- Days after Disney sued Florida’s governor in federal court for what it described as retaliation for opposing the state’s so-called “Don’t Say Gay” bill, members of Disney World’s governing board - made up of Gov. Ron DeSantis appointees - authorized a lawsuit Monday against the entertainment giant.
DeSantis: "Hold on a minute Mickey! Let me spread my stance before you kick me in the groin."
I'm impressed with how these board members seem really up to the task. "I gotta check with Ron, I'll get back to once I'm told what to do."

I can’t wait until Disney leaves FL. The Desantians will celebrate so hard, right up until next tax season. As their flooding state goes broke, they can submerge with the satisfaction of the entire country being completely unconcerned with their future.

Yea I'd think going after the largest employer for the state because they said something you didn't like seems like something people wouldn't like. Now the judge that hears this case will have to fear for their future as a judge. If they decide for Disney, Desantis will simply have a law written to oust the judge. This is what dictators do
The legal system doesn’t work that way.
DeSantis will have difficulties firing the federal judge over the case. There's a claim based on a violation of federal constitutional rights.
Since The Walt Disney Company and the DeSantis Board reside, officially, in two different states, it can heard in federal court.
When the parties reside in different states, federal district courts have jurisdiction to hear cases partially based on state law and executive orders from governors.

@@raybod1775 Also, as a general rule states have complete control over its political subdivisions as long as it is not inconsistent with the respective state constitution. Yet, a lot of people on forums are either ignorant of that or just do not realize that. Political subdivisions exist at the whim of the states and states can create, dissolve, modify, merge, etc. IMHO, it would violate federalism for a federal court to even get involved in the decision of what constitutes a local government corporation or district.

The Walt Disney Company has some of the nation's best attorneys and law firms defending them in this case.
They're serious about remaining in control of one of the largest "company towns" still in existence. The residence and taxpaying-citizens of the town are all Disney managers.
The contractual loop hole they used to weaken the authority of the DeSantis Board shouldn't come as a surprise because the company helped draft the law establishing the Reedy Creek Improvement district.
I think you mean prosecuting the case - Disney sued first, and they're probably going to move to have any state case consolidated with their federal case

The use of the term "Prosecutor" or "The People of the State [X]" are used almost exclusively in criminal cases with the state as a party.
The Walt Disney Company, like most large American corporations, are citizens of the State of Delaware. The federal courts can hear cases partially on state law when it's combined with a federal constitutional right claim.

I feel like there's a good chance DeSantis ends up ruining his presidential aspirations over this. He's making his case against Disney sound personal which hurts both his legal chances of success and his image as a candidate. People said Trump focused too hard on appealing to his base and not enough on trying to reach independents, now DeSantis seems to be doing the same thing when a more moderate or calm conservative alternative to Trump is wanted. Whether you agree or disagree with him his treatment of Disney might hurt him more with the general electorate than it helps. On the potential plus side it's been said DeSantis doesn't seem to want to actually do much campaigning/talking in general to the press so he might much prefer to stay at the state level so not becoming the nominee would be a win for him and his voters.
I know it would be difficult, but if I were Disney...I'd find a way to move it or shut it down. They are a Global company and have plenty of resources. The park is probably a money sink anyway. These games are stupid...hopefully that is what they are planning.

Taxes should be much lower than they are for everyone. And no one and no company should be exempt or have special privileges not to pay them. Disney should never have had any special treatment in the first place.
If DeSantis had stopped at disbanding Reedy Creek, most probably would have been fine with it. But he didn't. Instead he personally took over Reedy Creek, instituted tolls on all roads going into Disney World, levied a new tax on hotels but only hotels near Disney World, suggested building a prison on state owned land in the middle of the amusement park, and stated point blank that he intended to remake Disney World to make it 'family friendly again' through the renamed Reedy Creek district.
Florida home owner AND tax payer here. Just wanted to say “hello” to all of the other FL taxpayers who will be funding DeSantis’ legal battle against Disney. Nice to know our money is being spent wisely.

Regardless of your political side, his entire process is going to pass the legal test of being retaliatory against the entities right or freedom of speech. By all his comments and speeches he basically wrote a book of admission to that was his intent. That’s outside of all the contractual and municipal / state land grab which he is enacting against the constitution. He let his anger or whatever his emotional issues are get in front of him. Florida constitution requires the state legislature to periodically review all special districts and if they don't benefit the people of Florida then they are to be modified per the constitution.
The problem is timing. It is blatantly obvious (and DeSantis has effectively admitted it multiple times) that all of this was done in retaliation for Disney exercising their first amendment rights. The government cannot retaliate against private citizens for protected speech, plain and simple.
