As states scramble to push back their primaries to comply with the federal guidelines aimed at social distancing to combat the coronavirus, whispers have begun that maybe, just maybe, President Donald Trump will use the pandemic to cancel the 2020 election entirely. This is flatly untrue. Here's why. Primaries are state-run contests. States are given wide leeway to set the dates and times of how voters get to choose the nominees for offices like state legislature, House, Senate and governor. While postponing a primary isn't easy -- there are massive logistical challenges to doing so -- it is, broadly speaking, up to state governments to make these calls. This is not a perfect process, of course. Ohio is a good example. Gov. Mike DeWine asked the state's Supreme Court on Monday to postpone Tuesday's primary election in Ohio until June. The court said no. So DeWine -- and the state's top election official -- ordered that polling places be closed. And so, the primary didn't happen. A general election is not up to the states. It is governed by federal statute. And this language in particular:

Dude, you forgot about daylight savings... that's congress redefining the time as being one hour later. They could redefine Jan 19 to be Jan 21, so that Jan 20 doesn't happen, as it says the term will end on Jan 20, NOT "will not be in office after Jan 20", so without Jan 20 happening, the term would never end hahaha

I’m with the OP. Clearly though, it isn’t that they’re unable to do it by mail. They just don’t want to make voting easier for the common people because he’s probably depending on the electoral college to get him through like they did 4 years ago... See: gerrymandering. I don’t like either party much these days but when one wins the popular vote by 2-3 million votes that seems like a prime example of why some members of the electoral college don’t represent anyone but themselves.

@@AndrewAMartin I agree with Nene here. My high school taught me some stuff under the assumption that I learned history in my prior years. They were wrong. Middle school taught me how to do synthetic division (because math was important to that school for some odd reason), and elementary taught me how to sneak snacks around campus. High school taught me stuff I couldnt really grasp without prior knowledge and they didnt have the funding, time, or energy to teach one kid years worth if materials.
I was one of the few lucky students who had a teacher who LIVED for politics. So I honestly learned more about government than anything else.

it already has been
postponing or canceling the election would not work in trump's favor, even if he could do it, because only 1/3 of senate is up for election, so remaining 2/3 would decide interim president after trump is termed out. those 2/3 are mostly democrats. 1/2 the states do vote-by-mail so unless the postal service stops, at least half the states can still vote. best trump can do is like Wisconsin, where Supreme Court forced voters to vote in person, and the governor closed all the polls, so thousands and thousands of people had to go to just 5 polling places and risk getting sick in order to vote. but that was a primary, which states can (and did) postpone, Election Day is locked so that wouldn't work
I've been an absentee voter since I turned 18. It'll always be normal for me. I'll never understand why people insist on going to the polls. Give me a computer for personal research, a TV with Netflix, a shot of Hennessey, and a Rocky Pattel. Those are my demands for anyone who wants me at the polls.

It really bugs me whenever he brings up article 2. The way he says “it means I can do whatever I want, but I never talk about that...” (even though he talks about it all the time). A declaration of martial law for this trivial reason would be an extreme threat to our democracy. I would hope that the general would say: "Mr. President, I have sworn to uphold and defend our constitution. Sir, with all respect, I refuse this order."
Then proceeds to arrest Donald J. Trump for committing treason and crimes against humanity. And for just being cruel and extremely unusual.
You don't get to the top of the military without learning how to play ball and likely having secrets of your own that the powers that can hold over you. I hope your scenario is possible. After all, the military isn't meant to say no. That would be court-martial-able. Anyone refusing orders has to be prepared to go to hell and back before likely being thrown aside with an assassinated character and replaced by someone that will.
Jeremy Kothe: Actually the military IS meant to say no to illegal orders. Obeying illegal orders will also get soldiers court martialed. Several found that out the hard way in Abu Ghraib. Martial law is unconstitutional in areas where local courts are still in session, which they still are even through Coronavirus. Even if Trump managed to stop the election, it wouldn't do him any good. It would just make the Speaker of the House (Nancy Pelosi) President on January 20, 2021.

Real America is not like Hollywood. There are not great men at the top. Quite the reverse. There is a filtering system that starts in kindergarten and works right up to the top of the hierarchy. It selects for subservience and obedience. All senior journalists, judges, politicians and generals have reached those high positions because they are subservient and obedient to power and lack independence. No general will do what you say. It requires courage and independence and what is more - what is in it for them? On the other hand the risks are huge - they could be arrested for treason themselves.

@@RestingStitchFace0 He caucuses with the democrats. It's not a strict rule that they have to be of the same party, the senators (appointed by respective governors) just have to be favoring that person (they probably still wouldn't pick him though).
Though, it doesn't matter either way because Bernie was elected in 2006, so he isn't the second *longest-serving* democratic senator, he's only the second oldest. Important distinction to make. Pat Leahy was elected back in 1974, while the second longest serving is actually Dianne Feinstein who was elected in 1992.
Ah, so it's clear: "The President SHALL hold his office during the term of four years."
And, "The term of the President SHALL end at noon on the 20th day of January."
Sort of like where the Internal Revenue Code (law) states: "Upon written request from the chairman of the Committee on Ways and Means of the House of Representatives, the chairman of the Committee on Finance of the Senate, or the chairman of the Joint Committee on Taxation, the Secretary [of the Treasury] SHALL furnish such committee with any return or return information specified in such request,....
IRS should be abolished.. But not until we see those returns XD

He's not going to cancel the election, but he's saying it should be to make it seem more illegitimate so if he loses he can try to stay in regardless. Love that bit about the electoral college. I was explaining it to my dad (he was born and raised in the UK and lived there until 1998 so he got around most of his life without really needing to understand it of course)
He seemed to be having trouble understanding it, so I asked him what part he wasn't understanding. His response was something along the lines of "There just doesn't seem to be any logic to it." 🤔 I replied, "Because there ISN'T any!"
Sure there is logic to setting it up and keeping it. It was to make sure that those selecting the president could meet him before making a selection. Each State would select an appropriate number of people, equal to their number of representatives (determined by their population) plus the number equal to their number of senators. This has an effect of giving low-population States an outsized influence in the vote - which was important to the slaveholders of the Old South which had few who could legally vote (you had to be white, a man, and a land owner at the time to vote!)
It's outlived its usefulness. Average people can listen to candidates and politicians speak (in real time) from anywhere in the world. People can see debates, as well as read about the issues and various people's stances on the matters, and decide for themselves.
I appreciated this video overall, but I would love to hear more about your thoughts on the Electoral College. I think it is still necessary in order to ensure that California and New York do not decide every election. It allows other states to have a say in the presidential elections. That being said, I hope you post a video about your stance on the Electoral College so that I can have a better understanding of your perspective. I completely agree with this statement. Without the EC California would choose every president and we can see how shinning a job they have done with their own state.
Considering he operates and lives in California, his view is not surprising. People who live in California and New York generally want to do away with the electoral college. The fact that Republicans cannot win an election without it, and Legal Eagle does quite little to hide his left leaning bias, his view is to be expected, as is the condescending way he explains it.
He’s certainly knowledgeable about law, but that doesn’t mean he grasps how national policy affects the entire population of a country. He clearly doesn’t.

d bc the 12th amendment would not allow Obama to be president again. It states that if you are not eligible for the office of President then you would not be eligible for the VP. I know they said VP but assuming they went down the line it would still apply to Obama since he has already served his max terms therefore he would not be eligible for the office of President. They would probably just pass over him to the next eligible person.

@T Mox it doesn't really matter who the electors are at this point, because they are legally bound to vote in a certain way. I'm talking more about battleground states with Republican legislatures. In the event that state legislatures are tasked with voting on behalf of their constituents, those states would award their votes to the president even though he is polling behind in all three.

I think a good topic to cover that I think will be an interesting video is religious freedom under the constitution during the pandemic.
Recently, several churches have been meeting for service in person (some following social distancing and CDC guidelines, others without following guidelines). Some governments, local and state, have used law enforcement to put and end to meetings, or force fines on the groups. There is a debate on if this is legal based on the 1st amendment, and some states are considering churches and religious gatherings exempt from guidelines. What is the legal precedent established for this kind of law enforcement and application of 1st amendment rights?
As an atheist who still has religious family this sounds like an interesting topic. And its better then linking everything to Trump. Great suggestion, take my upvote.
@@mongolifepawn842 I would have to say that there are alternative means for worship, as has already been proven by other churches very easily, and that could be swaying whether or not its a suppression of religious freedom. However I would also like to hear it from a real point of legal outlook as well.

@@Skumm93 It would be interesting to see. As you mentioned, there are other ways to conduct worship that many churches, including my own, use to great effect. On the other side, not everyone has access to the internet needed to use those methods. After all, places like Starbucks that could have provided free wifi now cannot be used for that method and going to someone else's house that has internet might not be viable either because there is no way to ensure that they have not contracted the virus. Before it was easier to just send buses to pick up those that were unable to get to church for whatever reason but providing internet for those people would be much more expensive and therefor less practical.
You can practice any religion in your own home. The health of citizens takes priority over your make believe stories. The fact that this is even being debated is a testament to how backwards and behind the times the USA really is.

Objection, precedence has established time and again that law curtailing executive authority is only as strong as its enforcement; and further that the failure to enforce said curtailments results in their erosion or dismissal.
If a president does something and no one is effective at stopping him it often becomes legal.
The question becomes whether those with lawful force who answer to the President of the United States would decide "Hmmm, it's past noon on 20th January who's the new boss? Oh, it's Mr. Leahy let me make a call. President Leahy what would like me to do to the squatter in the White House, he won't leave? Remove him. Roger that." Essentially the reason the Executive Branch can get away with violating the law is it controls the guns. If the Executive Branch decides a particular person is not its boss (rightfully so in this case) then that individual can no longer violate the law. What happens in such a scenario depends on how many law enforcement and military personnel are loyal to Donald Trump, to the Republican Party, to the Office of President as they think it's possessed (if they don't understand succession) and those who are loyal to the Office of President as it is possessed.
