even when it literally had nothing else. What scum bags, also yeah that 100% sounds like a pyramid scheme and I should know my dad got tricked into one of those before. Games like this make me glad to be a console gamer where there are actual checks in place (at least most the time) to root out scummy devs like this. Anyways keep up the good work man!
If you're interested in games that don't lean on visuals to be engaging and have a story that hits you in the feels, I can't recommend "Hacknet" enough! I was crying when I got to the credits. I think it was a gamejam submission that lost but was such a solid execution that the developer finished it and gave us that gem.
Agreed. There's nothing wrong with trying to do something unique with your gameplay. And I would have no problem with this game if it was just simply bad. It's the fact that there's a "mystery" hiding behind the developer making a certain amount of money that makes me think this is more a scam than a game. Not including the AI-generated voices and stolen artwork
@@jauwn I've seen a game where you play as a blind sourcer, and you use vibrations, a complex system, you feel like your actually walking into this character's shoes. I think the sad thing about scammers like this is they will eventually make it more difficult for legit indie developers to release good games that required lots of hard work, they will eventually bring more and more legal regulation onto the industry so that devs will have to jump through more and more hoops. Good luck exposing this stuff.
Yea, but not always since this situation is due to the scummy tactic they used to sell their “game”
Legit Indie Developer usually don’t overprice their game this much and also the majority of them that I know of has demo of their game.

And as for the DMCA issue we all know UA-cam's DMCA system sucks as it lets basically anyone copyright someone else's video if they wanted and is easy to abuse...as for other video services they're probably about as bad besides on a few sites that don't alloy as much abuse with their DMCA system.
