Today’s briefing is focused on SCOTUS - aka The U.S. Supreme Court - and some interesting facts about the current term.
The Supreme Court's yearly term begins on the first Monday in October and lasts until the first Monday in October the following year. The court generally releases the majority of its decisions in mid-June. The Court is typically in recess from late June/early July until the first Monday in October. They hear oral arguments in cases from October through April.
This year, SCOTUS released 28 decisions in June and four in July
35% of the opinions issued were 6-3 votes, the highest occurrence of 6-3 votes since 2017.
Five (8%) of the Court’s 62 opinions were decided 5-4, and 40% of the Court’s opinions were unanimous.
Since 2007, SCOTUS has released opinions in 1,250 cases. Of those, it reversed a lower court decision 891 times (71.3%). It affirmed a lower court decision 347 times (27.8%). Most SCOTUS cases originate in a lower court, though some cases may have original jurisdiction, meaning that SCOTUS is the first and only court that rules in the case. The Supreme Court hears and rules on an average of 74.3 cases each year.

    I can see both sides of the argument, however I am more in favor of keeping the power in the hands of judges. This way if an individual judge, makes a bad ruling it affects a single case. Where is allowing agencies to make a bad ruling affects literally everyone affected by that agency. And under the Chevron paradigm it basically institutionalized, bad ideas. Chevron's current application basically is the closest thing we have to systemic, problems in the government. Taking away that power, opens up every agency to be sued by every person that disagrees with them, and we'll make the agencies less likely, to impose unreasonable rules because they'll have to constantly defend them in court.

      With the courts deciding at least we have a third and hopefully neutral party deciding. I look at Chevron like this, you wouldn't give somebody a blank check with permission or immunity to write themselves a check for A's much as they want. That would be a conflict of interest.

      What if you take what you said, then add "full immunity" for those agencies you said would be sued, say if a president was going to make justifiable immunity for foreign agencies such as police. Then I think that changes the ruling altogether for a bad favoral of morality?

    Great considered coverage! To add to the One Person, One Vote point, STAR Voting is absolutely One Person, One Vote no matter how you look at it. In the classic sense, in STAR Voting 's scoring round you add up the stars, then in the runoff you add up the votes. Every voter gets one vote, and the finalist with the most votes wins. This makes it legally compatible with election law everywhere that calls for "the candidate with the most votes wins" or a "win by plurality". For a more technical perspective, One Person, One Vote legally means that every voters' vote must be equally weighted as nearly as is practicable. STAR Voting ensures that in both the scoring round and the runoff by eliminating vote-splitting. This is why STAR passes the Equality Criterion: if the election was tied and you voted, there would always be a way that I could vote equal and opposite to bring the election back to a tie. (Approval Voting and Condorcet systems like Ranked Robin also pass this criteria.) starvoting.org/peer_review On the RCV side, there are a few arguments for why it does not comply with One Person, One Vote and does not ensure all voters an equally weighted vote. 1) In RCV, some voters whose favorite does not win will have their next choice counted, others will not, even if they had another candidate ranked and even if their other rankings could have made a difference. 2) In RCV, voters are at a mathematical disadvantage if their vote transfers later in the process, or not at all. In some cases this can lead to large numbers of people's votes backfiring, resulting in a worse outcome for them than if they hadn't voted at all. (Monotonicity and Participation Criteria failures.) 3) A study analyzing 98 RCV elections from 2006 to 2019 found that in races that required multiple rounds, over 10% of ballots were unable to be counted in the final round either due to the order of elimination or because they were voided due to voter errors. 4) Studies consistently show that lower income and minority voters are more likely to cast voided (ie spoiled) and exhausted ballots (un-transferable votes) under RCV.

    Thanks for making such a thorough analysis of the STAR Voting campaign in Eugene! One thing to note: You mentioned the opposition from Tribal Democracy Project and other groups. It's important context that almost all of the groups opposing STAR Voting in Eugene receive funding from RCV Oregon and/or are in coalition with them. Also, neither the orgs nor the leaders of these opposition groups are based in Eugene. The person leading the opposition doesn't even live in Oregon! Just some things to be aware of.

    In New York 22, Democrats want to defeat Brandon Williams. Redistricting gave Williams small cities, and moved rural areas to rural District 21, which is represented by Republican Conference Chair Elise Stefanik. Some suburbs of Albany that were in District 21 were moved to District 20, which has a small area because it has Albany, or to District 19.

    I'm glad to know that the criticisms of Mr. England hold no water given it would be the same if any new voting method is used. And its not complex at all, I already have to select multiple options for county justices and school board members. He implies we'll constantly be too stupid to vote on our ballot, especially when a new method is enacted.

    I’ve never heard it called ‘top two primaries’. Sounds like a standard two round runoff to me. Am I missing something? Also, the ‘special’ Louisiana method is the only sane way to do it. Obviously if a majority has already been attained then the winner is guaranteed to win the runoff, assuming none of their voters defect for some reason.

    Ranked-choice voting is for babies and beauraucrats causing double the work and time. Vote for one person and mean it. Not vote for a person without a snowball chance in Hades and when they lose, you now get a second vote in ranked-choice. Holding up the entire works. Like in Maine right now. At least run the vote count computers for full ranked-choice the first time, rather than waiting for a run-off.

    In Rockland county there is only a congressional race. I do not see any propositions to consider. I will vote later and I haope that you are correct. I hate finding additional measures that I did not consider.

    Midterm elections (such 2010, 2014 and 2018) are sometimes considered to be a "report card" on the job performance on the President. These trifectas are most likely to be broken on those years, because a majority of the Governorships are up for reelection. Also, On the first election year of a Presidential four-year term, the Governorships of Virginia and New Jersey are up for election.
