Judge Simpson went too far. He answered for the prosecution, he said his personal feelings towards people involved prevented him from believing anything wrong took place and he ignored answers the defense attorney gave when asked. Judge Simpson asked how they know an email exits. The answer was an employee has a forwarded copy. Then Judge Simpson blows up and repeatedly says there is no evidence there are emails, listing off everything said, but leaving that part out about the forwarded copy. Judge Simpson is defending people he knows, showing it, saying it and even spelling it out. He should be removed from the case. The defense gave the prosecution something that has to be confirmed , but that something references the prosecutions own server data - that the prosecution can’t validate. The prosecution can’t validate their own information. So the prosecution had enough data verification to prosecute but they can’t access the data to defend the charges? And that’s okay because someone is out and the other person is dealing with the election. The burden of proof is on the prosecution and shouldn’t they have had all of this in the first place, shouldn’t they have been familiar with their own server data, before charging? I don’t think Judge Simpson realizes if the core issue is server data, everyone is taking someone else's word for it and if the first person is wrong, then this has gone too far. Judge Simpson answering for the prosecution when the defense attorney asked if it would be appropriate to find out if the prosecution looked for the emails was a HUGE overstep. This is the first time I’ve seen Judge Simpson make a mistake and he made too many in this case. This is the behavior that got him in trouble before - inserting himself personally when he feels people close to him need defending. I think what the defense is saying is that, shouldn't the prosecutor be trying to give all the evidence good or bad to the defense and not try to hide it like 90% of them do? Also, shouldn't everyone be looking for justice, the defense, law Enforcment, prosecutor instead of just a conviction for their friend so he can hold on to power. Just because the prosecution says he does not have the info doesn't mean he does not know what it is or where it is. All the prosecution has to do is say "don't say anything about any of this in my presence" and he can deny ever knowing anything about it, and they will do it in a heartbeat if it means getting that win. The prosecution is working with law enforcement to keep evidence out. Same thing they always do. The defense attorney knows how this goes because he was a federal prosecutor. He has more experience in violating people's rights than most. 'If you come to my court saying the prosecution and the sheriff are dirty and they are hiding evidence, you better be ready to defend yourself against not only both of them but me and the full power of my office as well". i know this is a confusing case ... in a nut shell.. the defense motioned the court saying the prosecution is refusing to hand over evidence that doesnt exist. the defense is claiming there are email conversations that the proseution is holding onto. basically, the defense wants judge Simpson to approve his fishing expedition and is now throwing a temper tantrum cause the judge wont give him authority to poke and proad through the prosecutors emails.
