What I see is that he start with one idea and it change in the middle, I think he goes by what he see how is developing the picture if he like stay and if no it is covered till he reaches what his eye said Yes this is it

That's just what I was thinking while watching this! I looked it up and there are various opinions on the issue including whether the artist got permission to use the photo, whether the artwork based on the image is derivative, and whether the photo was under copyright in the first place. I don't know VOKA's circumstances but I would really hesitate to sell work this obviously based on a single, identifiable photo.
@@kvr8286 a photo always has copyrights it's an art form just like painting I don't think that there are exceptions I am a painter myself and I like drawing from interesting photographs just as much as just drawing from my mind and I'd really like to sell those or at least show them at art exhibitions but I don't want to get in trouble for it and respect the art of that person like I want mine to be treated respectfully thanks for your answer have a great day
@@unbekanntesmadchen9058 It looked to me in my five minute search that there's a difference between using the copyrighted photo for reference (literally referencing how to paint a tree or lighting condition or what have you) and copying the subject with your own "twist" on it, which is where the issue of a piece being derivative comes from. My question with VOKA is that I think his work would fall into the derivative category which is much more problematic from a copyright aspect seeing as how he's literally repainting the photo with his own artistic spin in his medium. I'm a painter as well and use a lot of copyrighted reference photos (granted, I'm a hobbyist) which is one of the reasons I haven't pursued selling my stuff more. VOKA's work is wonderful and inspiring but confuses the hell out of me on the copyright front! Perhaps the reason he gets away with it is because he work is sufficiently transformative in the colors, paint application and abstraction that he skirts the original photo's copyright?
@@kvr8286 thats how far i got with my research too... i looked at his website and it looks like he got a huge team maybe they take care of that for him like you can with music when youre using a copyrighted sample and the label takes care of it i can only guess though I wish he would clear it up for fellow artists so we dont step into a trap or something not everyone has a team lol
