It seems, 'declaration simpliciter' is also taken care of by court BUT if the further issue, in relation to present declaration suit, is inherent in between the parties now before the court, the simpliciter suit to be amended accordingly, if not done suit may not be entertained. In fact, with appearance of other side, all matter would get cleared as to why declaration is being sought. And perhaps, that is the reason such suit is not dismissed at threshold.

My brother took her signature on affidavit stating that the ownership shall be transferred in his name but there is no Will / gift deed. I requested my brother to transfer title from later mother's name to all Three heirs name but he his avoiding it. Can I file a Declaratory suit against him?
Declaratory decree can only be provided if the plaintiff claim full and final relief , and if court found that his relief is for the purpose of claiming further relief in any other case or he will claim in future more relief then the declaratory relief, then court never allowed plaintiff to get any relief from the court
one doubt sir, that there is last line of sec 34 says plaintiff need not in such suit ask any further relief, then, why there is in proviso saying that court shall not make any declaration where plaintiff omits to do so. is it not contradictory?

Does it mean that court may permission the party to amend the plaint and prayer and claim the relief. Till the time can court stay the proceedings and after amendments then decide the case.
Why should court ask, if I be a judge I can directly dismisse the stay application by giving such reason that plaintiff by claiming declaratory decree wants to build the ground for further relief

Sec 6 comes into play after the dispossession of tenant, he can get back the possession and for this he has to file a suit within 6 month from the date of dispossession, whereas he can file a suit under sec 34 at any time if landlord refuses that he is his tenant, so tenant through sec 34 ask the court to declare that he is the tenant (if has proved only then)..

A' sold his property to a third party without partition but B wants to buy his property. Infact B still have the possession over A's property. Now what is the remedy B have to own A's property... rply plzzz 🙏🙏

Any further relief means relief on the basis of declaratory decree. So plaintiff can't use the decree to get further relief
