      You would also lose your job. You'd get behind on car and home or rental payments. You very likely would be absolutely destroyed financially, no vehicle, no job, potentially no place to live or with immense late fees and/or destroyed credit

    This goes well beyond incompetence, there was clear, intentional malfeasance, here. The cop flat out lied to her when he said that her name and birthdate matched the suspect's.

      Cases like this happen quite often and there is case law that exonerates cops under qualified immunity. She should be suing the person that falsely attached her photo to the record. If they aren’t a sworn police officer they don’t have qualified immunity.

      Mistaken identity arrests happen quite often, but not cases like this. In the majority of cases of mistaken identity arrests the person that gets arrested has the same first and last name as the person they're looking for and is in the same area as the person they're looking for. And while it's still unreasonable that they don't do anything more to verify that they've got the right person outside of saying "are you Patrick Ryan" and having the person say yes, it's at least understandable how the mistake happens.
      In this case literally nothing about this woman matched the person they were looking to arrest other than her first name. Different middle name, different last name, different age, different date of birth, different DL number, different SS number, different hair and eye color, massively different height, massively different weight, lives in a different state, looks nothing like the person on the warrant. This was absolutely insane and there is no plausible explanation for how nobody out of the dozens of people that were involved in this at any point did anything whatsoever to look into all of the glaring discrepancies between the person the warrant was issued for and the person they were conducting a huge operation to have arrested in another state and extradited back to Texas.
      Oh and the story about someone attaching her photo to the record is bogus. That never happened.

    Sue the Broward County Sheriff for $1,000,000 for false imprisonment, and sue the Harris County Sheriff for $5,000,000 for falsification of an arrest warrant!

      Compensation and accountability are two different things in this country because of qualified immunity. Even if she wins a humongous lawsuit the cops will suffer no consequences. It’s always “we’ve investigated ourselves and found we did no wrong“ and / or the cop just moves to a different department before any investigation - or gets a promotion.

AND THEN, just then, maybe the citizens of those counties will fight for reform so they're taxes don't continue to increase....
      but then again.. no one cares... this is why qualified immunity must be overturned...

      Its really not kidnapping. This was definitely wrong, but fact that her photo was attached to the warrant means that they could've had the right person because the other Jennifer could've been the wrong person just as easily. Not defending them, but not kidnapping.

      @@Stratus41298 Definitely kidnapping. The officer knew the name and date of birth did not match the photo / person he had. Yes, the mixup could have been the other way around... until the booking officer double checked and confirmed that the person they had in custody did not have any warrants. At that point continuing to hold her was straight up criminal. The officer didn't want to get in trouble for his screwup so he just threw her in prison and hoped it would go away.
      Even holding her when there was uncertainty about the identity (rather than doing the research to resolve the ambiguity) was blatantly illegal. Continuing to hold her after someone else had actually checked and told the officer he had the wrong person... that is not a police officer. That is a criminal with a badge.

    It is exactly the lack of accountability in the legal system that allows law enforcement, prosecutors, and judges to make mistakes without fear of consequences. Her spending three days in jail did not affect anyone other than herself and her family. LEOs just say "oops, sorry for the mistake".

      I've heard countless stories of wrongful convictions/arrests. People who've spent decades incarcerated. I've never heard a cop/prosecutor/judge be remorseful, because they're not remorseful.

    I heard they did an “internal investigation” and not only dubbed that they didn’t do anything wrong, they also didn’t even apologize stating that “it happens”. I wish we could petition to defund certain counties for negligence of proper training for their police officers. If they don’t want to train people on how to do their jobs, losing money from the state will shape them up real quick.

      I agree as the warrant stipulation gives a full description of person .
      And this case they had the person go through booking process that gave height and weight, and eye color . Where it was obvious that all three didn't match. This information would have been apparent right from the start in intake.
      The reality of having arrested wrong person then holding her for another day is going to be a clear point in lawsuit against the county.
      This going to interesting to see how it plays out in court.
      As there was similar thing on video where woman sued for being held for 12 days her case went on for over 4 years as defense appealed and the courts ruled qualified immunity was granted because Marshall had been processing valid warrant.

    This is why qualified immunity needs to end. The union also needs to be liable. Since the union protects members, that means the union can be a party to the lawsuit.
    The only thing they will understand is losing their jobs, authority, and losing their assets. When they're poor and powerless, they will live with the same fear they try to inspire in others.

      That has nothing to do with qualified immunity if IJ wins their case.
      The union has nothing to do with the issue. They pay for lawyer fees and don’t get to make judgments on punishment. If you have a lawyer on retainer (which is what a union provides) and you get in trouble, should your lawyer be responsible for your actions?

    It’s horrific knowing this is how they treat actual criminals, freezing them out, and blaring death metal is cruel and unusual punishment (especially if they haven’t had their day in court). But for an innocent person to be treated this way makes it even worse.
    How are we as a society ok with treating anyone like this?

      Yes, especially as the US practice of treating inmates as animals is unquestionably failing. We have proportionally far more people incarcerated in worse conditions that peer countries....and higher crime rates nonetheless.
      Basic intelligence would suggest looking at other countries' practices and policies to learn why they have better results.

      Because QI applies to civil suits, not criminal ones. The only thing keeping police officers from being criminally charged is the local DA refusing to do it. It's corruption that keeps the justice system two-tiered, not QI.
      The hierarchy, first and foremost, protects the hierarchy. If they fire/jail all the bad cops, they no longer have their order-following foot soldiers to make sure you keep paying your -taxes- extortion.

      Blame the courts. They created this. The police are just acting under their perceived authority and their immunity.     I spent a night in Broward County Jail for the exact same thing. It was not me, still I was arrested. Spending the night in jail changed my life forever. I dropped out of college directly because of my experience. Being innocent in jail changes a person's life. I hope she gets a huge payout to make this awful experience manageable.

    Same officer that killed a black man for carrying an airsoft rifle and listening to music through headphones. Lots of ego and prior issues with this officer. He was the first officer in 30 years charged in an on duty fatal shooting. Of course the judge dismissed the case, but that's Broward county. But the family did get 2.5million dollars from the lawsuit

    In my state it takes 560 hours at the police academy to get a badge and a gun while it takes 1,500 hours at a beauty school to get a license to cut hair. 560 for a badge and a gun vs 1,500 for a pair of scissors. Think about that ....

      @Sondan1988 perhaps we haven't seen it in action, but about two-thirds of LEOs who had resigned within the first year it was implemented cited the lack of QI protection as a concern. I do think that civil rights violation cap should have no limit - it's currently capped at 25k.
      Look at the Karen Garner case - both officers were sentenced, one is still in jail, the other on probation.
      Yareni Rios-Gonzalez - the officers were sentenced.
      I think doing away with QI is weeding out bad officers.

    I'm 75 now. I used to be a supporter of police. Today, given what I have uncovered online, I would never cooperate with, or assist the American police for any reason; even if I thought their request for assistance was reasonable. I am sure I have a lot of company in this
    view. It's not the occasional error that that is demoralizing, but the fact that the courts almost always give bad cops a pass and assure they suffer zero consequences for their malfeasance!

      Also, anything you say and/or do, even before you're read your rights, can or will be (usually will be) used against you in court. As soon as you find out you're being arrested you need to ask for a lawyer and perform your right to stay silent even though they will typically try to harass/provoke you into talking.

      I had a cousin who was imprisoned for murder. His mother fought tirelessly for him. She passed away while he was still in prison. Years later with DNA evidence he was cleared. Unfortunately, during his lawsuit against the state, he passed away as well. It’s always seemed to me It was the most cruel events I personally witnessed.

      One of our local police departments had a Facebook post about their explorer program for high school kids who want to be cops. One of the requirements was a 2.0 GPA. I don't think I have ever known anyone whose GPA was that low.

The elected Sherriff in each County should fire each of the doofus Deputies (especially on the Broward County Florida end) and make all deputies in both departments take and pass a READING exam! If not, then a good candidate that understands the U.S. 4th Amendment needs to run for Office of Sherriff in both of those counties.

    I am Irish and my buddy and his gf were Ashkenazi Jews. We were detained, made to lie face down in mud in a hard pouring rain until a drive by identification of a store owner who had been robbed.
    He had told them it was two Hispanic men. It ruined our evening 🙂 but gave me a story about hammer-headed cops.

    I was almost arrested for similar reasons. My son hit a deer and I arrived to assist him since it was his first ever driving incident. I called the police so we could file a report for the insurance and once they arrived they asked for my ID since I had phoned it in. Once my son stepped away for a brief second, the officer informed my that I had an arrest warrant for another state, a state that I have not visited. They at least took the time to verify a few things and I was free to go.

      Unfortunately, overwhelmingly common events demonstrate irrefutably that such horrid searches are necessary because people insist on utilizing their body cavities for smuggling substances, weapons, and other illicit items into jails and prisons, across borders, etc. I agree that the search is horrific. I don't know what alternative is available besides x-ray, which would be a challenge to implement widely.

    This is one of the many examples of why I am completely against capital punishment. The state cannot ever guarantee they are correct, and due process MUST be on going for life.

    The actual woman is in her 20s and this woman has a 30yr old son. Just sue that county for millions for it's insane "mistake" and subsequent torture of a totally innocent woman.

    Body cavity searches and strip searches should be outlawed. There are scanners now that can do the job. I hope her lawsuit brings BSO to their knees.
