As much as I'd love to tsktsk the police, they had a duty to arrest that man for assault, even with the footage. Their role is to enforce the law: someone claims they were assaulted, they have to arrest the attacker until the DA, who actually chooses to charge someone with the crime or not, makes their decision. You don't want cops deciding what laws they want to enforce or not. Consider if this was a domestic violence case between this man and his lover, Rudy. Would you want the cops deciding that Mrs. Rudy wasn't assaulted enough to remove the potential assaulter from the home? It boils down to it not being the job of the police to decide if the back slap was assault or not. Fortunately the prosecutors office whose job it is, determined that Rudy was a little puny wuss and released that man.
