- Former Sars commissioner Tom Moyane cross-examined Minister of Public Enterprises Pravin Gordhan at the state capture commission on 30 November 2020. Gordhan and Advocate Dali Mpofu, who is representing Moyane, shared a number of heated exchanges. Here are some of the key moments from the day’s testimony.

I didn't get that at all. Chair is dealing with Gordhan just fine. Gordhan is trying to be difficult and Mpofu is falling for it by being equally difficult. Chair is dealing with this difficult situation and is handling it fairly well.
@@rohp1283 look at what the Chair is not saying... read between the lines. At no point does the Chair require Gordhan to conduct himself respectfully. The Chair allows Gordhan to dogde straight forward and simple questions. The objective of this commission is to get answers from Gordhan but the Chair does not insist on answers so that the commission can be able to do its job. That’s why my friend I say he seems scared of Gordhan. With other witnesses the Chair always guides and insist on the questions to be answered by the witnesses but with Gordhan appear to treat him special. You can see the Chairs body language when he address Gordhan that he takes a posture as if he is addressing his master.

He merely attempted to ask questions in a way that maybe misconstrued with any explanation... Hence Mr Pravin explained every answer he provided in a clear and logical sequence. Mr Mpofu knows that what he was attempting was a long shot to discredit a very reliable witness, hence he was getting frustrated and impatient. He is a terrible example of law practice, in all honesty his is an embarrassment to the law society.
Mpofu got an attitude and have no respect for the law. He needs to change his ways of doing things,otherwise he'll have a tough time in future.

This is a clear indication that the commission was created for certain individuals, here we witness the chair failing to compel the witness to answer questions. I now support the submission made by President Zuma, Zondo must reduce himself from chairing the commission

The word is "recuse" Mongezi. And you cannot force a witness to answer a question. Not even in court. And if, as a fair number of people on this comments session think, he will incriminate homself, he has a right not to answer. Law of evidence 101.
When a witness does not answer a question though, it is the commisioner / court's right to draw a negative inference to the fact that he (the witness) did not answer. So, in not answering, a witness does so at his own peril.

@@jabumalinga1943 Couldn't have said it better myself, highly unprofessional and EFF behaviour is quite apparent to everyone I believe. Perhaps this was a tactic which Mpofu relied on, i.e. Judge Z being lenient, in which case he was. For me it's always good to compare two things because in life you have YinYang, Good vs Evil. If I compare if Zuma had been subjected to this type of questioning or arrogance, how would his interviews have turned out? Also I say that this is a tactic because perhaps Mpofu's plan is to delay the information that Pravin has to divulge in. Also take not of the path Mpofu is trying to lead the witness down. Zuma evidence line of questioning is totally irrelevant at this stage and diverts attention and time. He also brings this absolute hogwash issue of racism. We all know that South Africans together are trying to put this racism thing behind us. What is the need after all these years to call an ANC Minister a racist? It means you realized after 50years that Pravin is a racist? It just doesnt make logical sense to the people watching this charade of a cross-examination. On the topic of Ma Winnie, yes I think we should leave her out of this. May she RIP. Her role has been fulfilled and we are happy that things are better now than before. One thing we must realise is that the decision of a violent South Africa was made a long time ago by Nelson Mandela. And he chose the best outcome which is to walk us forward into the promised land hand in hand all together. South Africans will all stand together.
