    hey so I got in an accident where i was rear ended by a Van on the highway in New York. Car was damaged real Bad, no severe injuries tho, back and neck pain. Insurance offering me $6000 2 days after. Need help/advice please

    Hi Mr. Arkady,
    If the attorney files the complaint in court - does it warrant 40% in the settlement?
    Do personal injury attorneys need to give a breakdown of economic damages (past:future) emotional damages (past:future)?
    Do the lien & former attorney fee (Flipper fee) get deducted from 30% or is it added?
    Before I signed an agreement all I knew was that Unless the case goes to trial and appeal the attorneys fee is 40%.
    Please clarify. Thank you!

      40% is what some lawyers charge once the case goes into litigation. In New York it’s always 33% but some states have 40%

      My attorney informed me after filing the case & doing deposition that he would get $50,000 out of $300,000 that I would be getting.
      I think your subscribers should know that attorneys fee (which in my case came from economic damages) should not be more than Plaintiff's economic damages.
      It is victimizing the victim that all attorneys should know and follow.

    The idea that a drunk motorcyclist should recover anything is absurd. For all we know, that crash didn't save his life (hitting a truck a mile down the road) or someone else's life.
    In fact, I would award motorcyclists awards under a completely different standard than car accident victims. A car has to have all kinds of safety equipment: air bags, seat belts, etc. These are mandated. Other safety features are engineered by auto companies to protect the occupants and aren't even required.
    A motorcyclist has none of this. There is an extremely high level of risk assumption that should be factored in to these judgements. The idea that someone should receive a million dollars for injuries in an accident that would just be minor damage in a car is just silly. (And I'm a former motorcyclist that gave it up when I turned 60 and had seen too many friends hurt badly either because of their negligence or someone else's in an accident that wouldn't have caused any injuries in a car).

      Sounds like you might have a bias. And this illustrates just how amazing this verdict of $60+ million was bc the lawyer surely had to deal with potential jurors who had these same beliefs yet he was able to keep them off the jury. So masterful lawyering indeed. I agree the cases are tough

    I am personally injured on job by another man. But every lawyer runaway from my case. I need help of law enforcement officer to help get evidence which is possible with his help. Jehanzeb

      @@jehanzebkhan5579 yes law enforcement would be the police. If it’s an assault on the job that could also be workers compensation.
