Between 2006 and 2016, the number of drug patents granted in the United States doubled -- but not because there was an explosion in invention or innovation. Drug companies have learned how to game the system, accumulating patents not for new medicines but for small changes to existing ones, which allows them to build monopolies, block competition and drive prices up. Health justice lawyer Priti Krishtel sheds light on how we've lost sight of the patent system's original intent -- and offers five reforms for a redesign that would serve the public and save lives.

Politicians are bought by votes, lobbyists use contributions and other under the table means to sway politicians to their side, including the threat of votes from workers (via jobs) that they don't represent. Grass roots citizen lobbying is based on votes and so lobbyists can be neutralised when there's a threat that they could lose office.

It's just too expensive. It's ridiculousl you need to pay $10k for an invention. It keeps all the public out of invention.
My doctor told me about another reason for high drug costs. Generic drug manufacturers are bought out by big corporations . The drug prices skyrocket because it costs too much for a "new" generiic masnufacturer to market the drug(s) at a lower price.
Everything she said was so accurate she is probably a corporate target now. I said stuff like that in high school a week later there were federal agents knocking at my door calling me a Russian spy.

I used to take Imitrex, when the patent expired they wanted to make a new one so they added RX strength naproxen, slightly altered the dose of the imitrex and changed the name. I also used to get free samples of Zipsor (diclofenac in liquid gel cap form.) I get some of my meds through the county where most of the patients are poor and on state insurance and the doctors I have had generally pay little attention the the fact I need cheaper generic drugs. (The state insurance covers these name brands no problem.) Last year I went without a lot of things even generics till I hit my OOP max because a single trip to the pharmacy could cost me $500+

then all of these pharma companies would quit and go make video games instead. but then again what you dont know cant hurt you. all of the drugs they could make but wont will never cause public outrage. 300 years ago when simple illnesses could kill you not a single person complained about drug companies.

Brilliant presentation and content
Some medications cost a ton to fabricate, most do not and are simply overpriced. Some medications cost a lot in research and development, most do not and are simply old drugs rebranded as treating a new symptom. We need to be able to differentiate between these. Some drugs are naturally expensive, but most are just unethically artificially priced high for profit.
We do need copyright reform.

We also need to be able to categorize and sub-categorize different patents to have different rule sets. To separate out things like literature from character or mascot designs, or a pharmaceutical's chemical formula from new packaging or delivery methods. Aspirin is still Aspirin regardless of if it's a tablet, gel-cap or some pressure injecting shot from a scifi. The difference between a regular gelcap and a time release one, I can see there being a large enough difference between them for a patent; but not for using a slightly different type of gel or design with marginal improvements.
It seems like a big problem! How come US legislators haven't done anything about it???
They generally benefit from it, as most politicians rely on corporate donors to fund their election campaigns.
Pharmaceutical companies are major contributors to their campaigns. $$$

Changes in patent system are not the only way to ensure treatment for everyone. Look at GB or Germany for example. Everyone gets the medicine they need, even it is expensive. People matter not money.
Please address the Insurance companies and Tort Reform in driving up costs.

There's so many good TED talks that have great ideas and concepts, but it assumes that there isn't a company wanting to make more money. For themselves, or shareholders. Greed will always exist. That's the real problem here.
yes. it is called humanity. and that is why capitalism is so great. in the old days to gain wealth and power you just stole stuff from others. now in order to gain wealth and power you create a factory or invent a new product that makes everyones lives better.

During the financial crisis, I served an American chap who said it was insane that his private prescription for antibiotics cost him £5 instead of over £100. He wanted to rant, but we fund five patients for the cost the Americans fund one.

The problem is NOT with the patent laws, the problem is with the GREDY pharmaceutical corporations. We need to make laws that limit the costs of pharmaceuticals to give the companies reasonable profits.
Vetted international online pharmacies are just as safe as domestic ones - but a lot cheaper. In many cases, the exact same medicine sold here, such as those you may find at a local Walgreens or CVS, costs 90% less from an international online pharmacy.

If you want a lower Rx cost, go to a single payer system where rates are negotiated, and approved drugs are limited to those proven effective in a cost effective manner. Then you don’t need to reform patents at all.
Im not sure but I dont feel like we have those problems in my country in the EU. But of curse I could be wrong.
The fact that the new technology has to be an order of magnitude better for adption is a law of the market due to the cost of transition from the old to the new. I think the idea that to issue a new patent on something it has to be significantly better makes a huge sense.
How should significantly better be defined when it comes to patents? Do you think patents should be based on the foundations of HTA? (Eg cost effectiveness) as a society we don’t align on the definition for magnitude of benefit (eg 1 month vs yrs).
I hope this system changes to an open source system and rejects the belief system in money

PBMs are the main drivers for high drug prices. Ask any congressmen. These middlemen are gouging the consumers. If they were representing the patients they could negotiate lower prices. But due to their rebate kickbacks, they are incentivized to promote higher drug prices.

Ok, good. I'm sold on this. Now what? We know what we want, but what can we do? I'm not a US citizen so it would be even harder for me to change US laws, but still. What can me or other people do to change this? This is a good cause, but I would like concrete propositions about what can be done to help. I have a limited amount of time I can spend thinking about this. Can someone with more time, think about this and propose ideas? There are to many wars to fight and not enough time.
Good ideas, but one needs to be careful with "more oversight." Fortunately what she described was more about additional transparency, which is good.

..... she proved herself in her own speech it is not outdated its just not being enforced properly. although it is a bit more complicated than that also. originally when our patent system was designed inventors were really just small scale innovators you made a new drug in a tiny lab or you made a new device in your garage. nowadays the level of investment required for new things is in the billions and that only counts for a success what about the nearly limitless number of failed projects that also cost many hundreds of millions of dollars.

Interesting thoughts, and I'm sure truly sincere. Unfortunately sincerely simplistic. The heads of pharmacy corporations should face criminal charges just like a back alley crack dealer.
That is an even less realistic idea.
I agree that they should be held responsible for the deaths their decisions directly caused- however, I don't think prison is the answer. The only reason to physically isolate someone from society is if they are a physical danger to others. They are only a moral danger, for being absolute psychopaths. Reparations to the families of the deceased should be made from the decision maker's personal accounts, even if it bankrupts them, and they should absolutely be forced to resign and barred from any positions which hold power over other human beings from then on. They do not care enough about others for that kind of responsibility. Sadly, this is a pipe dream as well, because money is power.

We used to fund medical research thru taxes supporting university medical centers. But since, we've privatized the research in the false belief that doing so would both encourage efficiency and streamline costs, we've ended up where we are. What's worse is we're still providing government money for research only now it goes into private hands for the development of drugs they feel will have the greatest potential for profit rather than those treatments that we need most as a society. Stop with the no more taxes BS, people. The pittance you pay is not the thing killing your financial security. Your employer underpaying you is the problem.

The pharmaceutical industry is influencing people who believe in capitalism to believe that if it is good for the company, it is good for capitalism. That's not true when what is good for the company is a new patent approval for an old drug that allows them to avoid competing with the generic production of a drug like insulin. Capitalism depends on competition keeping prices down. You used to get 7 years to recuperate costs and make profits by controlling prices before competing with generic production to make profits with increased sales vs. increased prices per sale. Then it was 14 years, 20 years, and so on. Now there's no firm end date. Don't be fooled because they say it's socialism to make them work to deserve increased prices and patent extensions. In fact, it is capitalism to ensure they work for profits. They just hope you won't think about it.

Drug price are expensive because of Government interference in the free market. The same is true with College education. The more centralized control by Government where it does not belong, the more harm is done to our society.
I hate to be the bearer of bad news, but last I checked the US Patent Office has no control over what a patent owner(s) and the free market does to the price of an invention after it has been patented. Her speech is nice and inspirational, but I can't see how the US patent system can control the price of an invention brought to the free market for sale. BK

Patent office has a huge impact on prices.
The USPTO doesn't test for efficacy only novelty or non obviousness. There are no labs or facilities to do so. The Office generally believes the inventor that they invented a thing. The FDA tests for efficacy. Go talk to them

Well, it's a good thing these people you say can't afford their drugs are able to take advantage of existing healthcare and financial handouts. They, like all Americans, should make responsible financial decisions, instead of relying on the government to hand them social security checks because they couldn't be bothered to save for retirement.
As far as your point on the patents being extended beyond their limits, yes, this seems wrong when you don't take into account the costs in making these drugs. Often times, they will not be approved, resulting in hundreds of millions to billions of dollars in losses for these companies. If there is no motivation to make these drugs, then it won't happen. The companies everyone likes to hate, the pharmaceutical companies, are not in the business of making medicine out of the kindness of their hearts, and wasting their money that they earned from the businesses they built.

The HIV problem in India doesn't even compare to the United States, where people do in fact have social safety nets that allow people to live. Not if they have cancer and some other diseases, but that's what health insurance is for.
Not liking the cost of health insurance does not entitle you to get it for free. You should have been more responsible. Instead of going to Starbuck's and McDonald's every day, getting name brand clothes, and "needing" the new iPhone every year, buy health insurance. You get to live like a rich person/Z/They/Apache Attack Helicopter or whatever pronoun you decide to use that day, when you can afford it. Time to grow up.
