    Hello Bilal! Thank you for your content and explaining things so thoroughly in your UA-cam videos. I wanted to see if you have any input on a particular scenario. I'm in California and I ended up settling my workers comp case by C&R. I now have Medi-Cal. Can I present to my new doctor my previous medical imaging and mention the therapy I've gone through so I don't lose any progress? My concern is going back to square one in my path to healing from my injury. From what I understand, preexisting conditions are no longer a roadblock. I'm always honest, I just don't want to complicate things either if I was treated under another entity beforehand. Friends have advised me not to mention getting treated through workers comp prior for the ongoing injury, but I think it shouldn't matter since the case is closed and behind me, right? Any advice would be appreciated as I don't have any guidance but this point. Thanks in advance. Best regards.

    Lets assume a claim settled after 7 years after filing for WC. The injured worker then reached MMI past the 5 statue of limitation. His condition worsen and additional injuries appeared, which are 100% related to the original work injury. How can an injured worker be responsible for additional injuries clearly related to the og work injury so happens that it did was not discovered within 5 yrs but 6years instead??

    Okay, but it does not make any sense to me that a statue of limitations can bar you from filing a second claim specially if an original injury does not worsen in 5 years or less but does so 6+years later.

    What do you think would be the purpose for the TPA illegally changing the work status and on top of that also falsely claiming that the injured employee has returned to their employment and is "currently working with restrictions"?. All this shortly after settling the WC claim through a Finding & Award court order. Thank you in advance.

      Hey Victor! No, what Bilal is referring to here is if you have a workers comps case and you have a 3rd party case like a personal injury case. An example is: you're a delivery driver and another driver crashes into you. In this situation, you would have a work injury case and a Personal injury case (as long as you were not at fault).

    Is the California specific? My law firm didnt take the 20% for the first 3 months, while recovering from surgery. Then started to collect it after i was healed.

      No lawyer should be taking 20% on a work comp case. It's generally 15% and only if the court approves it!

    Cost of living in Santa Cruz county is SO MUCH higher than in the cheapest to live in county in California. Income limit should therefore NOT be the same. If they wanna say 1,732 a month is the limit in the LOWEST cost of living county it should probably be 3,464 in Santa Cruz county. BS!

    Hi there. I’m socal. I was just informed by workers comp that I have permanent neck disability that was determined to 13% disability. They offered settlement. Is it okay to seek consultation?     Thank you. My TDD ended back in May and I wish someone helped advise me about this sooner but the problem is nobody informed me that to get certified was a difficult process! My WC primary dr never wants to certify!

    Yes! I knew nothing about workman’s comp. Was advised to use my sick and vacation pay to rest not knowing the severity of my injury. When it did finally get reported, I had no sick and vacation pay to use!

      It depends, most cases you can't double dip meaning you can't get money from a civil lawsuit and wokers' comp.     You take so many losses while out on worker’s compensation. Some lose their homes, families, vehicles, friends, jobs, health, contacts, hobbies, social interaction with others and the list goes on. Some may get an attorney that doesn’t explain the court case etc. Some feel like they should have worked through their injuries to keep a livable wage and not report their injuries. WC injury victims suffer so much overall and many don’t truly understand that and most really don’t care.

    I tried to call the adjuster when my case started and both my attorney and adjuster scolded me for doing so. And they said it was illegal.

      Yea, that's not true. You can contact your adjuster for simple things, like for milage, for authorization for medicine stuff like that. Anything serious, you should go through your attorney first.

    Hi. I’m in southern CA but on average, do you know how long it takes before a settlement occurs from date of injury (average)? It’s been 15 months now. Also, I wanted to do a voluntary resignation as part of the settlement process but it’s taking a very long time and I was given restrictions to go back to work. Is this normal??

      Hi! Each case is different but on average they can last 2 years. Once you have agreed to a settlement it has to be approved by a judge and that can take about 30 days

      It is normal if you are not in the settlement stage yet. If you are given restrictions and if your employer has a job for you within those restrictions, it is going to be expected for you to return to work. If you decide to decline the job with restrictions, some benefits may be affected
