    An ABNB is not an apartment you get to live in forever. It's basically a privately owned hotel room/suite. As much as I am not a fan at all of LTB, I agree with them.

    I can’t believe that a person renting an Air BNB actually thinks they have Landlord Tenant protections.
    Glad to see that the ABNB Host was successful but it should never have come to that situation. The renter essentially became a squatter that was trespassing on private property.

    These squatter expect airbnb to be a homeless shelter, and their ticket is a one night, long stay etc. My bet is they've cause trouble for other landlords before.

    Your renters and the landlord or their immediate family can move back into their home. Abnb or not..

    If you want ownership rights then buy you own dam house.
    Owners should have more rights than tenants.

    Since the LTB is failing landlords, I wouldn't be surprised if all rental properties in Canada become Airbnbs.

    You don’t own the home. If you are asked to leave, you should. Landlord is not doing anything wrong. Get out of her house.

      Although I agree an AirBNB contract is not a lease enforceable by the LTB., the renters in this case were forced to leave before the agreed upon expiration date of the contract. The renters should receive compensation from the owner for renegading and not fulfilling the agreement.

    Everyone is going to take advantage of any situation if they can get away with it. Don't rent your family home for extra cash.

    You shouldn’t let someone to stay for more than 1 month at airbnb. This airbnb renter obviously is exploiting a situation. If I rent out via airbnb, it’s because I don’t want to deal with the eviction crap. I feel terrible for this landlord to have to take 5 months to remove this renter. I hope she was covered by airbnb

      In this particular case the landlord wanted to take possession of the property before the end of the contract. The renters had an agreement to stay. It wasn't like the renters were staying illegally all that time, they just wanted the landlord to abide by the original terms of the contract. If it was a regular lease agreement the LTB would had intervened and upheld the renter's tenancy.

      Seriously, this family weren't squatters. They paid over value long term, the landlord made a fortune off of the family and then threw them out.

    So she ‘rents’ a temporary residence that belongs to someone else,& puts her kids in school? Strange even for AirBNB situations,of which they’re many.

    Air B & B are short term rentals PERIOD and everyone knows this .Unfortunately grifters like Ming will ALWAYS exist.The landlord did nothing wrong

I would hope AirBnB penalized the landlord and compensated the renter.

    A landlord has always had the right to take back a property for their own use, and they had an agreed upon checkout date, meaning the Airbnb guests were trying to violate a contract.

    is this really a win? the airbnb stay was to end at the end of June 2023. and they ended up seizing the propery in...the start of June 2023. While the host wanted to get them out much earlier it took about 5 months of work to do so.
    the host was VERY lucky that the LTB decided in her favor. If you pause the video you will see that one item of contention was that the host claimed they were paying a nightly rate - but the adjudicator felt the arrangement was much more likely as the renter described : a monthly rate. (which in my eyes would make it more like a monthly lease than a short term stay)
    If I was air bnb ing a property i would never agree to a stay more than 30 days. I would want to retain my abiltity to remove them as trespassers at the end of their stay if I needed to.
    I can see both sides here though and there is no 'right' side here. They entered a contract where the host agreed for the renter to stay there for a period. and for some reason the host changed their mind (they claimed there was an emergency of some sort that required the home to revert to her?) .
    If i was in the renter's shoes I would be pretty pissed about this too -> we agreed for me to rent it until a set date and now you want me out 5 months early?
    note that there did not seem to be an issue of not paying rent here. (they also did not mention whether the renter continued to pay rent while the issue was waiting for adjudication)

      Reform the LTB from the top down. They allow thousands of rent evaders to squat for more than a year while the eviction process plays out. That doesn’t just screw the landlord, that screws all Ontario renters by way of fewer repairs, less unit expansion, and little investor confidence and absolutely translates to higher rents.
      The proliferation of air bnb isn’t the disease, it’s the symptom. Why on earth would anyone put their property on the long term market for less money and more risk when they can retain the rights to the property and not enter a legal relationship with someone that might destroy them?

      @@Matt-YT Toronto already has the strictest Airbnb rules in all of Canada. They are the example of how to do it fairly. It’s not just hotels that should be allowed to rent a room. Anyone should be able to rent out their room in their primary residence as long as they follow the rules. Airbnb isn’t the problem. Aggressive immigration is the problem

      @@Matt-YT That's going too far. There needs to be correct zoning. Toronto has done a wonderful job regulating and enforcing Airbnb. The rest of the country should take stock and do the same. That would be the fair and balanced approach for all Canadians not just the tenants and rentors.

    Can we evict the AirBNB owners? I'd love to see that. AirBNB doesn't qualify for landlord protection, because most of them aren't local owners....in a great sense of karma the AirBNB owner should be watched and forced to pay for empty unit taxes. They are a large contributor to homelessness, increased housing costs and why our population can't afford housing in general.

    I understand why it was ruled in the LL’s favour but what I don’t understand is how the tenants were removed prior to the June 30 expiry of their stay. Let’s say it was short term, 2 weeks; can an airbnb host end a visitors booking early without cause such as a guest violation? Or can a host end a guests stay early simply because the host wants to return home?

      A landlord has the right to terminate a contract if they need the property for themselves or their immediate family. This has been the law for decades.

      Air BNB also gives landlords the right to cancel reservations. It's not encouraged and it's usually not without penalties, but it's allowed.

    My recent ruling in an LTB case should also be cause for concern to tenants. I'm going to OMBUSMEN About it. It was soooo unjust. Incredibly unfair and shady.
