    Whether the information given by the accused that he purchased the murder weapon from shop of G followed by his leading the police, to his shop is admissible under sec 27 evidence act ?
    Can this be a discovery though not recovery u/s 27 ?
    Herein the actual weapon used in the crime is not recovered yet

    • @Advocate_Akshaybhasin
      @Advocate_Akshaybhasin  6 років тому

      It will not be admissible under section 27 untill the weapon is recovered! Also, it can't be a discovery untill the weapon is discovered.

    Sir can u explain Clause 3 of section 21 again..

    • @Advocate_Akshaybhasin
      @Advocate_Akshaybhasin  7 років тому

      deepika sharma The clause (3) of Section 21 lays down that an admission may be proved by or on behalf of a person making it if it is relevant otherwise than as an admission. The condition is that the statement must be relevant to determine the fact in issue and only previous statements are relevant.
      For example, where plaintiffs sought to establish their part by proving that A and B were brothers, a statement to that effect made by one of the plaintiffs long before the controversy arose, were held relevant. The statement admissible under clause (3) is also relevant under sections 6 to 13 and 34 and 35 of the Evidence Act

    Admission may be self harming and self serving. But confession must be self harming.
    Ap galt bta rhay ke admission self haming hona chaye...

    • @Advocate_Akshaybhasin
      @Advocate_Akshaybhasin  6 років тому +1

      M Shoaib admission is always self harming but uske bhi exceptions hai jab vo self preserving ho sakta hai jaise ki section 32(1) and others

    • @Advocate_Akshaybhasin
      @Advocate_Akshaybhasin  7 років тому

      adya singh I didn't get your query! Admissions should be self harming not self preserving

    • @adyasingh2327
      @adyasingh2327 7 років тому +1

      Akshay Bhasin it is not a compulsion that admissions should be self harming

    • @Advocate_Akshaybhasin
      @Advocate_Akshaybhasin  7 років тому

      No it's not necessary! exception is section 32 where it can be self preservation!
