Is it okay to manufacture someone else’s design that was intended to be a handmade item? Even if that design was free?

    Nice video. The fact the design is basically stolen is only one problem. I think she lost the plot when she decided to manufacture a toy in China. First off, we buy because it’s handmade. Who wants another cheap China manufactured toy? I can go to the $ store if I want junk?

    I'm not on Instagram. Can someone please contact crochet by El and advise her to look into taking legal action. This needs to be stopped. The law protects her pattern. Her pattern was stolen. The law can't make you credit the designer, the law does protect your pattern from being used like this.

  • @irmagarcia4012

    She should look into suing. Legally, you can't control someone selling the product they made from the pattern purchased or free. You can not make someone credit you as the designer. Legally you own the PATTERN and this pattern was stolen. El needs to sue the company who mass produced it and go after the chock who sold our gave it to them. This is theft of her pattern and legally she has all rights to her pattern. This is a lawsuit and she needs to go after them. It's one thing when patterns look all the same this one is clearly distinct

    I agree with you. It doesnt hurt multimillion dollar companies to make their characters to sell. But everyone knows or should know if you make something to sell by a small company always create thedesigner and get their permission to make. What that lady did is wrong and I hope she gets a desist order.

  • @WorksofWhimsyCrochetCo

    I'm not saying it's not wrong but Crochet By El has no legal recourse here. Not because she didn't put that the product couldn't be mass produced but because even if she did, that's not legally binding. And copyright covers only the instructions in the pattern, not the character made. She'd have to trademark her character for this to legally have been an issue. Just for everyone's info. So once again, TECHNICALLY nothing here is ACTUALLY wrong. Morally, it's questionable.😊

    I guess today’s crocheters have their own set of problems. Crocheters of a certain age used to copy crochet pieces just by figuring out patterns from pictures. My aunt was able to figure out complicated patterns from things I would make out of magazines and gift her. Crochet back then was a pure hobby. Now it’s a money making venture. Morality seems to be traded for the almighty dollar. The dollar is now the false idol being worshiped. Nothing else matters.

    Hello! I am someone who lives in Oroville, CA and wish I had came to that event cuz if I did I would’ve bought too many things. Love your work! I also wanted to comment about your feelings about owning your business but feeling guilt towards thinking you’re taking away something from your daughter. Now I am not a mother, but I am a child of parents who own their own business. I was 6 when they started and now I am 26 and they still doing great. Anyways .. As a kid I had nothing but pride and respect towards my parents for being risk -takers. I never felt like my parents were doing something wrong when the business had to be the priority most times. So I hope you don’t feel guilty and acknowledge if you weren’t running your own business you would still have to be away from your baby if you had a normal job. So keep at it! Your daughter will love going to work with you like I did with mine lol

It’s nice to see another “Orovillian” 😂 our town is so small but has had so many big disasters in it and nearby the past few years. I hope you were okay during the Thompson fire, and if you are in town this weekend I will be vending at a small craft fair downtown at the bird cage theater!

    I primarily crochet flowers, and I make it a point to not sell patterns to my designs anymore in order to avoid this type of scenario. Even without a pattern, I've had lots of copycats and even found my designs on Temu. It's extremely discouraging when you're trying to stand out in a space where copying seems to be almost 'acceptable' somehow. Loved the video!!

    • @CatCakeCrochet
      @CatCakeCrochet День тому

      This is a great perspective and something I should have noted in the video, anytime anything is shared online it runs the risk of being copied and the overseas companies can steal designs regardless of if we used their facilities or not. Another huge topic is that, when something is mass produced we have no way of knowing how ethical their labor laws were, so not only do those cheap knock offs hurt our sales but they could possibly be produced in inhumane working conditions. It was one of your videos that opened my eyes to the cheap Temu flowers being sold at a market I went to and I greatly appreciate the time you took to educate your audience on the matter. I’m sure as an artist familiar with seeing these mass produced items, those copied flowers break your heart by not only wrongfully stealing your designs and undercutting your prices but also as a reminder that crocheted items can only be produced by human hands and there is no way of knowing if the hands making those flowers were treated fairly or not.

  • @Pixxelina
    @Pixxelina День тому

    The ignorance about copyright laws shows through and through in this video. Be well versed in copyright law to have credibility in your content. For one, you must register your copyright before you can file a lawsuit for infringement in federal court. Many crocheters do not because it takes time and costs a lot upfront. Which that’s one flaw showing since these individuals are not equipped with the business mentality, yet they chest pound and demand the same rights as businesses. Another tip: if they register their copyright within 3 months of publication or before a violation happens, they may be able to get statutory damages and attorney’s fees reimbursed in addition to actual damages in a successful lawsuit. So this is why many crocheters and small content creators stand no chance against Temu, Shein, AliBaba. Their legal team truly does their research on copyright registrations before stealing someone’s work and getting away with it.

    I’ve released 4 free patterns so far with intentions to release more. If I saw someone mass produce my spuds I would be devastated. I understand that legally it’s a gray area, but the whole thing feels…icky? It’s the added layer of not crediting the pattern designer on multiple occasions which appears to be a repeated pattern of behavior, and then making someone else’s pattern the main thing on her page (again without crediting the original pattern designer). She’s definitely making it seem, whether intentionally or not, like the duck is her idea and design.
