It's an industry standard that the venues acquire what are known as public performance rights which allow copyrighted songs, including covers of them, to be played at that location. However in this case I'm sure Mustaine could go after them if he wanted to.
You can play anything you want, as long as any royalties are paid. And since this is three former members of megadeth who played on the records, I think they have ever right to play them. So when someone is playing your songs live, oh wait,, pigeons don't have songs.
