    ISSUES RELATED TO REDEVELOPMENT PURSUANT TO THE RECENT CIRCULAR
    a. Only those buildings should go for redevelopment which have been declared dilapidated by the competent authority, the municipal corporation.
    b. The decision for redevelopment has to be taken by the general body of the society. The general body which comprises of 2/3rd of the total members of the society, which makes a quorum.
    c. The general body has to take a decision as to whether to carry out repairs or go for redevelopment. This depends on the nature of their building as declared by the municipal corporation.
    d. In this case, irrespective of whatever category the building has achieved in the survey carried out by the municipal corporation, the society should be comfortable going for redevelopment. Only then can they go for redevelopment.
    e. Another important criterion for redevelopment is that there should be a resolution passed by the general body in the management committee meeting.
    f. It is the general body of the society which takes the decision regarding redevelopment or repairs.
    g. The general body can approach the competent authority to facilitate their decision on redevelopment.
    h. Whenever the society goes for redevelopment, the decision has to be taken by an elected managing committee.
    i. The society can appoint a project management consultant, if they wish to go for redevelopment. If they are going for repairs, they have to appoint a suitable contractor.
    j. The PMC has to be appointed by the general body by taking suggestions from whomsoever is interested in redeveloping their building. They can also take suggestions from members in appointing a PMC.
    k. Those members who are not in the country at the time of the general body meeting can appoint an associate member who can vote in society elections and attend meetings on their behalf. The associate member can be a relative of the primary member. The general body will also require consent of 51% of the total members of the society.
    l. For appointing a PMC, quotations can be taken by the general body and after receiving three or five quotations, they can appoint a PMC.
    m. The government resolution also gives the terms and conditions to be included in the development agreement.
    n. The GR also outlines the time to be taken to complete the project. If it is a small building project, then the timeline given is 2 years and for larger buildings, 3 years are given as the timeline to complete the project.
    o. The tenants should not vacate their premises without their receiving the approved plan and advance rent from the builder.
    p. There is a general misconception among members that due to the coming of RERA no developer will give the bank guarantee.
    q. The society should choose only those developers who have at least one project registered in RERA.
    r. The bank guarantee collected should be 20% of the project cost.
    s. The developer should give alternate interim accommodation to the members while he develops their building.
    t. Moreover, the development agreement has to be registered. Unless the development agreement is registered, the members should not vacate their premises.
    u. The clear carpet area of the project should be as per RERA.
    v. The carpet area as mentioned in RERA should be put down in the development agreement.
    w. The flat has to be allotted in the presence of the registrar.
    x. Information regarding the building should be made available to the developer so that he can take an informed decision when developing the building.
