  • Can I Get a Second QME - Qualified Medical Evaluator or Exam Whether it's a back injury requiring a chiropractic, pain medicine, or orthopedic surgery QME, these evaluators must address all aspects of the injury within their expertise.
There's two different kinds of second or another QME. One is a replacement another is about having multiple different kinds of doctors. If you have a back injury and an internal injury - this would require a second QME.
The other is having a replacement QME because a doctor is biased or just not very good. This doesn't happen just because you don't like the medical report. There has to be good reason to do this. Judges favor keeping the QME's and are pretty slow to call out a doctor.
Kassem begins by explaining what a QME is and why they're crucial in workers' compensation cases. He clarifies that QME stands for Qualified Medical Evaluator and discusses how these medical professionals are typically assigned to assess the nature and scope of workplace injuries.
One of the main topics Kassem explores is the possibility of obtaining a second QME evaluation. He emphasizes that while workers are generally limited to one QME, there are circumstances where a second evaluation becomes necessary. This is particularly relevant in cases of multifaceted injuries, where a worker might suffer from physical trauma alongside psychological issues like depression or anxiety, or develop additional health problems due to prescribed medications.
Kassem outlines the process of securing a second QME, noting that it's often a complicated endeavor. He explains that this typically requires either an agreement between the injured worker and the insurance company or a court order. Given that insurance companies are often reluctant to approve additional QMEs due to cost concerns, Kassem shares insights on how to navigate this challenge, often necessitating legal intervention.
The video also covers the circumstances under which an injured worker might seek a replacement QME. Kassem discusses valid reasons for replacement, such as the QME's unavailability, retirement, or potential bias. He provides valuable information on how to prove QME bias and the legal process involved in getting a QME replaced, which usually involves presenting evidence before a workers' compensation judge.
Throughout the video, Kassem emphasizes the importance of proper legal representation in handling these complex aspects of workers' compensation cases. He shares his experience dealing with insurance companies and the court system, offering practical advice for injured workers navigating the QME process.
This comprehensive overview of QME-related issues in workers' compensation cases provides essential knowledge for anyone dealing with a workplace injury. Kassem's expert insights shed light on the nuances of the system and offer guidance on how to ensure fair and thorough medical evaluations in workers' comp claims.

You can generally receive both SSDI and Workers' Comp simultaneously but the amount of SSDI you receive may be affected by your Workers' Comp payments. It's crucial to stay informed about reporting requirements and consider professional advice to manage your benefits effectively. :)
