POLICE lie to Uber Driver/Attorney

- In this video, an officer from Wilmington Police Department and a sheriff from the New Hanover Country Sheriffs Department tell me that it's illegal to record the police and they will take me to jail for doing so. What they didn't know at the time, is that I'm a local attorney, and was ready to call them out on their lies.
Watch how the interaction plays out. If you have any question, leave a comment!

A large part what's going on in this video has to do with police training in the US, and how it is of significantly lower quality than in most other developed countries.
On average, one has to attend 13-16 weeks of training to become a police officer in the US. As a comparison, becoming a police officer in Norway (where I am from) requires you undergo 156 weeks of training and complete a bachelor's degree at the Norwegian Police University College.
Law is a difficult field. I spent five years becoming a lawyer, and there are still hundreds of thousands of questions I would be unable to answer on the spot. I wouldn't expect a police officer with a mere few months, part of which is dedicated to practical training, to know even the basics of applicable laws in his field.
While the police conduct on display in this video does leave something to her desired, I do not think it's fair to put the responsibility strictly on the individuals therein.
If? No, they're trained to do exactly that. A cop can say literally anything, threaten literally anything. The smartest thing you can do in the presence of a police officer asking you questions is call a lawyer.
@@EspedalsNot making up laws does not require any training though.

Attorney: actually doesn’t know the law and lied multiple times throughout this video
“The first officer was dumb for saying he cannot be recorded. No county in the U.S. has any sort of law. However, I do think recording cops, in general, is dumb unless you are in a county that does not have body cameras yet witch every cop here visibly has. And if anyone says, "oh well, you can never trust the cops recording" or anything dumb like that, cops recordings have proven far more people lying about them, then them lying to others. And if you disagree, just watch donut operator, or find me an instance where any footage of an incident of a cop has gone missing that has not resulted in a misconduct charge for improper handling of evidence.
Another thing is that when he asks you to step out of the car, whatever the reason for refusing you are violating the law, the supreme court case Pennsylvania v. Mimms has already settled that you must step out of your car when asked regardless if you have done anything wrong. And when you say "there not searching my car" and "I know my rights" clearly you don't as during a traffic stop, police only need probable cause to search your vehicle legally. And this case they suspected that either you or the passenger could be hiding something in the vehicle witch wrong or not is still probable cause. But in summary, yes, you are right that there is no law prohibiting recording, and it is perfectly fine to do so. However, you were also wrong twice as you must step out of the vehicle when requested and you clearly don't know your rights cause they can search your vehicle if they believe there is a possibility of something in your car as under the "automobile exception" to the search warrant requirement, courts have recognized that individuals have a lower expectation of privacy when driving a car than when they're in their homes.”
Bruh I jus make comment memes. I ain’t no lawyer
@@connix2782 First of all we are talking about a taxi service so probable cause here can easily be fought in the court. The man who was being arrested has nothing to do with the vehicle other than that he was in it. They would need to smell drugs or see something in plain view to search the vehicle. I agree that he has to step out of the vehicle but considering it was because he was recording officers that could also be argued in court. Definitely more difficult but doable. Third of all there is a video of a body camera "Malfunctioning" and then the officer suddenly finding a big bag of drugs. I am not saying this is how all officers operate but it is a possibility. You always should keep your own recording if you feel it is necessary. You cannot control what is not in your hands. I trust the police to an extent but they are still human and humans can make massive errors in judgement to save face. If you feel you are being wrongfully treated, record it yourself because many things can go wrong and again its not a "don't trust any cop" thing, its more "realize they are human and they need to be checked sometimes" thing
Conor Koritor honestly fair enough however I would still say probable cause is 100% fair in this the cop himself even said if they find something it might have nothing to do with him and not get him in trouble the cops can’t be sure the guy they are arresting did not leave anything in the car that may potential be used as evidence or worst of all possible harm the driver. My point still stands however that besides the first dumb cops statement about the camera I would say everything else was handled properly and lawfully with the other officers behaving respectfully and following proper procedures.
“You’re being a jerk”
“Sticks and stones, officer”
Every time I think the police can't get any more idiotic, they prove me wrong again... and people wonder why there are still protests going on after nearly 2 straight months of constant protests or why people would want to defund the police. ACAB
And this is how the majority of cops behave these days. When I was younger I had plenty of positive, human interactions with cops. They treated me like a human and I treated them the same. Now days, it doesn’t matter how nice you are, you get treated like a bag of dirt.
A good, recent example of this when my road was closed due to construction at the intersection up the street. The cops were pulling people over that bypassed the road closed signs despite them not living on the road or going to anyone’s house on the road. A bit excessive, but whatever. Was 100% a needless money grab from the PD, but I didn’t worry because I lived on the road so I had every right to drive down it. Well, as I was turning through the intersection that was soon to be worked on, there were two cops with someone pulled over. One went jogging back to his truck and pulled a half a donut peeling out to come pull me over. I saw all this in my rear view, so I just pulled over before he even got his lights on. I figured it would be as simple as him running my plates, coming up and saying “oh you live on this section of the road, have a good day” and I’d be on my way. But no. He walked up immediately with a condescending and extremely rude attitude. To make a long story short, I show him my I.D. and after reading the address and running it, he comes back, throws the I.D. in my window and says “you’ll probably get stopped again” and walks away.
After I recovered from my pure shock at his piss poor behavior, I stuck my head out my window as he was walking back to his truck and said “have a nice day” and as he opened his door I said “asshole” as I put my car in gear and pulled away. Saw him stand there for a second trying to find a reason to stop me again because his fragile little ego was hurt.
Thing is, I used to support police, but they’ve lost my support with their all too common power trips, unnecessary stops of simple working people trying to make their way through the day, general harassment, brutality, and murder. Police behave more like a government gang than citizen’s protection these days. They no longer serve the public. It’s sad. Simple accountable policing reform would solve all of this, but there’s so much pushback from all the cops who don’t want to be held accountable that it never changes.
I read a comment elsewhere that cops in the US are trained for less time than many other countries? 13-16 weeks, anyone know if that's true and have thoughts on if that is too short? Sounds like it.

Legally the man has to get out of the car. Cops have the right to control everyone during a traffic stop.
Edit: sorry not the right but are allowed to by law.
@@shadow435100 that's just crazy! I would ask everyone to get out of the car and form 2 lines parallel
Line 1 all males above the age of 18
Line 2 all females and children.
And then have them marching towards the new Auschwitz.
Seems about right, Nazi style no?
@@mkefayati473 It's for officer safety that they are allowed to control everyone in the vehicle. The man was refusing a lawful order when you do that you have now committed a crime and the officer needs to either a, get you out of the car by asking which this man wouldn't do, or b by force. Just follow the orders of the police even if they tell you to get naked and dance in the street win it in the court room because you can't win it on the street.

This is an example of cops being arseholes. Lying about the “new law” about video recording. That’s the little grift they play on us, so when they f up, they wont get busted.
