- The Federal Trade Commission (FTC) voted 3-2 on Tuesday to ban noncompete agreements that prevent tens of millions of employees from working for competitors or starting a competing business after they leave a job.

Think about this lol. Company lays off hundreds of employees during the beginning of Covid. Then says, “oh btw not only can you not work here..but you can’t work for any other company in this industry.” That’s what happened in the logistics industry and has been happening for years. This is good.
My very first employer out of college presented me with one of these as an "oh and by the way..." They already had me all set up at a desk, and everything. So it's either stay with this company forever, or go stock grocery shelves?
These never should have been legal.

I can't wait for corporate America with their 10 private jets to start complaining about how unfair this decision is for them not the workers. That's the thing about corporate America. It's always about them, never about the workers who made them be able to afford 10 private jets in the first place. Have to worry about company secrets getting out then patent the idea. Remember anyone who's against this bill will always look at it in a business perspective rather than the employees who is barely making a living.
America needs to ban executive owning their own private jet and lease it back to the company. are you aware this is the biggest tax loophole. The executive then gets to write off his plane from his income tax. This is one reason they pay so little in tax.

Power grab has been by companies adopting the practice of non compete agreements. I understand some cases this is needed, but come on a roof installer! I saw a comment where it was obviously food service and the person said they developed a “amazing brisket recipe” and this would hurt their business to not have non compete. Really…I think you can get a dozen amazing brisket recipes off the internet🙄

Okay, but what do we need to do to deal with the US Chamber of Commerce's decision to sue? This is egregious.
They can't. It is unconstitutional. The company does not own the experience or skill of the individual even if it is acquired by the job.
By and large this will be a good thing. There will still be laws/regulations about taking proprietary information from one employer to another. However, there is no reason that a research chemist at Monsanto shouldn't be able to leave for a job at Dow Chemical. I actually knew a young woman who worked for a national company that contracts to do housekeeping and laundry at nursing homes. She had to sign a non-compete agreement which was completely ridiculous.
They are afraid she might steal their customer.

(6 months)which is ridiculous. Have shown that most of the noncompete clauses in the United States are for workers that make $13 an hour! I really don’t see any trade secrets being given to a $ 13-an-hour employees. This was used to retain employees.
It is true that you can’t come up with ideas and then have them taken away from you FOR FREE!
18% of the workforce was never gonna do that. This is really about wage suppression and not protecting secrets, which can be covered by NDAs anyway

I literally paid for my education, testing, and certifications with my own money, yet the industry standard non-compete for my job is 2 years and 50 miles from any office I regularly serviced in the last 3 years. Im only making 32k a year, what exactly can I take from my employer that wasn't already earned?

Training hours are considered work and are required to be paid like work. And if a company wants competent workers, it will 1) train them to be competent, and 2) pay them enough that they stay.
It's called the labor _market._ Companies should compete for labor just as workers compete in the job market. Non-competes were just a nasty loophole companies used instead of actually _being competitive._

Non Compete agreements restrict freedom of choice where the people want to work and make the workplaces kind of forced labour camp.
In this case, it is against all human rights and freedom.
We can't call our country free if we continue such restrictions like Non Compete !
Protects trade secrets? Really, then prove how it's a secret. Then what about the ideas that the worker comes up with. How do they get credit and a percentage of profit.
I've only heard of this for tatoo artists. But that's more about apprenticeship and standards, than trade secrets
We have them in the medical field too. The Indiana standard for my industry is 2 years and 50 miles from any office you regularly serve. So I'm completely cut out of northern IN, all of Chicago and 2 hours into South Michigan. I would literally have to relocate my whole family or leave the field for 2 years.

I'd like NDA to go away, too. I was once asked to sign NCA, NDA, etc. just for a two hour interview. I walked away, and the CEO or VP was livid. They try to spring it on you at the last minute, once you get on site.

I wouldn't be surprised if a federal court places it on hold after the lawsuit(s) being filed requesting immediate abjuctions to halt it. Long term, I don't see the decision from the FDA to hold once it hits the courts and appellant courts. Most likely will be ruled that the FTC does not have such authority to ban them nationwide.
Only in the US. So Google is laying off their US employees. Also because the cost of living is higher and they save money hiring workers in Europe.
If you work for an international employer, these laws will not help you at all.

More like "I'm finally allowed to work at a different pizza place." Non- _compete_ means your previous workplace could forbid you from working for competitors. Leave Little Ceaser's for Domino's after signing a noncompete? You could have been sued.
If all they wanted was to protect their recipes, they would have had you sign a non- _disclosure._
@@EaglesQuestions Non competes can restrict a person from starting a business in the same market. If I wanted to start a pizza business and give away a recipe, non competes would restrict me from doing that.
I was joking anyway, because the idea of a pizza shop making you sign a non compete is comical. There's more competition in the pizza market than probably _every_ other market. Why do you think there's so much good pizza?

If Congress had a problem with it, they wouldn't have created the FTC to write the keep-the-markets-fair rules.
