The short answer is pretty much yeah they have all the same rights as a tenant with a lease except they can be told to leave at any time. Kind of.     As a long-time landlord, I can honestly say that ANYONE who rents without a written lease needs to get a written, signed lease ASAP. Don't be a sucker!

      a male landlord can kick u out because he rented to a female intending to try to hump in the future and realize she got a man so the landlord can revoke the lease over anything he can make up to find a different single mother with a man "single mother hunter" landlord

    I always have a lease with tenants. If they tell me they will be late i usually wave the late fee because i don't want to see them struggle.

    In Ohio, it is expected that one gives the other the notice not to renew in writing. Also, a "month's notice" doesn't mean June 10 to July 10. If rents are due the first of the month, a month's notice must be given 30 days before the next rent is due. So if a tenant gives a month's notice on June 15, he owes the full month of July rent. Of course, unless the 2 parties come to some negotiated agreement.

    Monterey County, CA; implied lease only; single family owner not living on site did not provide proof of exemption from AB1482 (as no lease/written rental agreement); raised the rent 25-35% on multiple subtenants in latest rental agreement (AB 1110 protects tenants from 10+% rent hike: landlord or rep on site must provide 90 days notice); when tenants balked, Lease Holder texted each was evicted within 2 days of new lease signing/August 1st. HELP!

    I have been renting an apt in a 2 family house in Orange County NY for 30 yrs without a lease. Now the owner has decided to sell the house. Can I be evicted by new owner? Old owner? What I am most appalled about is the fact that a realtor took photos of the inside of my apt and put them on the realtors website showing all of my possessions. Is that not an invasion of privacy?

      Thank you for your comment. It sounds like you are in a difficult situation. It is understandable that you are concerned about being evicted by the new owner, however, it is important to know your rights as a tenant. As far as the realtor taking photos of the inside of your apartment and displaying them online, that is definitely an invasion of privacy. I would recommend speaking with an attorney who specializes in landlord/tenant law to ensure that you are protected.

    My landlord is trying to sue me for the 4 months I didn't pay the last months I stayed there .. we have to more court dates next one is hearing.. the trial.. but anyways they didn't sign the lease I did and the court has the copy I'm also sueing for not answering to board of health 3 times while is 3 times the rent .. hope to hear back from ya

    We are a tenant and have been for 10 years. The landlord was an elderly woman who was taken advantage of by a prior tenant she was offering a lease option. The house was gutted so we agreed that she would give us 23000. To apply when we decided to purchase the home as compensation. We agreed and spent thousand putting in a kitchen, flooring, painted, put in cabinets etc. Did landscaping well a lawyer came buy and told us she was incapacitated and he was the guardian and wanted the lease. I told him about the 23,000 that was owed and he said he would look into it. Are we going to get screwed? We own a flooring contracting and are considering getting a mechanics lein to protect the money we put into this house. We have evidence of all work and the state of the house before we moved in.

    I live in Virginia. I do not have a lease. I have lived in the rental house for 13 years. I have never been late on rent. A verbal eviction notice was given with no paperwork. The landlord's garage caught on fire and they want to live in the residence while repairs are being done to their home. What are my rights?

      You should talk with the landlord first and try and work something out. If that doesn't work, you want to consult an attorney. If you pay rent and they continue to accept rent you likely have a legal claim to continue staying. They most likely need to get notice to vacate in writing. Even if only via text it may hold up as sufficent notice. No Lease and you are limited in your rights to remain as a lawful tenant.

    What if you're living in a apartment where the lease holder has died... but you arent on the lease and you have been paying rent in that persons name who died.? But you are having a little difficulty paying the rent now?

      If you are not on the lease, your daughter is on the lease and will need to abide by it. It likely states the length of time visitors are allowed to stay before being considered residents. This may even go back to the city and the occupancy permit. how many people are permitted to stay. I would encourage you to have your daughter reach out to the landlord and try and get you added to the lease. If the landlord is aware of the situation and asking you to leave it is probably past that conversation but might still be worth calling and discussing the situation.

    I raised my tenants rent the 10 percent im allowed to and he started doing something strange. He is paying me 20 dollars more then that increase. Ive sent him letters and refunds so if this had been a mistake he knows better by now. I am becoming suspicious

    I have a friend who wants his 45 yr old son out of his house (owned by him and his wife). The son is violent and does drugs. The wife doesn't want him out but the husband does. He had to move out of his own home due to violent confrontations with son. He'd like to evict the son so he can move back into his own house safely. (California) Does he have a chance?

    So my uncle just lost his house I was living in it as a tenant for 15 years. Didn’t know all this stuff was happening while paying utilities and so on. Now the new owners who I have been trying to contact for months suddenly sent me a 15 day vacate notice that is also 10 days late from the date noted. What are my rights in this situation as I need more time to move and expressed months before that I would be willing to do cash for keys and accept assistance to relocate.

    Hi, my landlord asked me to leave in 30 days because I asked him to follow the NYC regulations for heat. His argument was that I’m a problematic tenant because once in the past I asked for no yelling before 8:00 a.m. in a respectful conversation. He lives in the room next door. I have no lease and pay monthly. I was trying to move out of the country in two months, so it is very inconvenient to move at this point. What should I do to stay that extra month? Regarding the heat situation, he hasn’t started using the heat properly. He says he has it set to turn on when we go below 50F. But we’ve been in 44F several times with no heat. He can’t tell me to leave in 30 days for reasons like these, can he?

      Call the Employment Housing dept saying they want to evict you for retaliation. Do everything in writing. Nothing verbal. These landlords don't evict drug dealers and other trouble tenants but wants to evict a tenant with good faith.

For the heat issue, it's the landlord's responsibility to provide adequate heating.     Hello, my lease is up and the landlord told us our rent will go up $200 unless we sign a new lease. Is that legal? To me it sounds like the landlord is pressuring us to sign a new lease by raising rent unless we sign the lease.

    I live in Indiana. My rent is up to date. My AC isn't working so I messaged my landlord. The people were supposed to be here today at 2. However, the landlord along with the AC repair man showed up unannounced, opened the front door while my teenage daughter was walking to her room in a bra and pair of very short sleep shorts. Of course I was at work and had no idea any of this was happening until it was already done. That's upsetting in itself but when I called him after returning home from work to ask why the ac still wasn't working he told me he has now decided that he wants to sell my home and wants me out by Sept 1st because he no longer wants the financial burden of fixing things that go wrong. I have been here since March of 2021 and the lease was for 1 year. However, we had an agreement that I was going to reside here at least until May 2024 when my daughter graduates high-school. So basically all would be well if I wouldn't have said anything about the AC. I'm very upset over all of this as I'm sure anyone would be. What are my rights in this situation?

      Regarding your lease and the landlords plan to sell. Unfortunately it sounds like your lease is up and if he asks you to leave you may have to. I would try and work something out with him if he is willing. Maybe you instead of a rent increase of having to move help with the cost of some of the repairs. If that is the current issue for landlord. HVAC's can be very costly to repair; as temps hit the 90s+ in our area we have a LOT of service calls for AC's.

      Not a lawyer, but generally, if you've extended the terms or changed the terms of written document, those changes must be in writing. Sometimes called "4 corners doctrine". Either party can get out of a m2-m lease with just a month's notice.

    *I have kind of a complex question that I CANNOT find the answer to no matter how much I search google. So My issue is this: I live in New York, and rented from my previous landlord, lets call him E, and I now have a new landlord, lets call him C. Before C bought my building, E let me know that he "transferred my lease" to C. I paid first and last month's rent to E when I first moved in, but he didn't mention if he sent my last month's rent to C with the 'lease transfer'. I plan on moving out of new landlord C's apartment when the 1 year lease is up. Should I expect to not have to pay last month's rent my last month there? What happens if my previous landlord did NOT send my new landlord my last month's rent, and I am not able to get in contact with my old landlord to ask him if he did? Please help lol*

I hit 👍 but then whilst listening to more of channel author speaking I realzed info he's saying is VERY helpful for me to know what my landlord SHOULD do if wanting me gone & if landlord doesn't do it correctly I believe I as a tenant have a legal recourse. So if the law is followed & if it went to court then a judge might show mercy to me & God knows I need it!

    I keep an audio recording of the verbal agreements, counts as a verbal lease in Ontario. And also learn how to file an A7 and submit affidavits yourself without legal counsel using the Ontario portal for the Kings Court.

    I need your advice my daughter lived in a rooming house since 2013..The original landlord gave her a lease he left and a new landlord took over in 2015 he never gave her a renewed lease, he also raised her rent ( none in wrighting)my daughter list her job due to the pandemic but she did apply for back rent & he received a large payment, She has the confirmation of the payment Now hes saying he wants everyone out so he can rent to a family because the other tenant were withholding there rent what steps do she take now..legally

    My land lord owes me $9000.00 and wants me to move out in 3 months. I told him I need my money before leaving so I can rent another place but they said they don’t have the money. I don’t want to escalate things because I have 15 years living here but what can I do living in NYC?

      Wow, that's a tough situation. $9000 on top of finding a new place is a lot to handle. Luckily, there are some resources available in NYC to help! The NYC Bar Association has a free Housing Hotline www.nyc.gov/site/hra/help/legal-services-for-tenants.pagethat can give you advice on your rights and options, like potentially withholding rent or taking your landlord to small claims court. You could also try negotiating a payment plan with your landlord so you can get some money while staying put. Remember, 15 years of tenancy gives you some leverage. Be sure to document everything with emails, texts, or dated notes from conversations. Stay calm, be firm.

    I had the worst landlord and it was right during the pandemic. I had a Ministry that was actually helping me pay rent so the rent was definitely getting paid. It came time for me to start paying my half of the rent and I got a receipt from the landlord each time. He wanted to be mean because the ministry would not give him the money early. It turned out him and his son who was my roommate, we're both on drugs and I did not know that when I first moved in. A lady from the ministry even did an inspection and met both of them and she didn't suspect anything. Long story short, I couldn't use the washing machine and then the dryer, then I wasn't allowed to turn the air below a certain temperature in the summer and it was so hot and then as soon as they lifted the no eviction policy during the pandemic, he went to the court and have me evicted then him and his son hit the notices from the door and the mailbox and had me and my 3.5 year old child put out without solutely zero notice. He also lied to the court and said that I owed him $750 which is one month of rent and I'm guessing he had to do that to have me put out because he couldn't say anything else. I realize this after watching this video. I'm still bitter about it and I don't want to let it go because that's what my rental record now

      Very Sketch! Sorry that happened to you. Lesson; From what you tell it seems the only error you might have made was living with the son of the landlord. Seems like that would have given him access to the mail. If you had receipts and would have been notified of court you surely wouldn't have that on your record. Not sure if you could figure out a way to prove to judge mail was stolen and provide paid rent reciepts if they might remove it?!

I was very depressed at the time & was sleeping alot.. my job shut down & the pandemic had began, didn't know what to expect so I slept life away while my son was at pre-k. That's how they got away with it. They did got paid but because of the landlords attitude with the ministry, they'd make him wait longer for their part & it pissed him off... rightfully so but he was calling them N slurs, bit*he's, etc.. in the end, it only hurt me. He got rid of me because he didn't wanna deal with them but it all came down to his attitude & even asked for the $$ early the 2nd month. They told him no & he got mad. It was either live there or be homeless because that was last day in homeless shelter we had. My son was 4 at the time. Ahhh.... thanks, I just saw ur response after a year lol

    My landlord thinks she can enter my space when ever she feels also touching my personal things i keep telling her she has to give me a notice unless theres water damage or some type of hazard related issue and she basically tells me if i don't like it then leave, she is a nice lady so i have put up with it as long as I can but it has gotten to far she doesn't respect my space or my property, any advice on how to handle this difficult situation

      definitely document everything. take pictures, get a security camera, etc. wish i could help more, that is part of what i am dealing with as well and not sure how to proceed. but definitely document! if you end up in court you'll have proof.

      One last thing I would like todad is that the electric company shut off the power in the middle of July so I was waiting for my disability and really wasn't able to afford it at the pretty hot and I had to get mom to the hospital or unfortunately she passed away within 12 or 16 hours something like that But I think the electric company is a little bit It was a 80 Shutting off electricity in the middle of July I think they're a little Responsible for her death God rushed your soul

    In Colorado, a new law just passed that doesn't matter if you're month to month or on contract with the landlord, you cannot lawfully evict a tenant WITHOUT cause now. You cannot force them out by the sheriff until you've gone to court. I'm going through this right now. My landlord's DAUGHTER is trying to evict me, she's going about it all wrong, she's not even my landlord, and if I have to be taken to court, SHE is gonna be the one who looks like the fool. Plus, I'm mentally ill, and here in Colorado, it is illegal to evict a tenant without mediation FIRST if they receive public assistance, which I do. Every state is different. Landlords can't just throw you out "Just because" in some states. The realtor showings have been exacerbating my mental illness and I'm about to go to small claims court and file a lawsuit for the violation of my right to peaceful enjoyment of the premises, the mental distress caused by all this, including all the illegal things her father (the official landlord and owner) has done to me in the entire 8 years living in the house I'm about to be booted from. All because they don't get to do showings when I mentally can't handle having people going in and out of my house. It was getting to the point where the realtor showings were almost every day and then I finally broke down and told her off. Even though I'm a tenant and I'm mentally ill, I'm not gonna be that bitch's doormat. Excuse my language, but yeah... So there's that.

    I Currently live in New York State I rent rooms in a house, the landlord lives inside of the house as well. I have six children they’ve been going to school since we moved in here July 8, 2019 I never had a written lease it was always a verbal agreement but I do have an owner affidavit that the landlord signed and got notarized and on that affidavit she wrote our verbal agreement that was five years now she’s denying she ever said that there’s a ton of repairs including a roof leaking rodents and other bugs septic issues garbage that builds up an unfinished deck and no railing around the pool doors that aren’t secure windows that I don’t open and I’m considering holding the rent but I wanna know if that’s The smartest thing to do. I wrote a letter to her and mailed it certified mail the day that her and her boyfriend received a letter he came in screaming and telling me to pack my F’ing S*%t and get out Not to use his stove not to use his refrigerator that I crossed the line by reporting it to the health department they were mad because they’re already dealing with the health department due to the septic issues that they’ve been ignoring I can’t find a lawyer that will at least even give me advice everyone is telling me that they don’t handle those kind of issues they only help Landlords please help I’m worried the house is going to be condemned and I want to know what steps I should take and what I can do and what my rights are

      I'm sorry, this is probably above my level of expertise. I believe when a Landlord is renting out a room in a property they also occupy (up to 4 units or less) they are not held to the same standards as a landlord renting out an entire property. I believe you may have less of case to stay if they want you to leave since they are living there. Regarding landlord not fixing things, that is not great, I would encourage you to get ready to move because it sounds like they are not fixing anything. But I do NOT know and I don't know about every state specifically. Check out Nolo.com for State Specific advice. Let me know if you find other free online resources with better info.

      Good luck in your Battle with Cancer. If you don't have a current lease most likely 30 days notice would be all that would be required of a landlord to ask you to leave. Check for your state in Nolo.com. Search your state and eviction, then look for articles on that. They do sell products but if you search and then click "ARticles" usually pretty good info

    I let friends move in and I paid the mortgage, we agreed they would pay the utilities, I paid trash. One paid water& gas and the other paid electric. One was on dialysis and use one of the two rooms for it, we had a bed in that room where I sleep at first. They occupied the master bedroom since they were a couple. They ended up removing the bed without telling me and said because of the dialysis, I spelt on the recliner and told them it won't work out that they need to save up to move. They did nothing. 2 months after I gave them a 30day notice to move and they got hostel with me. I felt threaten and they claimed I was harassing them so I moved in with boyfriend I gave them almost 6 months to move out before I filled out the unlawful detainer. They claim that they don't comply with it due to the condition of the house. It was inspected for his dialysis and they never said or gave me anything stating what they responded with. It being my home and my life savings I am low income and can't afford an attorney. Is there any advice you could give me. Idk what to do from here and I live in ridgecrest California. Where it's 2 hours to any legal help. I appreciate your time and advice.

    Washington state is pro tenant doesn't matter if you have lease or not according to thelaws in this state the tenant doesn't have to pay rent either landlirds jumo thru all the legal hoops to evict tenant but doesn't matter how much paper work you paid for yes...paid for court costs can be extremely high my daughter paid $1100 to evict tenant hadn't pd in 6 mnths but lovely PD/Sheriff office kept passing the buck then tenant hired covil rights attorney ...what a joke...case got thrown out all they did for tenant was show her how to find loop holes...daughter is now into eviction 8 mnths still no vacating so don't listen to ANY of this non sense just because YOU CAN evict a tenant doesn't mean they'll leave nor does it means you'll get any legal help thru the system to remive tenanrs. It's asinine. What it means is just because you own rental property doesn't mean you have control of your property. Moral story is come to washington state if you are a freeloader!!!

    A year ago I purchased a home in New Mexico after the owner passed away and it has a back house which had renters living in it on month to month payments (no lease) When my husband and I bought the home we had no intention of being landlords and we actually want to turn the back house into a garage. We planned to remodel the main house and since it was in the middle of Covid we verbally told the renters that they are welcome to stay in the apartment for a year, while we remodel. Well fast forward to 2023, we gave a written notice to the renters 3 months in advance as a reminder of the upcoming move out date. Then we gave them another written notice 30 days prior to the move out date. Well, move out date came and the renters refused to move and started becoming hostile. I quickly got an attorney who wrote up a 3 day eviction notice and we had a police officer deliver it to the renters. Well, they still have refused to move. Fast forward to now 2 months later and we are waiting for the court date which is finally set in August. Its been such a nightmare. We are still not living in the main house out of the awkwardness it is having people who we do not want there essentially living in the back yard. I have been so stressed on this, buying a home with no intention of being a landlord and doing what we thought was nice by giving the renters up to a year to find a new place.. Is there any way the court would rule in the favor of the renter? I'm so scared of that happening, I have no idea what we would do..

      It all panned out well. I let them know they did not have permission to occupy the property and that I would be filing an eviction notice if they weren't out in 30 days and they left without a crazy amount of damage being done. They did steal appliances and what not but the worthwhile ones were returned after the sheriff spoke with them. Lesson learned - Never sell a house on payments with minimal paperwork to family.

She asked if she could be on the lease with the other lady, but the other lady told my girlfriend that it’s OK so if that lady decides to call the cops on me, although my girlfriend pay rent here would I have to leave? My girlfriend is OK with me staying here

      If you didn't have a lease with the brother that owns the property and you didn't pay that brother rent you won't have much right to remain if he wants you out. If however you have history of paying him rent for staying there, then paying him rent would likely give you more rights to remain.     For california, my e boyfriend and I rent a house from his father but now that the relationship is coming to an end, his father is trying to build a false case against me to have me evicted by saying that I owe thousands in back rent when the truth is that he told me to stop working when COVID hit and to not worry about rent or utilities (for 2 yrs) in order to stay home safe with our daughter who was home schooling. I can’t afford to have an eviction on my record and I also can’t afford to pay back 2 yrs of back rent without warning. Because we have a daughter together I’m being advised to stay o n the property until the custody is settled but now he’s trying to have me evicted
    What can I do??

    Squatters, eviction will be on the records, and these leeches will have problem to rent another apt. No landlord will rent if you have eviction, squatting history.

      I wouldn't unless they were problem tenants. If they pay rent I'd probably let them stay there. That is just me though. You can start an eviction though, consult an attorney and make sure you follow their advice on how to evict properly / legally. If you own in an entity they will probably have to do the work for you anyways but many charge reasonable flat rates for standard eviction.

      @@DaeronMaxedOut Gotcha you bought to move in. If you are not familiar with it, I would call around to a few attorneys and get them to help. Usually they will do flat fee, its a pretty simple legal process but its a legal process...which means even if you act quickly it will still take some time. How much time depends on the state.       You send them notice to quit putting the reason why they need to move out after the notice to quit expired you start eviction process in court with the notice to quit attached to your lawsuit

    I currently have lived with a friend temporarily for 3 months to help her afford her mortgage. I've been paying everything on time but due to personal differences I gave her 45 days notice and was supposed to be out by the 1st of October. I already paid all of September but she wants me out sooner. Can she lock me out when all of my belongings are in the home if I refuse to pay more for utilities?

    Hi i am paying 1650 plus utlites one bedroom basment in Scarborough and my landlord is not turn on the ac in the day and temperature is 31 feels like 40
    They said we cannt afford high bill even though i am paying 30%

    Hi I gave this current tenant a 30 day to terminate her month to month rent. This tenant was very angry. I had a witness. Then the tenant and I didn’t sign any lease agreement. I made a mistake as a landlord by trusting the wrong realtor. I hired a lawyer. She wanted 4 months. I want her to move out by 4 months. She told me I agreed by a handshake. I wish I had my friend with me. As a witness. In case I signed up for an eviction lawyer to legally evict the tenant. She did pay me $950 month to month for a room. I don’t trust this tenant. This was not properly screened by the realtor. I am unhappy. I have to give her 4 months she must move out. 🙏

    In my situation, Im subleasing so I'm not on the lease, I just rent a room but after 7 yrs. my r.mate tells me to be out in 3 days .. IMPOSSIBLE! I've always paid my rent but he recently had a female move in and they share a room, she's a complete nightmare and he mentioned this before and called it off. So now its back on where I have to move, out by 6/6/23 .. like I said IMPOSSIBLE!

    I signed a 12 month lease in Missouri, but by the time I started moving in, the landlord stopped working on the apartment. He did not steam cleaned the filthy carpet. I asked him to clean it and he said he's not doing it. When the lease was over it went to month to month, and I asked him again to clean the carpet, and again he said no. I'm 73 years old with COPD, and the carpet is so filthy that I can't tell if there's mold on the under side. I really like to know if there's anything I can do. I've never missed a payment or late. I need help.

    My lease was up in February and he doesn't let his tenants sign a new lease he puts them on month to month. In March he went up $155 said it was because of taxes going up but he doesn't get bill for taxes till August. Then I had to have my kitchen floor fixed because a pipe was damaged in the wall now he is raising my rent again $100 to pay for the repairs not caused by me at all. Can he do this? I live in Charlotte NC

    I have been trying and trying since May to get help from the legal aide in New Mexico and other agencies as well as searching on line for answer regarding the lease renewal notice sent on May 1 2023 and now the lease is expiring in two days. The office has not only been ignoring my in person and emails requests for information about when to go in there to sign this new lease, but it's now been five times since March 13 2023, that they have also ignored my in person and emails inquires in regards to my request for reasonable accommodation. The corporate office has also not returned one of my calls either, so no help and don't know where I stand and there's nothing else available to rent due to gouging and long waiting lists.

    Ky. 3 years of living here, no lease, maintained all maintance, always paid rent.
    3 strangers came to my door yesterday to tape a note to my door to tell me i have a hand written 30 evict , signed by the new owner., Not notrized, because they're the new owner. Didnt even know this was happening. 30 days is so close to try to find something . I asked if i could have 60 days, he laughed and said 30 days he will be back with the sheriff.

    I have been approved for an apartment in Virginia. Move in date is August 1st. The Landlord is requiring me to send them cashiers check security deposit the amount of 1st and last months rent immediately. But will not allow me to sign a lease until two days before I move in.
