      Yes, however the petition will have to be done off shore once deported. There are countless of similar cases in US. People go there illegally, they live there and bear children. Now the children have the US citizenship and parent suddenly having a loud voice of wanted to fight for their right to stay in US.

      kudos to ICE. Im a Filipino and even though he is a fellow Filipino i commend ICE for doing their job. the guy is been living there in US undocumented with his Family for 7 years? that's too much. He knows what might happen when authority caught them so why is he asking for fairness and human rights when in the first place they live in there in US illegally?

      Oh come on Red I know the BI in the Philippines is notorious or locking up foreigners who overstay or eve not allowing someone into the Philippines who does not have an onward ticket upon entry. But that's the Philippines. And they don't have the opportunities we have here. Sure overstaying is illegal. But look at life in the Philippines and the prospects for opportunities for decent jobs with livable wages. I saw a day laborer in a video the other day who said he earns 300PHP a day which is about $3 a day. Seriously anyone who does not have good opportunities for fair wages and come here will probably do the same like that man.
      Also ICE violated the law. If the police lock you up they're supposed to read you your Miranda rights. Here he was supposed to be told he has the right to see a judge to get a hearing. Instead he was told he would be locked up for at least six months upon which he should have called them on their bluff and agreed to be locked up so he could see a judge. Like the Filipino immigration advocate in the video said he would most likely be out on bond and get a hearing. He got kids born in America so most likely he would have been granted a stay by the judge since Obama's executive order was not repealed by Trump who does not want to come off looking like he is pure evil breaking up families especially where this man does not have any criminal convictions.
      So the only thing he can do is to tell his story so others like him in the Filipino community who are here illegally will be aware of their rights and not allow themselves to be intimidated by ICE and definitely not pay for their own ticket back to the Philippines. That is the ultimate insult. I mean if you're going to deport someone then let the government pay for it.

      wayne that illegal alien knew that he was breaking the law the day he jumped ship in the USA he could have applied for citizenship at that time instead of mooching out of American taxpayers pockets for 7 years there is a bunch more like him and I hope ICE gets everyone of them GO PRESIDENT TRUMP BUILD THE WALL NOW!

      They also denies re-entry to Philippines Chinese professionals from re-entry after training in USA. The Philipines Chinese were born, grew up and educated in Philippines. They were never been to China. I guessed Philippines did not want their investment.

      This is bull shit, I saw this story. He was arrested for multiple accounts for molesting kids. His wife was lying and saying she didn't know where he was. He was hiding in a neighbor's apartment.

    you need to respect other country's right to implement their law, you went there illegally, for sure you know that there is the high risk of being caught, you were given the option to go home voluntarily or be detained... you broke their law entering without a visa and now you are asking for your right??? I wonder if a foreigner breaks Philippine law if they will be given the same dignified voluntary departure.

    Foreigners in the US ILLEGALLY do not have Constitutional rights, except where noted.
    Tell the family that was leaving Disneyland that were hit by a foreign DUI hit & run driver whose 6-year-old child has skull fractures & may have a lifetime of problems as a result! He will likely be scared for life! This guy had been deported, reportedly 19 times! And they are raising funds to pay his healthcare (I suppose ObamaCare doesn't cover that, does it!?!)
    A family member was hit by an uninsured foreigner living here illegally. That was over a year ago, and he's had to pay out almost $10,000 out of HIS pocket, even though she was 100% at fault, spent over a month in a nursing home, had a broken collar bone, knee, sliced open head, etc.
    It absolutely costs money to have foreigners in the US illegally!

    Dito sa canada wala akung narinig na undocumented immigrant, kung sakaling expired na ang whatever visa you got to enter Canada then you will be given a notice to go back to your country, if you will not comply you will deported by the authorites. Mr. Rey Galleon what right you are talking about, in the first place you are the one who did not obey the law of united states, you have to face the consequences.

    He should have never came here "ILLEGALLY" in the first place. My wife is a Filipina, and we paid thousands of dollars, and she is now a "Legal Permanent Resident". It is a slap in the face to all of the many LEGAL Immigrants in America that waited and came here the right way! I do not feel sorry for him or his family in the least, we are a nation with laws, and he broke those laws.

      FYI...all sailors who jump ships CANNOT file an LPR (legal permanent residency) much more on Citizenship.

    Go ICE! Let this serve as a lesson for others to learn to do things the right way when coming into this country and to wait your turn in line. Deportations are good for America and it's good that this guy paid for his own plane ticket. Taxpayer money should never have to be used as much as possible to go towards deporting illegal immigrants. They should also have all their U.S. bank accounts frozen and transferred to the federal government revenue as payback also.

      Philippines is very restrictive in immigration except for Korean and recently China. Filipinos should be aware of this. Philippines government should know the golden rule and not expected exception for Philippines. There is a change of immigrations attitude of Philippines due to economy. When China was poor in 1970, Philippines treated ordinary Chinese with no respect. Philippines denied a lot of foreigners re-entry visa in 1970s after going abroad for professional trainings. Philippines denied a lot of HongKong people from migrating to Philippines when China took over Hongkong. They were allowed to migrate to Singapore, Australia, Canada and USA.

      Philippines was not friendly to immigrants also even if you were born there, grew up there inTondo and educated there. Philippines did not care if you were professional such as doctor, had practice Medicine there for 2 years and would not posed a financial problem or burden to Philippines. Philippines denies my re-entry visa after my medical training in USA, 4 years, including fellowship due to my Taiwan visa since birth(never been to Taiwan). One could have contributed to the healthcare there as a doctor and has no language barrier problem since you were born and grew up there(Tondo). My wife who passed away was a native born Filipina. She sacrificed to join me in USA when my re-entry visa was denied, she was my girlfriend before I left the Philippinesand courted her by phones in USA. Majority of Filipinos do not know how strict their government was in 1974 regarding immigration. Professionals like me Philippines rejected ended up staying in USA . A lot of my contemporaries like me who were born and grew up in Philippines settled for Singapore, Australia, Canada and USA. Filipino should ask their government why they were not immigrant friendly at that time in 1970 to 1980s I have no ideas on 1990s and after that. Philippines had very strict immigration policy more than USA. Philippines born Chinese Professionals like me I know ended up in USA, Singapore, Canada and Australia. I would not be in USA if USA had the same strict immigration policy like Philippines. Even the immigration officer in US who interviewed me said I was not the only one. A lot of professional like me were gift wrapped to USA at that time. by Philippines. He said that in order to have a professional like me one would need to spend at least 2 millions dollars. He guessed Philippines was richer than USA financially and in professionals. My permanent resident visa was approved during the interview. President Reagan was the president then and he tried to attract professional to migrate to USA.

      @@tropturd6458 I was in Plaza Miranda area. Saw B. Aquino at old FEU Hospital carrying a machine gun going up and down the stairs after the bombing.. Philippines policy has not changed since I was in Tondo in 1960 and 1970s. It has changed since Duterte and he is immigrants friendly. I think Duterte realized that fervent Filipino First left Philippines isolated and stagnant among Asean country. Like the immigration officer in USA commented that Philippines tend to throw their foreign professionals to the USA as if USA was a third world country. I was one of those professionals. Spent first 24 years of my life in Philippines and denied re-entry after 2 years of professional training in USA. One has to accept one's fate.

    Ano ba ang ipaglalaban mo manong? Nakinabang ka na nga sa pagtatrabaho ng walang mga kung anu-anong papeles at kaltas sa sweldo mo puro ka pa reklamo. Mabuti nga at hindi ka ikinulong, kundi mas malaking perwisyo sa yo. Kaya napakahigpit ng US government sa pagbibigay ng visa sa mga ibang kapwa natin Pinoy kahit na wala naman talagang intensyon na mag overstay dahil na rin sa kagagawan ng mga gaya mong TNT. Nakinabang ka nga sa sarili mo habang ang karamihan nating kababayan kahit emergency na, yung iba nga medical emergency pa hindi pa rin mabigyan ng US Visa. Tapos ipaglalaban mo pa ang pagiging illegal mo sa Amerika. Sino sa tingin mo mas lalong maapektuhan? Yung iba o tingnan mo 25 years ng naghihintay ng visa, yung iba nakamatayan na wala pa rin, tapos ikaw mag-complain pa eh wala ka ngang dokumento. Wag namang ganyan...magpasalamat ka na lang at ngayon ka lang hinuli.

      Gus YAO because according to statistics and common sense, people from poorer countries are more likely to overstay. The "victim" in this video is a perfect example of why immigration must be tough. Misfortune? What misfortune are you talking about? Obey the law.       Philippines has strict immigration law. I was denied re-entry visa back to Philippines after my professional training here for 2 years in 1974. I was born and educated in Philippines but with Taiwan visa.I spent my first 24 years of my life in Philippines and speak Tagalog fluently. Philippines has tough immigration policy also. Even now I still have not been to Taiwan. Philippines immigration officer told me to go to Taiwan since I had Taiwan visa. Philippines has the same policy like USA and actually much stricter than USA. If USA is as strict as Philippines I would not be in USA and I do not know if going to Taiwan where I do not know anybody or have a job there was a good idea then. Grateful for USA to keep me. Philippines has stricter immigration policy more than USA. Philippines now loosened migration by Chinese and have better relation with China. It's hard to understand why Philippines had stricter immigration policy at that time. I attended medical conferences in USA, usually Canada, Singapore and Australian have tables in the conference trying to attract professional to go there and offering resident visa at that time. Philippines had very strict immigration policy at that time denying people born there and lived there to return to Philippines after 2 years out of the country. A lot of my contemporaries went to Singapore, Canada and Australia. A lot of Hong Kong Chinese were denied admission to Philippines when Communist China was taking over Hong kong. most went to Singapore, Australia, Canada and USA.

      California is also a big agriculture state. That's billions of dollars of produce for the domestic and international market. How many Americans are willing to pick produce under a blazing California sun? That's why that state tolerates illegal immigration. It benefits the business community, and Trump being a businessman, understands making a profit is the bottom line. As for not having compassion well you alone have to live with your conscience. There is abject poverty in the Philippines. People do what they have to do to survive same as the Europeans who settled here and displaced the native Americans.

    My sister wasn't able to come with us to the U.S. due to her starting a new family which we had to re-petition her for. That was in 1996. We still haven't been able to bring her here from the Philippines. Not once did we ever try to bring her illegaly. It sucks that's she's not here with us, but it was just the hand we were dealt with. With that said, I believe in what our government is doing. Why allow undocumented people to live here while people going through the legal process gets left out... We should shift our focus on aid to people who want to come here legally so they can help this country grow.

    Would us citizens have the same rights in the Philippines if we were there illegally? Will we be able to protest and blame dutuerte and it's government and the people of the Philippines that I have a right to be there illegally. Dutuerte should take responsibility of its people. Why aren't the Filipinos trying to make changes back in their home island so that they don't have to struggle here in the united States. Philippines is a beautiful place as well as the people.       I was born and educated in Philippines. I was denied re-entry to Philippines after 2 years of training in USA. Mas stricto ang Pilipinas kaysa USA. Wala ako sa USA kung stricto ang USA tulad ng Pilipinas. Philippines has strict policy more than USA, Singapore, Australia and Canada. Hindi ako nahirapan mag migrate sa USA. Sinabihan ako na tangap ako during the first US interview. Nagkwentuhan lang kami noong US immigration officer during the interview. I was offer resident status in Singapore, Australia and canada during several medical conferences in 1970s and 1980s when these countries were actively recruiting and they have your qualifications in their computer and were prepared during the casual talks. They even give you a little gift during the casual talk with them on the conference floor. US immigration officer was friendly and Philippines immigration officer was not welcoming and talked a little reminding you that you are not Filipino despite talking to them in Tagalog and they talked back in English.

      Faye Tatman: Mrs. Tatman, for sure if he worked for that employer whether he was a self employed or contractual, he still had the right to defend himself and to get an attorney that's the law even if he's not a US citizen as long as he doesn't commit any felony or crime plus having a US born children would have let him stayed in US and have also lived peacefully in one of the sanctuary cities like Los Angeles. The enforcers just gave this guy false options that he'd go to prison because of the agenda of the current president and an intimidation that ended up to self deportation. In contrast, the employer who hired him to work for their own benefit should be liable for hiring an undocumented worker but not him. Employer should have also be in question. Why would they hire an applicant who had no eligibility to work but to deport him is not a lawful act.

      Not really. Each country are given certain number of quota. The Philippines exhausted that quota. For you to apply to US you need to be a professional that United States are not over crowded, and you have to have good deposit to your bank account, unless the law has changed. The waiting period is multiple year. The fastest way is to married an American citizen.

When I was in Switzerland, you can check by the police even while walking and if you can't show any legal papers then they will take you and deport later. A law is a law.

    what their argument is that they are not illegal because they enter with legal tourist visa, however they can't get it in their head that once the visa expired they are now illegal and breaking the law. So a handful of crooked lawyer who wants to make money out of them insist that they have the right to stay here, that all they need to do is fight for them and of course that comes with expensive legal fees. This guy is driving a BMW so the lawyer thought that hmm money bag. So if they went thru legal process it may have been cheaper in the long run than hiring this lawyers who promise you that they can help you.       Masmahigpit ang Pinas kaysa America. Madaling akong nabigyan ng Green Card sa USA pero sa Pinas pahirapan. Madaling maging US citizen kung qualified ka. Pinas ay ayaw akong bigyan ng re-entry visa after 2 years ng training sa USA. Sa USA ay iniencouraged ka mag stay kung professional ka. Twice ako nagtry na magmigrate sa Pilipinas at twice nadenied Sa USA naging federal worker ako kahit walang green card noon umpisa. Madaming gaya ko na dito na lang sa USA or sa Canada, Australia at Singapore. Doon ako pinagnanak at lumaki sa Tondo. Ayaw ng Pilipinas ang foreign professional kahit doon ka pinanganak, lumaki at nagaral. Lisensyado ako na doctor sa Pilipinas. Dahil sa Filipino First policy ay hindi ako puwedeng mag doctor sa Pilipinas. Sa USA ako nagdoctor dahil sa welcome ka nila basta qualified ka. Naka practice ako sa pakadoctor at emplyed ng US government kahit walng green card noon. US citizen na ako ngayon.

    My wife is from the Philippines, we went there and had to abide by the laws while there. We wanted to stay an extra month and had to follow thier rules and pay for a visa extension
    Thats how it works. My sister in law ,her brother are here in the usa ,legally . The had 3 kids here. Own a house. Bought other property for investment. . Brought their parents here to watch the kids. Legally .
    There is no discrimination. In fact the usa is more tolerent ,allowing property to be owned by non citizens . Not in the philipines though .

      Philippines does not allow non Filipino doctors with Philippines Medical license to practice medcine,. Philippines passed a retroactive law invalidating medical license of non Filipino who got the medical license prior to passgae of the law. This does not bode well on credibility of Philippines. Who would be dumb enough to enter into treaty with Philippines when it can unilaterally not honor the treaty. Would not blame other countries to do this. To trust Philippines only when you can verify through Philippines's action.

    hindi ka talaga nila bibigyan ng lawyer, kasi hindi ka nman citizen, wala kang karapatan sa loob ng bansa nila, ndi ka nman kasi talaga dapat nandon. I get it mahirap maka kuha ng US visa, pero hindi un dahilan para hindi mo respetuhin ang batas nila, mas pinapahirap mo lang lalo ang pag kuha ng visa dahil mas nawawalan sila ng tiwala sating mga pilipino. At hindi mo manlang naisip na binabaliwala mo rin ung hirap na pinag daanan ng mga kababayan natin na nag hirap at nag sumikap para dumaan sa tamang proseso.

    yan kasi ang mahirap sa ibang mga Filipino eh. Kahit illegal na, ginagawa pa din. Yang mga ganyan ang nakakasira sa image ng mga Filipino citizens worldwide. Wag na kasi ipilit ang hindi pwede. Kaya nga may batas and legality when it comes to immigration policy. Why do you need to go there when you know that you are undocumented immigrant? what's the sesnse of going there illegally? Matitigas kasi ang mga ulo. Taposnkapag nahuli, ang daming excuse, isisisi sa ibag tao, isisisi sa gobyerno, hay naku! Tama lang na maghigpit ang ibang bansa para sa mga illegal immigrants na yan. They should be aware na bawat bansa may kanya-kanyang foreign policy and immigration law na sinusunod. Wag nang mag-kunwaring hindi nyo alam yan. The Law and policy applies to all, no matter what your race, status and gender in the society. Bawal ang pasaway mga kabayan!!!! Para hindi lumalabas na kahiya-hiya ang image ng Pinoy sa buong mundo.

      Aling bansa ang open? all nations have their immigration laws, if you're undocumented, overstaying, even if you are a foreigner legally staying in a country but commits a crime, the host country have every rights to arrest, prosecute, incarcerate and deport you.

    Masarap mabuhay sa sarili mong bansa basta't masipag, matiyaga at marunong kang makuntento sa buhay. At hindi din naman masamang mangarap ng mas higit dun kung sa tamang paraan, madali man o mahirap. I'm proud of my roots. I'm Filipina married to an American, been in the US a couple times but currently based in Dasmariñas, Philippines. My husband and I works for the same company. We grind 5 days a week and still pay our taxes and mortgage in the US and here. Because that's the LAW. What I don't understand, we Filipinos go abroad usually for "mas magandang buhay" for the people we love. We try to do it the easiest way possible not knowing the consequences. It's the sad truth. 💔

      Maxene Mataac it really does not matter sino pa nagsumbong. Come here legally tulad ko at ng ibang andidito. Nagpapakahirap mag work to pay taxes and insurance. Di yan fair sa amin. Kaya tama lang na ma deport na sila, they can always come back here after they apply for visa. Kung talagang masipag sila, ipepetition sila ng employers nila.

    It’s not a broken immigration system , laws were already there . they’re just implementing /enforcing the laws and they broke the law. I’m a legal immigrant from Philippines , single mother , from being a skilled worker to greencard and recently Americanized , never married for a greencard . If you follow and enter this country legally , you will be rewarded with citizenship . Proud to be American me and my daughter !

    What rights? You don’t have a right to come to US illegally. I have an older brother who did the same like you and if ICE will find him it’s really his fault not somebody else. Grow up man, you are lucky in other country if you come illegally you’ll be in prison and experienced worst that you can’t imagine.
