Working as a flight attendant, you get to see people as they really are. I served Mr. Henley three separate times over a period of about 15 years. Twice he was traveling with one of the most beautiful woman I’ve ever seen. He was such a miserable prick. I can’t imagine being so unhappy with life. The lady he was traveling with, was doing her best to calm him down and smooth things over for him, but he insisted on being miserable. The third and final time he boarded our flight he was alone. I guess that sweet beautiful lady he was traveling with finally had enough of his BS.

Leland Sklar got a copyright strike against a play-long with a James Taylor song that he played on. A couple days and a lot of fan pressure later (possibly even from James) and the strike was removed.
James Taylor himself has had problems performing his own songs on UA-cam. He got blocked by his own publishing company doing a live performance OF HIS OWN SONG. It's insane.

I grew up with a healthy diet of the Eagles. I loved every song the produced. I went on to become a musician and loved playing several Eagles songs. In the last few years however, the way Henley has acted toward small time musicians has completely put me off their music! I can’t listen to any of it anymore :(

I saw a recent 2023 UA-cam video where Don Felder played many of the Eagles hits in a concert, most of which were not written by him. I wonder how Don Felder was able to get away with that? Prior to that I had not heard him singing any Eagles songs except Hotel California, which he co-wrote. How come?
@@lukasfoo I forget the dates on this. Felder ask to see the financial books on the Eagles and was told on Monday, instead Henley and Frey fired him on Monday. Felder being a full member sued and got a "Huge" settlement including the right to perform any Eagles material any time he choose. Randy Meisner and Bernie Leaden were ran off and paid 12 and 8 million respectively. Don Felder new his legal rights and "Reamed" them out evidently. Some say Felder's settlement included 50 million, rights to play the music, which he does often, and future royalties.

That very interesting solo, a part of it anyway, is actually played by Rick B as an example of a specific set of notes that make up a specific scale I think it was. Andolucian I believe. It sounds so similar to the solo part.

Same thing has happened to Jimi Hendrix. His estate is just like Don Henley, thus he and his music are being forgotten. Less people know about Hendrix than the Eagles. They are literally shooting themselves in the foot. It makes absolutely no sense.
No matter what kind of venue I play; I always crank up my voice harmonizer, for my first song; Seven Bridges Road. It's a head turner. I started guitar late in life, played open jams to learn, and when I did Peaceful Easy Feeling my way, and the other players weren't digging it. I started writing my own songs. 400 Originals later, I've actually received 2 royalty checks ( yup. big money ,right?) What an honor as a Songwriter that someone else wants to play your Original. Don Henley, you get your money. Don't forget how it feels to have someone honor you by playing your creation. So. Sad times for music. Why do people do this? They should be proud that others love their stuff so much to care about learning it and taking it out to the world. And everyone knows who originally wrote those songs. As long as you don’t claim someone elses songs as your own, no harm is done.
People are monetizing off his work. It's one thing to play a cover, but it's another ball of wax for "influencers" to have channels completely dedicated to profiting off other people's music. The influencer thing is out of control.
So, you learn his song and put it on youtube. You ma have worked hard, and did do it for money,, But, UA-cam made money off the ads. So, that makes a little sense. If you could not have commercials, then it would be fine for everyone.
Because it’s not about love. It’s using a song that is known to further your own career. I don’t see why these people playing guitar on UA-cam think everybody wants to hear their cover of some popular song. You’re forgetting that UA-cam had made it next to impossible for truly gifted artists to get ahead. Now they’re dealing with 600 others playing what they are. Who cares at that point? It’s a bunch of nobodies showing how easy it is to be a nobody. Try writing original music. Once you do you’ll probably realize why so few are going that route (people aren’t interested in most players, sorry).

I posted a video I made at a Christmas light show that changed with the melody of "Kids On Christmas", which I'd never even heard of. I didn't monetize it, but youtube still sent a notice that I couldn't, but there was no strike. As to Henley, he is and always has been an a-hole, and not just toward musicians.
I got two strikes within 15 minutes - both guitar only demos (Hotel California and Boys Of Summer). I had to remove about 27 Eagles demos. I managed to put a few back up credited to the actual writers (Tom Waits, Gene Clark, Bernie Leadon, Jackson Browne etc). I don’t promote the Eagles in any way now which makes me a little sad. DH really is destroying the once rich legacy of that band.

Your suggestion of doing a search before you post a song is a good one. You can also upload a video as private and UA-cam will tell you if the copyright owner will claim it. Although, by that time, you've already put in the work to make the video. Also, there are a few artists who are known to object to covers of their songs but it seems to depend on numbers. So, if you post your cover of "Summer of '69" and you only get 50 views, then maybe Adams won't bother you. But, if it gets 10,000 views, that may be another thing. Ironic since that would mean more money for him.
You can get strikes from videos you posted years ago. I've only had one strike against me, it was for a video w/ fewer than 300 views and posted 8 years ago.
I just got my first copyright strike for playing on my guitar the first few opening bars of Witchy Woman with no other instrument backing. Emailing the Universal email address resulted in no response. Haven't decided whether to fight it via UA-cam or not. Suggestions?

I posted a video of my band singing live a number of years ago. I had a copyright strike from the Eagles. We weren't singing any Eagles songs but our name was Too Many Hands which happens to be an Eagles song. I appealed but in this day and age you have no power against UA-cam or assholes like the Eagles or Don Henley.

I've had good fun with this. When I got excited about uploading youtube videos in 2018, I was aghast when I had a copyright strike. I had one strike and one copyright claim. The songs were "Peaceful Easy Feeling" (Eagles) and "The River" (Bruce Springsteen). I don't remember which one was the claim and which one was the strike. I had one friend who saw the immense humour given that my chops in 2018 were so rudimentary. To this day, it's a running joke. I haven't had a "strike" since despite uploading many covers. I've covered "Slowdive" five times and they haven't once placed a copyright claim (very cool cast of characters). Lately, I've been revisiting "The Last Resort" to remind myself of Henley's immense talent. One day he may look back and conclude that this internet policing initiative has all been much "Wasted Time".
Great story and thanks for sharing. If artists like don Henley want their music to stand the ultimate test of time then his approach is going to assure that his music doesn’t. If the next generation and future generations don’t get to embrace and play your music freely and you don’t even allow people to teach your music it’s inevitable.

Great video - I love your channel! An extra note of caution to your viewers - I have a very, very small UA-cam channel for my band with a few traditional folk tunes and songs plus the odd cover. Bizarrely, our version of the traditional song 'The Parting Glass' was taken down! My understanding is that its a 300 year old traditional song that has been sung and recorded by many, many artists, and I didn't even stop to wonder if anyone owned or would claim the copyright, but it looks like someone has! 😮
Sometimes people will cover a song and release it… once they do that UA-cams content ID may pick it up then they “claim” it. Sometimes they don’t even have the right to do so. Did you see the name of the group or publishing organization that made the claim?

If you were monetized then you would be "sharing" revenue with the original copyright holder of the song. They may be taking the lions share of your revenue but still no negative effect on the channel. but DH just doesnt want his material covered. so he uses aggressive tactics such as the "Strike". Its not about money its about ....well i don't know what the heck its about actually we would have to ask DH... This was exactly why my last UA-cam channel got taken down. It had several Eagles/Don Henley covers on there, and I found out the hard way that UA-cam and Facebook aren't places for covering those artists' music. I had to start over with a new UA-cam channel, and I left the Eagles and Don Henley alone since.
Wow! I knew a tad about copyright issues, including on social media, but this taught me a lot. Thank you. I didn't realize the specifics, AND that they got PAID for those songs/videos...which makes this even more absurd. I do believe in an artist being able to protect their work & in another person having to share profits from such use...IF the person is making a lot from it. But, from some 12-yr-old in Iowa showing his/her talents on UA-cam, or someone trying to establish themselves as an artist, I find such aggressive copyright protection to be greedy & offensive. From what I’ve read up on it. I can kind see his point. If I was the co-founder of a band and MY songs were the ones that branded the band so to speak I wouldn’t like to see someone else use my bands name and songs … cuz it’s not like they are “covering” the material they are playing under the name of the band itself.
This time of year I normally do an open air thing at the Farmers Market in our local park. This year they stopped because of this crap. They're afraid someone will post a video and ASCAP will see it. They like to sue venues because of copyright issues. The thing is, all musicians learn from one another. And every performance is in and of itself and when I do covers I really try to make them my own interpretation.
I have a buddy who owns a pizzeria/restaurant. He decided to do an open mic on Tuesday nights. It’s literally 15 or so men and women in their 60s and 70s sitting around playing some songs on their acoustics. Some covers some originals. ASCAP starting going after him to the tune of 3k a year for him to have this open mic. SMH

You can post covers on Spotify, iTunes, Amazon Music and the other streamers. As long as you're not uploading a video, you're golden. Those music streaming services pay the license(s) needed to legally play songs, originals, covers or otherwise. Bryan Adams and Led Zeppelin will also have your video of their songs taken down. Henley is addicted to litigating people as much as anyone with cosmetic surgery addiction. Leland Sklar, the renowned bass player, had a video taken down because he was filming while walking past a bar that was playing "Dirty Laundry." Those 8 seconds earned him a copyright strike. I hope someone with means, and the time, sues Henley for lip-synching during his "live" Eagles' performances.

Musicians do not have the legal right to prevent people from playing covers, as long as appropriate royalties are paid. But UA-cam doesn't want to put forth the effort of dealing with it.
You can cover anything you like. And those who write the songs STILL hold rights (such as synchronization rights) over those covers which need clearance. Welcome to the adult world of copyright laws.
To put it another way: musicians DO have the legal right to collect royalties for people playing or using their copyrighted material for commercial purposes.
@@sm5574 mechanical royalties cover audio recordings. You can cover a song and pay the mechanicals without permission from the songwriter/publisher. Music synchronized to video must have a sync license which is a different kettle of fish. Sync licenses are negotiated individually and require permission.
If someone released a version of Take It Easy and Henley tried to copyright strike it, could they counter argue that they were performing Jackson Browne's version, not the Eagles' ?

Speaking of rabbit holes, there are actually two parts to a song that have separate copyrights. The first is the song itself (lyrics,melody, etc). The authors of the song (or their contracted partners such as record companies or publishing companies) own this. The second is the Sound Recording of the song. This is separate and belongs to the performers or their contracted partners. If Joe Nobody records a cover of a copyrighted song, the only royalties due are those for the mechanical. If UA-cam grabs all the revenue and gives it to the owner of the mechanical, the performer is getting cheated. To be honest, I have no idea how UA-cam channels the revenue from a cover, so it might not be an isssue at all. But it bears mentioning, especially if Joe Nobody’s cover blows up and becomes a major hit with millions and millions of views.
Bitter old man describes most of the people complaining about copyright strikes, channels being shutdown etc. because they posted things violating the UA-cam terms and agreements they agreed to follow when they started their channels.
I played Desperado at a talent show at my church, and then uploaded the video to UA-cam. It was banned before it even completely uploaded. Apparently my performance of their song at a church talent show is going to take money away from their recordings. Something needs to be done. On the one hand, I believe someone needs to be compensated for their work, but things have gotten way out of hand. Performance is as much an art as composing and not every musician can write good music. Musicians have been performing for thousands of years without writing their own music, and it's only in the 20th century that musicians have started being banned from performing the works of composers due to copyright law.
I posted a video years ago about installing siding on a house. The neighbors had some music playing that evidently got picked up in the recording. The only way you could even hear it was if speakers were at full volume but youtubes system picked it up and down went my instructional video I'd spent hours on.
Boys Of Summer had been one of my all time favorite songs since the first time I heard it. I have a UA-cam channel with 180 acoustic covers on it, so of course I put my cover of Boys Of Summer on my channel. A year or two ago I heard a live Hendrix song on a random UA-cam channel and thought the Hendrix estate must have finally lifted their draconian (and stupid) ban on others posting his music. So a couple days later I uploaded five or six live Hendrix songs I had from a great CD that I got a long time ago to my UA-cam channel. I figured they would be flagged if there was a copyright violation and that if there wasn't, the videos would be de-monitized at least (so any revenue from views would go to the Hendrix estate, which I thought was perfectly reasonable. I wasn't after money or clicks - just wanted to share some great, rare, clean live versions of some songs with fellow fans.) About a week or two later, I was informed by UA-cam that one of these videos had received a copyright strike from Sony Music and as such had been taken down. I immdiately took down the remaining videos and promptly wrote an email to Sony explaining the situation and apologizing for my accidental infringement. Needless to say, they did not respond nor did they take back my strike. Sadly, I now hold a grudge against Sony and Hendrix's estate and basically avoid anything they are tied to. Let them all fade away.

And the sad thing is that anyone taking the time to learn an Eagles song is most likely a devoted fan of the band. There are other reasons to learn a song. Like maybe to make yourself a better musician so you can incorporate their sounds and stylings into your music. But no no: it’s all about tribute. Lol.
In the UK I got my 17 Eagles covers/tutorials - muted, blocked, restricted in other countries...but never got a strike from them...then a friend of mine got his video "struck" so I deleted all 17...no more eagles (or DH)...others you need to watch out for are: Supertramp (Instant strike!) and Prince....but dunno the situation since he died...Prince actually gave me a strike for 1999.
You should be ok there. The venue if they have live music pays fees yearly to the publishing organizations (who usually bully them and shake them down btw) but that’s for a separate video I suppose
Henley is the perfect example of how to completely alienate your fanbase and guarantee you'll never make another dollar off your precious royalties. I used to love the Eagles back in the 70's and 80's, but this guy is a real piece of work. The biggest turn off for me, is when an artist does this crap to people who love their music and want to share it. I can see them being pissed off if you do a terrible cover that is emberassing to watch, or if you try and claim it as your own..I'm fortunate in that I don'tlike most of the popular and over rated stuff anyways. and my channel's not monetized. But it is still annoying.

Don Henley is an amazingly gifted musician and song writer. But….. This beyond crazy. I personally believe that fame and fortune have become his downfall. Henley's the king of the blockers, besting even McCartney. No music channel I follow even touches the Eagles or Henley because of this. For what it's worth my preferred version of "The Boys of Summer" is The Ataris version, partially for this reason and partially because I just prefer it.

I wish I could say I’m surprised by this, unfortunately, I’m not. I remember watching the eagles documentary several years ago. I was struck by the commentary by Glen Frey. He said that when they got the original lineup back together in the nineties, that he and Henley would be paid more than the other members. His reasoning was that only he and Henley were the only members that went on to successful solo careers post eagles. I believe his words were they were the only two “ that did anything “. I was taken back by this. The truth is, they wanted more because they thought they were better than the others and because they were greedier. Based upon what I’m seeing and hearing in this video,Henley is still greedy.

Prince and his team were this way 20 years or so ago, not sure if the team still is. I got a copyright strike for a 10 second Prince song snippet in my daughter’s school project video.

I think your advice is correct and I think everybody should boycott all HENLEY OR EAGLES material…in terms of covering and uploading to any streaming services. DON’T DO ANY OF THEM , NO EAGLES!! I also refuse to cover them in any live performances I CONTROL. Here in Germany, the US organizations ASCAP and BMI have a contract with the corresponding organzation in Germany so the German organization is selling the licenses for the two US organizations. Years ago, the German organization argued that there is too much copyright infringement on UA-cam and made UA-cam sign a contract so UA-cam had to pay license fees (covering videos watched in Germany only, of course). The point is: German law more or less says: If a composer is member of such an organization (BMI ...), cover versions of his songs are allowed as long as the license fees are paid. (Composers not being member of such organizations have the right to forbid cover versions.) And because of the contract, UA-cam does pay the license fees. Now my question would be if UA-cam does not have a similar contract with BMI or ASCAP in the USA?

I quit having Henley's songs on my channel when I started hearing the rumors. My 76K subscriber channel is a blip in the world of social media but I can't risk losing it because, as you say, it's one of the ways I make a living. I don't have an issue with sharing income with copyright owners -- it's their song after all -- but it's EVIL to issue a copyright strike.
Good video. Man, there's a lot to say about this subject. Some legalese person was harassing the bars here in my home town that had live music saying they had to join two different groups so the artists who were in these groups of music providers would get paid. It was all over copyright. A bunch of bars just quit having live music. I can't remember exactly but to be safe it was going to cost each bar about two grand per year. When you're not a club, just a bar, there's no way to ever make that money back. It took two bar owners to have a spine, tell the rep to GFY and take me to court. It went away. I think back to college. There was a band at a club I liked to go to that covered Steely Dan's "My Old School". That's where I heard it. That's where I fell in love with Steely Dan. Fast forward fifty years and I own tons of Steely Dan on at least three formats. People that push this are so short sighted.

About 20 or so people each taking a turn getting up and singing a mix of covers and originals. He started getting harassed by the organizations … would have cost a couple grand a year. Yep, my female duo partner and I played a live cover of "Hotel California." Just 2 electric guitars and 2 voices ---- nothing else, with some audience chatter included. I played both parts of the famous solo alone, switching pickups to mimic 2 different guitars, and I made very few mistakes. Naturally I couldn't duplicate the dual guitars section by myself, but overall it sounded good, IMHO. Our "manager" uploaded the video onto UA-cam unbeknownst to us. It was there for a while, and lot of people liked it, but suddenly it "disappeared" from UA-cam. Were we that bad or that good?? I'll never know, but I DO know the video still exists on our Facebook page, so Henley or whoever can KMA.

Yes, it is an issue. And as others point out, even having a radio playing in the background while videoing can get you in trouble here. That said, this is 2024 and it is SO easy to find out the major "problem" Groups or Singers. They are well known. When in doubt, just do a simple search. Again, this is 2024, come on. That said, the whole fair use issue really needs to be reexamined by courts.

Working as a flight attendant, you get to see people as they really are. I served Mr. Henley three separate times over a period of about 15 years. Twice he was traveling with one of the most beautiful woman I’ve ever seen. He was such a miserable prick. I can’t imagine being so unhappy with life. The lady he was traveling with, was doing her best to calm him down and smooth things over for him, but he insisted on being miserable. The third and final time he boarded our flight he was alone. I guess that sweet beautiful lady he was traveling with finally had enough of his BS.

I grew up with a healthy diet of the Eagles. I loved every song the produced. I went on to become a musician and loved playing several Eagles songs. In the last few years however, the way Henley has acted toward small time musicians has completely put me off their music! I can’t listen to any of it anymore :(

I saw a recent 2023 UA-cam video where Don Felder played many of the Eagles hits in a concert, most of which were not written by him. I wonder how Don Felder was able to get away with that? Prior to that I had not heard him singing any Eagles songs except Hotel California, which he co-wrote. How come?

Felder being a full member sued and got a "Huge" settlement including the right to perform any Eagles material any time he choose. Randy Meisner and Bernie Leaden were ran off and paid 12 and 8 million respectively. Don Felder new his legal rights and "Reamed" them out evidently. Some say Felder's settlement included 50 million, rights to play the music, which he does often, and future royalties.
I may have overstated what Meisner and Leaden got paid.

That very interesting solo, a part of it anyway, is actually played by Rick B as an example of a specific set of notes that make up a specific scale I think it was. Andolucian I believe. It sounds so similar to the solo part.

No matter what kind of venue I play; I always crank up my voice harmonizer, for my first song; Seven Bridges Road. It's a head turner. I started guitar late in life, played open jams to learn, and when I did Peaceful Easy Feeling my way, and the other players weren't digging it. I started writing my own songs. 400 Originals later, I've actually received 2 royalty checks ( yup. big money ,right?) What an honor as a Songwriter that someone else wants to play your Original. Don Henley, you get your money. Don't forget how it feels to have someone honor you by playing your creation. So. Don, or Frank, or UA-cam Folks, if you want to play " Somewhere East of A1A" , key of D#, go ahead and help me remember why I wrote songs in the first place!! Sad times for music. Why do people do this? They should be proud that others love their stuff so much to care about learning it and taking it out to the world. And everyone knows who originally wrote those songs. As long as you don’t claim someone elses songs as your own, no harm is done.
People are monetizing off his work. It's one thing to play a cover, but it's another ball of wax for "influencers" to have channels completely dedicated to profiting off other people's music. The influencer thing is out of control.

I got two strikes within 15 minutes - both guitar only demos (Hotel California and Boys Of Summer). I had to remove about 27 Eagles demos. I managed to put a few back up credited to the actual writers (Tom Waits, Gene Clark, Bernie Leadon, Jackson Browne etc). I don’t promote the Eagles in any way now which makes me a little sad. DH really is destroying the once rich legacy of that band.

Your suggestion of doing a search before you post a song is a good one. You can also upload a video as private and UA-cam will tell you if the copyright owner will claim it. Although, by that time, you've already put in the work to make the video. Also, there are a few artists who are known to object to covers of their songs but it seems to depend on numbers. So, if you post your cover of "Summer of '69" and you only get 50 views, then maybe Adams won't bother you. But, if it gets 10,000 views, that may be another thing. Ironic since that would mean more money for him.
You can get strikes from videos you posted years ago. I've only had one strike against me, it was for a video w/ fewer than 300 views and posted 8 years ago.
I just got my first copyright strike for playing on my guitar the first few opening bars of Witchy Woman with no other instrument backing. Emailing the Universal email address resulted in no response. Haven't decided whether to fight it via UA-cam or not. Suggestions?

We weren't singing any Eagles songs but our name was Too Many Hands which happens to be an Eagles song. I appealed but in this day and age you have no power against UA-cam or assholes like the Eagles or Don Henley.
I appealed a copyright claim for a song written in the 1800's and it wasn't taken down. It's not just Henley, it's the bots.

I've had good fun with this. When I got excited about uploading youtube videos in 2018, I was aghast when I had a copyright strike. I had one strike and one copyright claim. The songs were "Peaceful Easy Feeling" (Eagles) and "The River" (Bruce Springsteen). I don't remember which one was the claim and which one was the strike. I had one friend who saw the immense humour given that my chops in 2018 were so rudimentary. To this day, it's a running joke. I haven't had a "strike" since despite uploading many covers. I've covered "Slowdive" five times and they haven't once placed a copyright claim (very cool cast of characters). Lately, I've been revisiting "The Last Resort" to remind myself of Henley's immense talent. One day he may look back and conclude that this internet policing initiative has all been much "Wasted Time".
Great story and thanks for sharing. If artists like don Henley want their music to stand the ultimate test of time then his approach is going to assure that his music doesn’t. If the next generation and future generations don’t get to embrace and play your music freely and you don’t even allow people to teach your music it’s inevitable.

Great video - I love your channel! An extra note of caution to your viewers - I have a very, very small UA-cam channel for my band with a few traditional folk tunes and songs plus the odd cover. Bizarrely, our version of the traditional song 'The Parting Glass' was taken down! My understanding is that its a 300 year old traditional song that has been sung and recorded by many, many artists, and I didn't even stop to wonder if anyone owned or would claim the copyright, but it looks like someone has! 😮
Sometimes people will cover a song and release it… once they do that UA-cams content ID may pick it up then they “claim” it. Sometimes they don’t even have the right to do so. Did you see the name of the group or publishing organization that made the claim?

If you were monetized then you would be "sharing" revenue with the original copyright holder of the song. They may be taking the lions share of your revenue but still no negative effect on the channel. but DH just doesnt want his material covered. so he uses aggressive tactics such as the "Strike". Its not about money its about ....well i don't know what the heck its about actually we would have to ask DH... This was exactly why my last UA-cam channel got taken down. It had several Eagles/Don Henley covers on there, and I found out the hard way that UA-cam and Facebook aren't places for covering those artists' music. I had to start over with a new UA-cam channel, and I left the Eagles and Don Henley alone since.

I didn't realize the specifics, AND that they got PAID for those songs/videos...which makes this even more absurd. I do believe in an artist being able to protect their work & in another person having to share profits from such use...IF the person is making a lot from it. But, from some 12-yr-old in Iowa showing his/her talents on UA-cam, or someone trying to establish themselves as an artist, I find such aggressive copyright protection to be greedy & offensive. What do you think of Burton Cummings stopping the Guess Who from preforming any song he wrote while in the Guess Who?
From what I’ve read up on it. I can kind see his point. If I was the co-founder of a band and MY songs were the ones that branded the band so to speak I wouldn’t like to see someone else use my bands name and songs … cuz it’s not like they are “covering” the material they are playing under the name of the band itself.
This time of year I normally do an open air thing at the Farmers Market in our local park. This year they stopped because of this crap. They're afraid someone will post a video and ASCAP will see it. They like to sue venues because of copyright issues. The thing is, all musicians learn from one another. And every performance is in and of itself and when I do covers I really try to make them my own interpretation.
I have a buddy who owns a pizzeria/restaurant. He decided to do an open mic on Tuesday nights. It’s literally 15 or so men and women in their 60s and 70s sitting around playing some songs on their acoustics. Some covers some originals. ASCAP starting going after him to the tune of 3k a year for him to have this open mic. SMH
Playing a song live isn’t copyright. If someone else uploads it, that’s their issue. The people running the market obviously don’t know that.

You can post covers on Spotify, iTunes, Amazon Music and the other streamers. As long as you're not uploading a video, you're golden. Those music streaming services pay the license(s) needed to legally play songs, originals, covers or otherwise. Bryan Adams and Led Zeppelin will also have your video of their songs taken down. Henley is addicted to litigating people as much as anyone with cosmetic surgery addiction. Leland Sklar, the renowned bass player, had a video taken down because he was filming while walking past a bar that was playing "Dirty Laundry." Those 8 seconds earned him a copyright strike. I hope someone with means, and the time, sues Henley for lip-synching during his "live" Eagles' performances.
Well Don Henley is getting his just desserts for it now because he's single handedly ensuring that nobody from New generations even know who the Eagles are.

You obviously underestimate the younger generation's ability to discover previously unknown music. My kid didn't need to discover bands/musicians from social media. I didn't back in the Eighties either. I am a Clapton fan, and read he was heavily influenced by Robert Johnson, Robert Cray, BB King etc.

Musicians do not have the legal right to prevent people from playing covers, as long as appropriate royalties are paid. But UA-cam doesn't want to put forth the effort of dealing with it.
You can cover anything you like.
And those who write the songs STILL hold rights (such as synchronization rights) over those covers which need clearance.

To put it another way: musicians DO have the legal right to collect royalties for people playing or using their copyrighted material for commercial purposes.
@@sm5574 mechanical royalties cover audio recordings. You can cover a song and pay the mechanicals without permission from the songwriter/publisher. Music synchronized to video must have a sync license which is a different kettle of fish. Sync licenses are negotiated individually and require permission.

Speaking of rabbit holes, there are actually two parts to a song that have separate copyrights. The first is the song itself (lyrics,melody, etc). The authors of the song (or their contracted partners such as record companies or publishing companies) own this. The second is the Sound Recording of the song. This is separate and belongs to the performers or their contracted partners.
If Joe Nobody records a cover of a copyrighted song, the only royalties due are those for the mechanical. If UA-cam grabs all the revenue and gives it to the owner of the mechanical, the performer is getting cheated. To be honest, I have no idea how UA-cam channels the revenue from a cover, so it might not be an isssue at all. But it bears mentioning, especially if Joe Nobody’s cover blows up and becomes a major hit with millions and millions of views.

I played Desperado at a talent show at my church, and then uploaded the video to UA-cam. It was banned before it even completely uploaded. Apparently my performance of their song at a church talent show is going to take money away from their recordings. Something needs to be done. On the one hand, I believe someone needs to be compensated for their work, but things have gotten way out of hand. Performance is as much an art as composing and not every musician can write good music. Musicians have been performing for thousands of years without writing their own music, and it's only in the 20th century that musicians have started being banned from performing the works of composers due to copyright law.

I posted a video years ago about installing siding on a house. The neighbors had some music playing that evidently got picked up in the recording. The only way you could even hear it was if speakers were at full volume but youtubes system picked it up and down went my instructional video I'd spent hours on.

A year or two ago I heard a live Hendrix song on a random UA-cam channel and thought the Hendrix estate must have finally lifted their draconian (and stupid) ban on others posting his music. So a couple days later I uploaded five or six live Hendrix songs I had from a great CD that I got a long time ago to my UA-cam channel.
I figured they would be flagged if there was a copyright violation and that if there wasn't, the videos would be de-monitized at least (so any revenue from views would go to the Hendrix estate, which I thought was perfectly reasonable. I wasn't after money or clicks - just wanted to share some great, rare, clean live versions of some songs with fellow fans.)
About a week or two later, I was informed by UA-cam that one of these videos had received a copyright strike from Sony Music and as such had been taken down. I immdiately took down the remaining videos and promptly wrote an email to Sony explaining the situation and apologizing for my accidental infringement. Needless to say, they did not respond nor did they take back my strike.
Sadly, I now hold a grudge against Sony and Hendrix's estate and basically avoid anything they are tied to. Let them all fade away.
Jimi wouldn't agree with what Sony and his estate are doing, that's for sure. Greed.
Henley's no JImi, which is why Henley's music will be gone in 100 years and Jimi's will still be with us

There are other reasons to learn a song. Like maybe to make yourself a better musician so you can incorporate their sounds and stylings into your music.

In the UK I got my 17 Eagles covers/tutorials - muted, blocked, restricted in other countries...but never got a strike from them...then a friend of mine got his video "struck" so I deleted all 17...no more eagles (or DH)...others you need to watch out for are: Supertramp (Instant strike!) and Prince....but dunno the situation since he died...Prince actually gave me a strike for 1999.

You should be ok there. The venue if they have live music pays fees yearly to the publishing organizations (who usually bully them and shake them down btw) but that’s for a separate video I suppose
Henley is the perfect example of how to completely alienate your fanbase and guarantee you'll never make another dollar off your precious royalties. I used to love the Eagles back in the 70's and 80's, but this guy is a real piece of work. Great advice . On a side note during covid our band live streamed a basement performance on FB and the stream got shut down during a cover tune . Not the Eagles , I forget exactly what song but these things happen .

Thanks for making this video, the more people near about this issue, the more likely it will be fixed. The biggest turn off for me, is when an artist does this crap to people who love their music and want to share it. I can see them being pissed off if you do a terrible cover that is emberassing to watch, or if you try and claim it as your own..I'm fortunate in that I don'tlike most of the popular and over rated stuff anyways. and my channel's not monetized. But it is still annoying.

This beyond crazy. I personally believe that fame and fortune have become his downfall. Greed, pride, narcissism… and so on are not good traits.
I agree with Frank on the point that people doing covers of their songs are actually helping the song writer.
Henley has enough money and notoriety that can last more than one lifetime.

Henley's the king of the blockers, besting even McCartney. No music channel I follow even touches the Eagles or Henley because of this. For what it's worth my preferred version of "The Boys of Summer" is The Ataris version, partially for this reason and partially because I just prefer it.

I wish I could say I’m surprised by this, unfortunately, I’m not. I remember watching the eagles documentary several years ago. I was struck by the commentary by Glen Frey. He said that when they got the original lineup back together in the nineties, that he and Henley would be paid more than the other members. His reasoning was that only he and Henley were the only members that went on to successful solo careers post eagles. I believe his words were they were the only two “ that did anything “.
I was taken back by this. The truth is, they wanted more because they thought they were better than the others and because they were greedier. Based upon what I’m seeing and hearing in this video,Henley is still greedy.

I've been on YT for 18 years,since 2006. Last week I got my first YT strike for my non-monetized version of "The Boys of Summer", which I posted last Feb. My apologies to the Henley's for...Taking food off the Henley Family table. Once I've had a video taken down , (no strike), for Jimi Hendrix and AC/DC playing in the background.

I think your advice is correct and I think everybody should boycott all HENLEY OR EAGLES material…in terms of covering and uploading to any streaming services. DON’T DO ANY OF THEM , NO EAGLES!! I also refuse to cover them in any live performances I CONTROL. Here in Germany, the US organizations ASCAP and BMI have a contract with the corresponding organzation in Germany so the German organization is selling the licenses for the two US organizations. Years ago, the German organization argued that there is too much copyright infringement on UA-cam and made UA-cam sign a contract so UA-cam had to pay license fees (covering videos watched in Germany only, of course). The point is: German law more or less says: If a composer is member of such an organization (BMI ...), cover versions of his songs are allowed as long as the license fees are paid. (Composers not being member of such organizations have the right to forbid cover versions.) And because of the contract, UA-cam does pay the license fees.
Now my question would be if UA-cam does not have a similar contract with BMI or ASCAP in the USA?

I quit having Henley's songs on my channel when I started hearing the rumors. My 76K subscriber channel is a blip in the world of social media but I can't risk losing it because, as you say, it's one of the ways I make a living. I don't have an issue with sharing income with copyright owners -- it's their song after all -- but it's EVIL to issue a copyright strike.

Good video. Man, there's a lot to say about this subject. Some legalese person was harassing the bars here in my home town that had live music saying they had to join two different groups so the artists who were in these groups of music providers would get paid. It was all over copyright. A bunch of bars just quit having live music. I can't remember exactly but to be safe it was going to cost each bar about two grand per year. When you're not a club, just a bar, there's no way to ever make that money back. It took two bar owners to have a spine, tell the rep to GFY and take me to court. It went away. I think back to college. There was a band at a club I liked to go to that covered Steely Dan's "My Old School". That's where I heard it. That's where I fell in love with Steely Dan. Fast forward fifty years and I own tons of Steely Dan on at least three formats. People that push this are so short sighted.

Yep, my female duo partner and I played a live cover of "Hotel California." Just 2 electric guitars and 2 voices ---- nothing else, with some audience chatter included. I played both parts of the famous solo alone, switching pickups to mimic 2 different guitars, and I made very few mistakes. Naturally I couldn't duplicate the dual guitars section by myself, but overall it sounded good, IMHO. Our "manager" uploaded the video onto UA-cam unbeknownst to us. It was there for a while, and lot of people liked it, but suddenly it "disappeared" from UA-cam.

Yes, it is an issue. And as others point out, even having a radio playing in the background while videoing can get you in trouble here. That said, this is 2024 and it is SO easy to find out the major "problem" Groups or Singers. They are well known. When in doubt, just do a simple search. Again, this is 2024, come on.
That said, the whole fair use issue really needs to be reexamined by courts.

Went to see Don Henley in Sydney quite a few years back. Very disappointed that there were no screens as our seats weren’t great. The venue told me that Don wouldn’t pay to operate the screens. What a tight ass
