  • The Philippines, together with the United States, European Union, and allies call on China to abide by the 2016 Arbitral Ruling of the South China Sea
    The Philippines celebrated on Friday, the eighth anniversary of the Permanent Court of Arbitration’s 2016 ruling, that the nation has exclusive sovereign rights over the West Philippine Sea, and that China’s nine-dash line is invalid. With pouring support globally, international community led by the United States and European Union, called out China to abide the 2016 Arbitral Ruling.
    On July 12, marks the eighth anniversary of the award issued by the tribunal, constituted under Annex VII to the United Nations Convention on the Law of the Sea, in the arbitration instituted by the Republic of the Philippines against the People’s Republic of China, concerning the South China Sea.
    This award represents a significant milestone in the peaceful resolution of disputes in the South China Sea. Dispute settlement mechanisms provided under UN Convention on the Law of the Sea contribute to the maintenance, and furthering of the international legal order, based on the rule of law.
    While the Philippines' 2016 Arbitral Award victory, gains more international support every year, China continues to defies and will never accept the ruling. It is far too dug in, on its discredited maritime claims, over nearly all of the South China Sea.
    Beijing refused to join the arbitral proceedings back in 2013, is itself an undeniable fact, that it got no solid case to secure a legal victory. So, it went on to attack the tribunal, the award, and the Unclos itself, while China is pretending to champion for international law.
    The international community, led by the United States, reaffirms there unwavering support for the Philippines right in the West Philippine Sea, in upholding international law particularly Unclos.
    In a statement released by US Secretary of State, The United States joins the Philippines in marking the 8th anniversary of the final and legally binding Arbitral Ruling. U.S. State Secretary Antony Blinken affirms the Arbitral Tribunal's determination that China's expansive maritime claims in the South China Sea are inconsistent with international law.
    “We continue to call on the People’s Republic of China to abide by the 2016 arbitral ruling, to cease its dangerous and destabilizing conduct, and to comport its conduct as well as its territorial and maritime claims in the South China Sea to the international law of the sea.
    US Ambassador to the Philippines MaryKay Carlson also posted on X to support their unwavering support to the Philippines in marking the Victory of the 2016 Arbitral Ruling.
    In a statement Published by Australian Ambassador to The Philippines, the 2016 South China Sea Arbitral Award, which is final and binding, all parties involved must respect and honor the award. Australia has consistently called for the decision to be respected. Adherence to Unclos is vital for an open, stable and prosperous region.
    Over the years, the Philippines has continued to demonstrate this commitment to peace even in the face of the unlawful actions which have caused serious incidents in the South China Sea. Without ever diminishing their resolve, to protect and promote their people’s interest, and the full and responsible enjoyment of its legally settled maritime entitlements and its accompanying rights and jurisdictions, the DFA said in a statement.
    The Award is a reaffirmation of the United Nations Convention on the Law of the Sea, and protects their rights as a coastal state and a seafaring people. Every effort to secure their legitimate interests in its maritime domain is a testament to the determination and courage of the Filipino people, while showcasing the Philippines’ vision of peace and stability that inspires and resonates beyond the waters of the South China Sea.
    China’s aggression is borne out of its sweeping claim over most of the South China Sea. In 2016, however, the arbitral tribunal ruled in favor of the Philippines and invalidated China’s nine-dash, now ten-dash line claims.
    China expresses strong dissatisfaction, with firm opposition to the United States and European Union’s statement on the 8th anniversary of the South China Sea arbitration and has lodged solemn representations. According to China, the US and EU are not party to the South China Sea issue and their statement, disregarding the history and facts of the South China Sea issue, openly endorses the Philippines’ infringement on China’s sovereignty.

    l. A list of arbitrators shall be drawn up and maintained by the Secretary-General of the United Nations. Every State Party shall be entitled to nominate four arbitrators, each of whom shall be a person experienced in maritime affairs and enjoying the highest reputation for fairness, competence and integrity. The names of the persons so nominated shall constitute the list.
    The Arbitration was approved by United nation general Assembly make this proceeding legal and bindings to all parties Involved

If international community and US support it as you say, then MDT should invoke already on last June incident, as it is consider as intruding Philippine territory. That mean US and NATO which inclusiveness those international community countries that mention in this video should already activated MDT. Why wasn’t it done so. Because that decision was not recognise. China already say up front not agreeable to the UNCLOS before the arbitration discussion start and didn’t participate in that UNClos at all. By the way, there is no such thing as West Philippines Sea to even start with on EEZ. No country map has a location call west Philippines sea. And even Philippines own national map archive don’t have that location. In short, by fact of actual action and evident this clip is delusion

      Excerpt from a USIP article - It is worth recalling that in 2012, the United States chose to persuade the Philippines to withdraw from Scarborough Shoal (a separate set of features north of the Spratlys) while making no effort to compel the PRC to do the same. In effect, Washington forced Manila to cede that set of features to the PRC.

    Mr Lin Jian, UNCLOS was created to avoid misunderstanding between countries when it comes to their maritime boundaries. It was signed and approved by almost all nations to include China. If all nations follow International law their will be no war.

      nope. it was not recognized by majority of countries because it does not solve territorial disputes and actually made more conflicts. the first thing that need to be fixed is the credibility of the UN as it is influenced by special interest groups and mostly dominated by the rich western countries. it is not a proper representation of the world and being used as a tool for world geopolitics.

    Talking about history, Pre-colonial Filipinos were also seafarers and most likely fished in that area considering its proximity to our coastal lands. So, it doesn't justify PRC claims. It's a common fishing ground and no one took control of it. PRC is really not that bright! hahahahaha

    China is among the first countries who signed the UNCLOS in 1982 and ratified it in 1994. But now China refuses to follow the rules based order of UNCLOS and rejects the arbitral court's' ruling, to assert nine-dash line claim of sovereignty on the WPS and the south china sea.
    To deter/counter China's expansionism in Philippine EEZ,
    The PCG and USCG must continue joint patrol of the WPS, the Scarborough, Ayungin, and Escoda shoals.
    US Japan deploy troops, missiles and Typhon launchers systems, thru EDCA and RAA.
    The philippines boost defense military capability - more ships, aircrafts, anti-ship missiles and anti-ship drones.

    That is correct. THERE IS NO SEAFARER FROM CHINA CROSSING ACROSS THE SOUTH CHINA SEA. EXPLORER LIKE MAGELLAN HAD SHIPS WHICH SANK IN THE THEN SOUTH CHINA SEA CARRYING PORCELAIN ITEMS, COINS SEEN IN THE AREA AND WERE NOT FROM CHINESE/CHINA.

    The Potsdam and Cairo declaration doesn’t list Paracels, Scarborough and Spratlys as territories to be restored to China. Both declarations only said that Japan shall be expelled from said territories. Instead, it mentions that “all the territories Japan has stolen from the Chinese, including Manchuria, Formosa, and the Pescadores shall be restored to the Republic of China”. All other islands outside the ones explicitly mentioned to be restored to China are instead managed by the league of nations at the time. In fact, in the 1951 San Francisco Peace conference, there was a motion by the Soviet Union to award the Spratlys and Paracels to China which was defeated 46 to 3 and 1 abstention. And thus the Treaty of Taipei between Japan and China merely reiterates what Japan has agreed upon in the San Francisco peace treaty resulting from the 1951 conference.

    China already unknowingly recognized the Philippines' claims to the Spratly Islands and Scarborough Shoal when it referenced the *1900 Treaty of Washington* in its Position Paper to the 2013 Arbitral Tribunal in the Permanent Court of Arbitration:
    "Prior to the 1970s, Philippine law had set clear limits to the territory of the Philippines, which did not involve any of China's maritime features in the South China Sea. Article 1 of the 1935 Constitution of the Republic of the Philippines entitled "The National Territory", provided that the Philippines comprises all the territory ceded to the United States by the Treaty of Paris concluded between the United States and Spain on the tenth day of December, eighteen hundred and ninety-eight, the limits which are set forth in Article III of the said treaty, *together with all the islands embraced in the treaty concluded at Washington between the United States and Spain on the seventh day of November, nineteen hundred,* and the treaty concluded between the United States and Great Britain on the second day of January, nineteen hundred and thirty, and all all territory over which the present Government of the Philippine Islands exercise jurisdiction."

    How can it be an arbitration when there is only 1 party?
    This is do much a western concept, Ukraine peace Summit, but Russia is not invited!!!!
    UNCLOS has no jurisdiction on issues of sovereignty. It only covers navigation of the seas.

    Stop spreading miss leading information on Taiwan. 9 dash line were from Republic of China (Taiwan) and been recognise by Taiwan. And those Island dispute with Japan were part of Taiwan that Japan don’t dispute with but only to PRC (China). So please don’t drag Taiwan into the 9 dash line with China. As Taiwan stand same stand with China on this. And so is other claim on islands with Japan. Any attempt not to agree with that is consider traitor be it from blue camp or green camp.

    the decision was made by the admin office... not the judicial court... it never made it to court... only the philippines selected the jurors... these was the main reason why china refused to accept the outcome of the tentative ruling.
    also if you go the usa, uk, etc. public records... it clearly states china have the right to the 9 dash line. the new 10th line was part of taiwan and taiwan is a province of china...taiwan is not a country... this is also in the usa, uk, etc. public records...
    the map by the spanish cartographer shows the island is not part of the phillipines...
    irish professor carty actually wrote a book based on these facts...
    so philippines cant claim the islands...

Carty also talked about pursuing China's legality in SCS but China never went to a Court, I wonder why? Probably because it knows it will lose everytime.

    China's sovereignty and historic rights in the South China Sea are based on its long-term history of management and administration of the islands in the sea and the adjacent waters. They are also consistent with international law, including the United Nations Convention on the Law of the Sea.
    Successive dynasties or governments since the Tang Dynasty (618-907) effectively controlled and administered the South China Sea islands and the related waters. Successive Chinese governments asserted sovereignty over the islands and reefs within the nine-dash line of the South China Sea, as well as developed and managed resources within the line, which constituted exclusive rights to the waters of the South China Sea
    The Chinese have long engaged in fishing and other productive activities in the South China Sea, which is an important waterway for Chinese ships. Since the Han Dynasty (202BC-220AD), they began to make use of the resources of the sea, passing through it. These practices constitute the basic facts of China's long-term administration and passage in the South China Sea.
    The sovereignty has also been recognized by other countries. For a long time after World War II, Vietnam, the Philippines and other neighboring countries did not object to China's sovereignty over the South China Sea islands and the nine-dash line. Many other countries and international organizations also recognized or acquiesced to it. This is supported by a large number of foreign official documents and publications, as well as government archives, including those of Vietnam, the Philippines, the United States, Russia, the United Kingdom, France, Germany and Japan.
    Since the founding of the People's Republic of China in 1949, the Chinese government has exercised sovereignty and jurisdiction over the South China Sea by issuing government documents and diplomatic statements, promulgating domestic laws, asserting sovereignty over the South China Sea with abundant evidence.
    On the other hand, as an illegal claimant in the South China Sea dispute, the Philippines' position has been based on a completely wrong foundation from the beginning. The information provided by the Philippines on the islands and reefs and its claims are full of false information and false descriptions, and there are many inconsistent and self-contradictory statements. The Philippines had never raised territorial claims on the Nansha Islands before the 1970s.
    The nine-dash line, a heritage, is frequently questioned and attacked by the Philippines. In China, the drawing of dotted lines in the South China Sea began in the early 20th century. At that time, the maps compiled by private individuals first used dotted or continuous lines to show China's territory scope in the sea.
    In the 1930s, the government of the Republic of China began to standardize and manage map publishing. They established the Land and Waters Map Review Committee to examine the maps. In January 1935, the committee published the Map of Islands in the South China Sea, standardizing the names of 132 islands, reefs, sands and beaches. This was the first case of the Chinese government officially mapping the South China Sea islands in modern history.
    After World War II, in accordance with the Cairo Declaration, the Potsdam Proclamation and other international legal documents, China resumed the exercise of sovereignty of islands in the South China Sea. In February 1948, the Interior Ministry of the Republic of China publicly issued the Location Map of South China Sea Islands. It was the first time that the Chinese government drew a U-shaped line in the South China Sea on an officially published map, demonstrating to the international community its sovereignty over the sea.
    After 1949, the new Chinese government inherited this line and made appropriate adjustments to make it the nine-dash line we know today.
    From then until the 1970s, the neighboring countries, including the Philippines, and the international community did not raise any objections to China's territorial sovereignty.
    All official maps published by China after 1949 show this line, which clearly defines China's territorial sovereignty over the South China Sea islands within the line and its historic rights in the waters within the line.
