Larry - love your work. You are forgetting that there will be a disclosure that the buyers agent will be working against the sellers interest which is the crux of the lawsuit. Yes, an incentive to attract more buyers is necessary but let’s not forget there will be more involved after that offer is accepted. The seller does not want to compensate the same person who will attempt to reduce their price or request repairs or appraisal issues. Everybody keeps forgetting that piece. It is not subagency. You’re paying for someone else’s fiduciary.
I view this a bit differently, when cooperating with a listing broker or buyer broker - we are actually on the “same team” - it’s “team help respective client achieve their goals”. working toward the same mission = success for our respective clients to collaborate to getting what they want and need = a smooth transaction that closes and each party gets what they need. This is not different to any other industry, sales negotiations, contract negotiations. The brokers/agents job is to broker the agreement. That is the definition of broker. And negotiating is fundamental to the successful outcome for both sides. The agreement is just that agreement to negotiated terms to satisfy both parties and conclude the transaction - where everyone walks away satisfied with the outcome- no one is forcing anyone to any terms. It’s called agreement for that explicit reason. And therefore we are working together to find that agreement for both parties. Compensation is built in to attract the parties and pay for skills services and respective work for each party. Why did K-mart have blue light specials or why do infomercials do buy now for $19.99 or why do car dealers offer incentives or car brokers charge a fee to negotiate the car purchase or why do wealth managers take a determined % of your portfolio to manage it, it’s to attract, retain and conclude business - marketing and achieve a certain performance. A sale, a successful outcome, manage the client.
