He had not been served a warrant for it's placement so Law Enforcement had no case because it was his property and in order to search it he needed to be served a warrant so that he could have due process. If you find a tracking device on your vehicle and you have not been served with a court order or warrant feel free to remove it.. However you should not damage or alter the device unless it is absolutely necessary for it's removal.
