How I obtained a copy of my VA Summary/Breakdown letter to include the diagnostic codes.
I called the VA at 800-827-1000 and inform them that:
“I would like a summary letter/disability breakdown letter to include, all my service-connected conditions, percentages and diagnostic codes.” (If you are not service connected, you will not have one). Also, you can have them email or fax (if you don’t have a fax at home, you can download a fax app in the play store on your phone) this information, if the person doesn’t want to email or fax it, hang up and call back and speak to someone else.

Hi Dwayne my topic MULTIPLE SCLEROSIS....just found your channel today and so happy because you have a lot of great inside information that we need. I have one that you might or might not have information on. I served on active duty Army from Jan 1990- Jun 1999 with honorable discharge. Later on in 2011 when I was working as a civilian contractor in Afghanistan with DynCorp Intl and I collapsed due to horrible tingling & pain in my feet & legs & was transported to the nearest hospital in Dubai for 4 days where I had MRI & spinal tap, got diagnosed with MULTIPLE SCLEROSIS. Lost that contract job & started using the local VA for neurological services. I filed a claim in 2015 & it took forever & got denied in 2018 because of course they pointed out this "the presumptive period for multiple sclerosis...VA assigns this seven-year presumptive period because MS can be very difficult to diagnose based on the number of different signs & symptoms & a veteran must show they were experiencing symptoms of the disability within seven years of leaving active duty service. Of course back then who would have thought that the reason I kept dropping out of every single unit run is because of muscle weakness in my legs. But of course, I was always told I was lazy but I felt even back then that " my legs just stop, they wont keep running" and I had never heard the term " fatigue" before, I just use to assume I was tired. I was so confused and now after getting sick & diagnosed in 2011 all the symptoms during the last 5 years on active duty fall under MS symptoms. Let me know if you have information on MS. Again, to sum it up actice duty 1990-1999, got sick & hospitalized in 2011 and diagnosed with MULTIPLE SCLEROSIS filed VA claim for MS in 2015 and denied in 2018. Symptoms have worsen, brain & spinal lesions worsen but "stable" over the last several years, I say stable because I can still walk & work inside a medical lab. Thank you

Responding back to you Dewayne. I didn't do the C&P for my 5 claims. Got no increase of 70% ptsd, but did get increase to 90% in totality TODAY.
What I question is the VA saying my private psych gave no ptsd diagnosis on the DBQ. Yes he did and it's on the nexus along with other supporting evidence I sent in. Strange.....
Not all VA employees review the evidence the same and they do make errors. @@DewayneKimble I did not fail to attend my exam, I cancelled, but DAV is saying because I didn't attend, the VA couldn't evaluate my actionable.and sufficient DBQ. They said reopening the PTSD claim and having the C&P will be my new and relevant evidence for a supplemental claim. I got my total increase to 90%, but denied increase for PTSD.

Part2 also have you seen as a rater moved the goal post on effective date for any injury and got caught doing it. So I had to point that out as well...

When you get a minute, I just got off the phone with the informal review H/L call earlier about my knees and the lady I talked to was real receptive. Now I am going to throw this at you and I asked her the same thing?
I believe the 38cfr for knees are flawed. If the VA issues you a cane and two knee braces and the MRI plus x rays show what it shows

Hello Dwayne. Thank you for all you do and sharing your knowledge and expertise with us. Truly amazing what your doing. My question is pertaining to being 100% P&T and trying to file for ailments falling under the PACT Act. If I file for the PACT, am I risking having my disability get reduce if I file? I know that my VA letter states that any thing new I file, they will not re-evaluate any existing approved disability of mine. But I hear so many Veterans saying they're getting reduced because they went back and file for something else. Your help in this matter is greatly appreciated. Thank you.
Your welcome and it's my pleasure. How would it be reduced, I did a video on this. Also, I did a video on "They Said", is toxic, turnaround and go the other way. They are not telling you the whole story as to why they are getting reduced, just I got reduced. Every claim is different, trust me get educated.
Outside contractor non va. If you cant get a copy of your C & P exam until months later... How do you prepare for your HL review since they are happening pretty fast. You dont know what the exam doctor put on paper.

I filed a fully developed claim December 2022. I met the 3 elements etc. I'm in Kuwait, and I declined the C&P through telehealth. I'm still waiting. At this point, I might just go ahead and tell the VA to put me back in for the C&P.

I had a really good ptsd exam and he checked all the boxes. I called Vera a month later for an update and she told me it would stay at 70 since total social and occupational was t checked. I knew something was off based on the exam and reached out to the examiner. He thought total social and occupational was for handicapped in wheelchair bound veterans. He sent me a nexus in less than 24 clarifying I was total social and occupational and how my tbi symptoms were different than my ptsd. How would you look at a veterans supplemental appeal with this new evidence?
I would have to look at all the evidence submitted.

Had a claim for head injury when I got out, got denied because i was asked if I hit my head on the ship, I said No because I didn’t hit my head on the ship. I hit it in a LCAC or hover craft. Had the head trauma on my service record. Can I just submit a supplemental evidence like writing a statement saying I didn’t hit my head on the ship that I hit it on a toolbox in an LCAC while underway? I didn’t know that I was suppose to claim TBI back then . My recent Ct scan was good. But I still have really bad migraines. Never claimed migraines either coz I didn’t know any better. I don’t have a copy of my medical records yet. Still waiting on VA to send me the CD. I need to claim migraines too.

On VA website, it states that the VA will accept scientific evidence from an article from a medical journal or published research study. Trying to connect hypertension to secondary condition of Stroke. Found many articles on internet from Mayo Clinic, American Stroke Assoc, CDC, Medscape, etc. Will these be accepted as evidence since stroke is not on presumptive list. Already service connected for hypertension, coronary heart disease, and prostate cancer. Thank you

I was diagnosed and service connected for sleep apnea at 50% in 2017. I was also diagnosed with Allergic rhinitis and sinusitis. I never claimed rhinitis or sinusitis at that time because I didn’t know it was a claim. I would like to file for it now under the PACT ACT for these conditions and chronic fatigue syndrome. I was in Iraq 2003-2004. My question is, do I file it as secondary to sleep apnea? Or is it filed as a new claim? If I file it as a secondary claim to sleep apnea will it not fall under the PACT ACT? and be disqualified from the back pay to August 9th 2022? Thanks.
If your claiming it under the PACT Act it would be direct. Only a medical professional can say if sleep apnea could cause it. i had two c and p exams for PTSD the first Dr. said it was service connected and then the VA had me to do another c in P for PTSD a month later, and the examer that did that one said it was not services connected, so which one will the VA go with ?
I can't say which one the rater will use. There are hundreds of raters and I can't say which opinion will be used. The question should be, if denied, how do you argue the it on appeal. Question. I have recently been service connected for hypertension and I also have Mild Cognitive Impairement. I have applied to get my memory issues service connected secondary to hypertension.
My understanding is we JUST have to prove that there is at least a 50/50 or greater chance that hypertension has damaged my memory. We DON'T have to say it is the ONLY factor or even the main factor, just that it is A factor that has resulted in my diagnosis of Mild Cognitive Impairement.
Do I understand VA requirements correctly?

Good morning. Im wanting to file for a CUE, but not sure if I have enough to win. I know there are 3 elements. I feel like the error was to easy to find so Im iffy about it. Long story short I left during basic in 2002 bc of knee issues but I was not medically discharged. I filed a claim in 2007 and was denied stating it didnt happen in service. Filed again in 2018 and won. Lookinh at my military medical notes box is checked stating occurred in service. Do I have a claim for CUE or its not that simple? I want to challenge 2007 denial.

@DewayneKimble I feel the error is the VA overlooked evidence in the file or medical records, but looking at the decision letter, they used my medical records as evidence. In regard to what regulation violated... let me do a little more research bc my decision letter does not specify laws. It just says reference Title 38.
Is it OK to bring notes to a TBI and or mental health exam? I went to my TBI exam and I was about to look over at my notes C&P examiner said I cannot look at it. I wrote my symptoms down because I have really bad memory.

What would cause a case to take over the ave time to finish. I am at a 5 month wait now from my last C& P exam which was feb 10th.
There is no average time to finish a claim.

My VA doctor wrote me a great nexus letter for my Supplemental claim for Sleep Apnea secondary to my service connected Rhinitis due to bun pit exposure. My Doctor provided the DBQ in the initial claim also. Now VES is doing an ACE exam, is this even needed? and why would they need to do this if I provided everything they need through my VA DR. Thanks!

Kevin Jordan, USAF Airman DS/DS MRT 2A313B F16, F-117. Asked for assistance from 2lt 362 squad. with wife's military spouce adjustment issue. Requested DEERS and got a psycho eval instead. Got discharged under a personality disorder (inability to adjust to military lifestyle) after 186 days in service 16 vacation. Started a A1C out of basic, tech school I became E-1 Airman basic, before discharge, was told I made E-2 Airman and 2lt said, oh it's you, threw my stripe in the trash and then said, never mind, get out of here. Wife then committed suicide. 30 years later just received 50%PTSD And then told by VA REP. you can not change a DD214 FROM Personality disorder
