    One of my friends CONSTANTLY drives high and tipsy. Her thing is "I've been driving 20 years and never had an accident" or "I drive extra careful if I've been drinking". I stopped getting in the car with her a long time ago and everyone else thinks I''m 'being difficult'. My life is too important to take chances just for the sake of getting a lift somewhere..
    People think driving drunk and high is some sort of badge of honor. It's all fun and games until someone gets killed.

      I live in WI, and it is like a badge of honor up here. Both of my parents were children of alcoholics, and I know that if I really wanted to, I would be the worst addict anyone had ever seen. It's why I stay away from that stuff, I have never driven drunk, and I never will. An occasional beer-sure, we all do that. But to constantly be high, drunk etc. is disgusting. Your friend also needs to realize that.

      Felicia a family is incomplete because of her careless actions. And as you said she ruined several lives. She cut a very young and precious life short. No amount of rehabilitation can change that. The hardest thing a parent can do is bury their own child. You will never get over a loved one's death, you will learn to cope with it, but you will never get over it.

      thankfully the parole board did the right thing, she got paroled in 2019, serving 6 years in prison. She seems a regular girl, she didn’t want to hurt anyone, she’s no monster but everyone in that courtroom treated her like one… of course she deserves a couple of years in prison but 15 years for an accident? that’s no justice…

      @@weirdsciencetv4999 look at her tears… she really regrets her wrongdoing, I’m pretty sure she’ll feel guilty for the rest of her life, plus lost 6 years of her life in an horrible disgusting prison, I think she was punished enough. Put yourself in her place… you always be a good child, never get in trouble, have good grades and go to a good college. Yes, in a night out with college friends you drink and drive one time, get caught but nothing bad happens. After finishing college, you’re in a good job just starting your career, and in one night, just in one night everything change, you drink and drive and the night ends with you killing a baby. You didn’t want to hurt anyone, it was an horrible accident but they treat you like a murderer and you’re sentenced to 15 years in prison… and even after being released after 6 years served you’ll be a felon with lifelong criminal record… no good job awaits you anymore, your hard work in school/college is gone… sounds like a nightmare don’t you think?

      Yeah, I honestly empathize with both of them. Obviously I think it is extremely painful to lose someone you loved with all your heart to another persons actions. And I cant imagine going through that. But you can clearly tell that the woman who crashed the car was painfully regretful in what was an avoidable intoxicated crash. Im sure she never meant to put the baby in danger, but in the state of mind she was in she didnt think of the consequences, and Im sure that this will eat up her heart for the rest of her life. She was an innocent citizen who really fucked up, and is now facing the consequences of that. I cant imagine going through that either.

      @@gallzatron4046 The problem with that is that you are underestimating the power of alcohol and substance abuse. When you get into that state of mind , you are not you. Im not saying she doesnt deserve any punishment, cause she clearly does and she does need to face the consequences of her actions. But I cant help but sympathize a little with her situation. I couldnt bare myself if one night after a party I thought I could drive just fine and ended up killing a baby. The remorse and the blame would eat me up inside, as Im sure it is eating her up.

Im not saying there's no pain involved in the mother's side, because OBVIOUSLY there is shit loads of pain and anger that losing a child to someone's misdoing can bring. Im saying I dont doubt that the killer feels guilt and pain too. You clearly tell by the video. The mother has full right to hate the woman, shit I would probably hate her with every bone in my body and would want nothing more than to see her get locked up for life. But I feel like theres a lot of pain and regret that goes into killing a baby mistakenly, because you were drunk and couldnt think straight. The woman should and will face consequences for her actions, but I cant imagine the pain that I would go through living my life knowing that I killed someone's child just as much as I couldnt imagine the pain I would go through if I lost my child to somebody else. Im just saying theres pain involved in both sides of the coin, so I cant help but empathize with both (even though I empathize more with the mother). If the woman was unregretfel and showed no remorse, perhaps I would feel differently, but you can tell she is clearly disgusted with herself. Maybe one day you'll fuck up someones life really bad and face the consequences, and then you'll get where Im coming from.

    I lost my son, so I know what it's like to lose a baby, but can you imagine the guilt that this woman feels right now? The guilt of killing that baby will destroy her. No amount of jail time will hurt her more than her guilt.

      yeah maybe. but no amount of her feeling sorry will serve justice either. she's lucky she wasn't convicted of murder. It's important that we take a zero-tolerance position on DUI. 10,000 people die needlessly every year in the US alone from DUI-related accidents.

    I have no sympathy for drunk drivers. You do the crime, you do the time. For 15 tears I worked on a unit the trauma patients, drunk drivers that were so drunk that they didn't remember being in an accident and killing someone. Call a cab, call a friend, or walk, just do not drink and drive.

      I'd argue that about 70% of people shouldn't be driving or in control of anything larger than a bicycle.
      Self-driving cars and transports on tracks are the future. Even if there are accidents with self-driving cars, it's statistically less than if we let everyone drive a vehicle.
      Everyone knows at least five people who shouldn't be driving, either for financial reasons or because they're a danger to themselves and others when behind the wheel. More strict licensing and more public transport will lessen these problems.

    I think most of us get satisfaction seeing convicted killers getting sentenced to life or death.. I was watching those types of videos before landing here, and now I'm in tears.. This is just a terribly sad story no matter which way you look at it.

      Execution is the only thing missing for her. I was struck by a drunk driver. 11 years ago. Not a day goes by with out wishing I was killed in that accident. No mercy, no help for my family. No support, I paid into the System. But I got the Shaft. I Lost everything. My truck had Five More payments. Ford took my truck back. Gave me the Finger and took my truck in middle of the night. With my Bible. That was given to me, by a friend who passed away. So I have no pitty for pigs like this. Her "Second Drunk Driving." No Mercy. She's only sorry she was "caught."

      Actually Melissa was charged with 2nd degree murder because she had two priors which allowed the prosecutors to claim that she had "malice" (I saw the trial, they made her out to sound like an evil uncaring witch who deserved life in prison, which was not the case).
      Anyway, I agree.. both these girls had a drinking addiction and should not be punished so cruelly. Melissa got a minimum of 60 years... people say she deserves it but I say that's it's very cruel. Same with this dumb girl.

      Yup, MM was a wreck during the trial and when she spoke before sentencing. Yes, she was probably horrified knowing she was about to be sentenced to life in prison but she clearly felt remorse over killing 4 teenage girls by her stupid actions. By all accounts she was a very nice and decent girl... just had an alcohol problem and didn't make smart decisions.
      Wow, that is a sad story about that man. You'd think that everyone would be smart enough to never drink and drive, but something in that alcohol makes people (not everyone) stupid and do stupid things.
      Humans are complicated beings... they can do stupid/ thoughtless things without evil or malicious intentions and then tragedy occurs.
      I just feel bad for some of them when they are just stupid and not thinking that anything wrong will happen and then people are dead and they're in prison with violent insane harmful people, or psychologically ruined like that man you described..

    I think everyone that turns 21 must have a separate drinking license. You have to take a four hour drunk driving course which shows tragic car accidents with pictures of the victims that have died along with the crying parents and spouses and an interview of the driver that caused the accident. If you don't have the license, you cannot be served at bars, clubs or public places.

    The only thing putting her in prison accomplishes is trying to make people feel better.
    Putting a drug dealer, robber, or gang member in prison prevents them from committing further crimes. That's what prison is - keeping people out of public.
    Are we afraid this woman is going to get in her car and track down some more babies to kill? Does she look like a killer to you? Pay the victims money, take away her license, community service, permanent record, all those things make a difference. Jail time? Good for nothing but spite.

      I agree, Jail is unproductive and actually just makes worse criminals with the way it's run in the U.S.
      However, I would at least put her in jail for a year or something, then do all the things you mentioned as well. TONS of community service etc.
      We have a weird fetish for hell-on-earth in the United States, and it's really, really, really expensive to maintain this system. It costs enomorous amounts of money to lock people up because we're not just paying for the food, water, and resources of the prisoners, but also the guards, and mountains of paperwork and bureaucracy. It costs nearly $30,000 yearly per prisoner. That's a healthy salary!
      And it accomplishes very little. It wouldn't be so bad if we had optional assisted suicide, but for religious reasons, this country won't even entertain the idea. I know if I did something like she did, even if by accident, I'd want to die. Why spend your $30,000 to keep me alive doing absolutely nothing productive for anyone? Let me die.

    About two years ago there was a huge highway accident in my country, the media was full of the story. A young woman (severly drunk and high on something) was speeding and crashed into a small car carrying 4 people (two sisters and their husbands). She never helped them, and by the time other cars arrived at the scene it was too late to help - the car caught fire and those four were burned alive. The young woman (who is btw a millionaire) got 4 years at the end. 4 years for four people's life - or even more, as the victims had children wo were orphaned.
    At least this 15 years gives something for this woman to think about. 4 years in not enough to even come close to properly understand what you have done.

    To those of you saying the sentencing is too harsh; I believe she should be in there for life. You SHOULDN'T be drinking while driving at all. Anyone who says the sentencing is too long is basically condoning drunk driving. Anyone at all who's drunk while driving should spend the rest of their lives behind bars. You can never trust these people. Like how you can never trust a murderer. Unlike most murderers, all drunk drivers are so stupid that they're actually considered a threat.

      SD LunarElf murder is the unlawful killing of a human being with malice aforethought. in my opinion someone who has had a previous DUI conviction knows damn well what the consequences of driving drunk are and therefore that should satisfy the malice element of murder as described above.
      I happen to think everyone should be on notice that this is dangerous behavior with or without a prior DUI, but at the very least in terms of someone w/ a previous DUI who kills someone doing it again, i think it's absolutely appropriate to charge them with 2nd degree murder.

    It's too late to say you're sorry after you have killed someone. The family of that baby will grieve for the rest of their lives. I myself have lost 2 family members to the negligence and irresponsibility of a drunk driver. Driving a car is a privilege and if it were up to me a person convicted of DWI would never be able to drive again! My cousin was 38 and her husband was 40 when they were wiped out by a drunk driver who ran a red light. Her daughter survived but now has no parents. There is absolutely no excuse for this kind of stupidity!

Interesting thing is that in some cases if you are drunk driving and hit someone (lets assume that this person wont die and also assume that he escapes with minor injuries). You will propably get lets say 2-6 months probation time. And lets compare this for example to cannabis.       Actually, it's not. It's the max of what they could sentence. The main issue is "mens rea," meaning "bad intent." Because it's hard to make the case that someone like Kellogg set out to intentionally murder Baylee, you have no "mens rea." I'm not defending it, but as an attorney, I can tell you that this is a central component of sentencing law, even when it's not made explicit.

      +Josh Fierro - if you really are an attorney then surely you are familiar with the doctrine of depraved heart murder? obviously it's harder to convict someone of murder than manslaughter - it's a more serious crime. this would be true even if she had pulled out a gun and shot someone. Strictly speaking you don't have to prove intent to convict someone of murder and the element of mens rea (malice aforethought as it would apply here) can be satisfied in extreme cases by gross negligence.
      Murder is the unlawful killing of another with malice aforethought and the court can absolutely impute the element of malice on someone for gross negligence that results in the death of others and allow a murder conviction.
      So, somebody who has a previous DUI conviction and subsequently drives drunk, stoned and coked up on Wednesday-morning rush-hour traffic, in the rain WAY over the legal speed limit; do you think an argument could be made that this person showed reckless and wanton disregard for others? I do.
      They no doubt told her this during plea negotiations which likely played a roll in her decision to agree to plea guilty to a lesser charge.
      Yes, she got the max - but she's lucky she was not convicted ofmurder as she absolutely would have been in another state, California as just one example.

      @@bobby8536 The Judiciary would never tolerate it, but the States should enact "Truth in Sentencing Laws" which narrows the shell games the "Justice System" plays on the public. The 15 years lets judges go into the next election cycle sounding tough on tearjerker babykiller cases like this... then the horrible offender does only two fifths of it.

    Whether or not 15 years is too harsh for that girl is sort of irrelevant. The point here is that the sentencing MUST be harsh. It has nothing to do with "punishment" and everything to do with deterrent. DWI offenders don't care if they lose their license, they'll drive without one. They don't even care if they might kill a baby, but start handing out 15 year sentences and maybe they or their friends will do something about them getting into the drivers seat while drunk or high or otherwise impaired.

      valkyria20chronicles I have had opportunity to drive drunk. I didn't, because I have seen what happens. Plus, I don't want to hurt anyone. I don't want to go to Jail. I don't want to lose my career. I don't want to be humiliated, by the cold steel of handcuffs on me. I was.....Deterred.
      The vast majority of people, including this defendant, think like the above, even while drunk. But, they choose to take a chance. Or, they are truly dangerous because they don't give a shit at all.
      This defendant had all the power and intelligence to learn her lesson....the first time. The time when no one died. The time when society was more lenient. But she got drunk again, and also smoked a doobie. And then killed someone.
      If we had prison Resorts in this country, a number of criminals would purposely commit crimes again so they could get off the streets and back in prison. You may think it works in Norway, but not here.

    Wow I feel so much pain for everyone involved with this: the parents who will have to live every day of their lives grieving the life of their daughter, the siblings who will have to grow up without their sister and the woman who will have to live every day with the fact that she killed someone's child, a baby who didn't even have a chance at life. I know she was in the wrong by recklessly driving while under the influence of drugs and alcohol, and that it wasn't her first DUI so she had chosen to ignore the warnings but I still feel bad for her and get no satisfaction from her being punnished

I think that the length of a sentence depends on whether you believe prison is more about punishing people or reforming them. I think that 15 years is long enough for her to suffer for what she has done, reflect and to change. She won't be too much of a danger to society to never be released from prison and it would be a waste of taxpayers' dollars to keep her in there for life.
      Non-violent drug crimes certainly shouldn't be punished with life sentences but you have to remember that drug dealing is not a victimless crime. It is to profit from stripping vulnerable people of their health and keeping them in a downwards spiral of poverty. I feel bad for people that were born into families where drugs were freely around and they were sucked into the life of dealing, but I know too many people were victims of this and have had their bank balances, careers, relationships and physical and mental health destroyed by addiction.

    15 years for killing someone when drunk and driving? That seems too harsh. Frankly, quite a few people drink and drive and though I agree it's completely irresponsible, it hardly compares to murder or rape which is what the sentence time suggests. This driver deserved one year- two at most.

      15 years isn't harsh enough. If this was purely an innocent accident then I could be more agreeable to a shorter sentence but it wasn't innocent.     I’m a person who is more “eye for an eye” logic, so I’m cool with death sentences and death penalties. But a baby being killed shouldn’t be taken differently that an adult. A lot of people here are saying she should have a way harsher sentence than a regular murder. Personally I think she should be charged with the equivalent of murder on the road period; the age of the person shouldn’t matter.

    The first time you accidentally kill someone via drunk driving, it should rip your life apart. She obviously didn't care since she decided to drink and drive again. She should be gassed in a chamber. Man or woman, you're sick if you do something like this.
    If I heard right, the victim said that her baby was tore in two pieces? You would normally think of a baby dying via a non traumatising way such as dying in their sleep.. but that.. that's just sickening. I couldn't imagine my mother's reaction if that happened to me our my sister.
    That drunk lady is a waste of air. She deserves a longer sentence, 'it' had its second chance.

      +Victoria Waters Alcoholism is a disease, DUI is a choice. Your argument might have weight if she didn't have a previous DUI. As you yourself suggested, many people get away with DUI - so ostensibly this wasn't only the second time she ever did this. Even if it was, she was aware that she was not to be trusted when drinking so the burden was on her to either make sure she didn't drive drunk or simply not drink.
      She wasn't just drunk either, they found marijuana and cocaine in her system. Forgiveness? She doesn't deserve shit.

    She is just 24 years old! I feel sorry for her. What a crazy justice system. Im from Sweden and this is just sooooo wrong. It was an ACCIDENT. She should get therapy and maximum 2 years in prison. What will 15 years in prison do better for her, the mother and for society? It's going to destroy her life, a cost for society and there is not going to be any justice for the mother...she should stop fooling herself.

      This was the SECOND drunk driving incident she had been in. Even if this had been a first time thing, she knowingly got behind the wheel while drunk AND high. And it looked like it was justice to that mother and family of that baby girl. $20 says that if there hadn't been an accident, she would have continued to drive drunk.

      She knew what could happen the first time she was driving drunk, and even then she went and did it again killing someone in the process, accidents can be prevent, but she didn't do it the first time, and the second time she killed somebody in the process.

    Look. I was born in Australia. I moved here in 2009. The drivers here are fucking atrocious. 90% of the time, nobody uses their turn signal. Almost every time someone is swerving on the road they're on their phone. When you merge onto the highway, there is a high chance that people will not give way to you. Here's my advice for Americans. Use your fucking turn signal. Be polite, let someone turn in front of you, it's not that fucking hard, it even makes you feel good. If someone merges onto the high way, let them in. If someone is going 5 miles under the speed limit, there is zero reason for you to tailgate them. And if you're the person driving slowly, I recommend you simply go the speed limit. When you're driving, look on the road. All I see is selfish drivers, almost everyone puts themselves in front others as if the world owes them something. I'm not saying I'm the best driver at all; but when I moved here I've just be astounded by the lack of discipline and courtesy on the road. It's really not that hard.

      I too wish that people would consider using that turn signal as well as a golden rule, and I do let folks turn in front of me when they're the one that arrived at the intersection before I did but I'm not about to wave them on because they should 1.understand the rules of encounter, and 2. Remember the orders whom arrived at each intersection and realize that each type follows a prescribed pattern uniformly instructed over the whole country.

      To explain it, the large truck I drive has to be out of the way of an oncoming turner in a dual-lane situation before they can see if it's actually safe to move across. They shouldn't expect and can't rely on my having checked my passenger's side rear-view mirror before waving them to cross in front of me.

    I have some friends in the mainland who drive intoxicated. I keep telling them dont drive when they were drunk but they wont listened to me. I even offered them to drive them home. I'm the only one in the group that never drink alcohol when all my friends went out. First of all I dont like the taste of the alcohol. And I love my life my family my kids and most of all my husband.

    Ya know, I have infinite amounts of remorse for the woman who lost her child and ANY attempt at minimizing that would be absolutely unconscionable.However, at the same time, the woman who was drunk has to live with the knowledge of what she has done and the pain the incident caused. To force her to stand there and hear all of the references to the harm she caused is just a method of torture.Her life is ruined. She won't sleep for years and years without waking up hating herself to the point where she'll wish she WON'T wake up and brushing her teeth while looking in a mirror will be nearly impossible.

      gamelvr1 Well I guess you must know her personally and are just perfect enough to judge her. Looked to me like she was truly remorseful and you can tell the difference between those that are and those that aren't. Plus, I didn't hear her once say she was innocent and didn't deserve what she got, especially since she admitted to doing all of it!

      Monster? How do you arrive at that? Is she remorseless? Does she seem apathetic to the harm she caused? Indifferent? Did she intentionally cause a death? You know what the difference between HER and everyone else whose ever made a bad choice and driven drunk is? LUCK!

      He's not exaggerating her crimes. Someone close to me was involved in a car accident with similar outcome. The issue all people have is not taking Drunk driving seriously. You people think dui is not serious but it totally is. Just check how many people die every year because of car accidents. Everyone thinks nothing will happen if they drive while being drunk until it happens, and when it happens is already too late.
