    As a former TV repair engineer, it is impossible to detect who is watching a TV with any equipment. As the Television apparatus is a receiver not a transmitter. There are ways of detecting a single T.V. has been used, however in this modern day and age we live in most people have 2 or 3 bedrooms, with T.V's in them then 1 in the Lounge and some even have 1 in the kitchen. So that would 3, 4 or maybe 5 T.V's in a house hold. How can you detect with 100% accuracy that a T.V and which T.V was used to break the law and have proof of the program they where watching? For legal purposes in a court of law they would need to. Do not forget that you are allowed to watch catch up T.V without a T.V licence, just not allowed to watch live broadcasts.

      not "impossible" but the tech required for doing so is not something tv licensing have. If MI5 want to check on you for more serious reasons ( and have a warrant ) I assure you they CAN see if your tv or pc is on and what is on the screen. I think this is widely known now as we had this tech 20 years ago when I was an EW Engineer in the armed forces. I dread to think how much better it is now.!

      @@artful1967 Without attaching something to the TV receiver or Brute forcing a Smart TV with a virus or specially modified Malware / Spyware software. Only other way would be to use surveillance techniques used by Military Intelligence and Scotland Yard which would require special court order and warrants. Again it would not detect you where watching T.V. illegally with 100% guarantee of a conviction in a court of law in the UK.

      @@kpaxxapk6397 My main comment was about Antenna way of receiving TV, signals and that the so called TV licence detector vans are a big myth as the TV receiver only receives signals, so unable to confirm by any equipment which TV in a household is receiving the broadcasted signals through a TV aerial. The other forms of receiving TV through an ISP or Internet or satellite are straight forward common sense as you are connected to the ISP or Telecoms company servers through an account that is in your name etc... You are bang on right with the information you have stated, I should of been more specific in my answer, I do apologise, as I presumed it was obvious what I was referring to.

      ​@@kpaxxapk6397 It has always made me very suspect of any company or government that allows lies and miss information as a bases of deterrent especially with this TV detector vans. I would always recommend people get the hard facts from real electrical engineers or TV Service Engineers especially TV aerial Installers. they would confirm to you, that you need to attach a piece of equipment to the aerial to confirm the best signal being received by that TV receiver, it can not confirm you are watching the TV signal though. I do not understand legally how they get away with this? thank you ​@Samuel Snerden, I could not of explained it better myself.

      Exactly right, there has never been a prosecution brought about with evidence of detection equipment. A TV is a receiver, a receiver does not transmit.

      @@spokes1018 Back in the days of CRT TVs and analogue TV, they could feasibly detect a signal, but the vans were of course a myth
      I can't see how it's physically possible for them to detect a signal with digital signals and modern TVs no matter how much they try to claim they can

      Let the archaic Government mouthpiece the British BS Corporation go down the subscription route, if you want to watch then you pay for it otherwise let the rest of us get on with our lives without this extra restrictive tax. Notice the government could get rid of the TV licences but is not in any rush, MPs can just claim it back on expenses. Just like the Lord-inspired keep Sunday special shopping restrictions, if you do not want to shop on a Sunday fine then stay home but let the rest of us have the choice!

    Having been a police officer for 30 years (now retired) I have never attended any address with a TV licence inspector to execute a warrant and I have never heard of anyone who has.

      @@phil4893 We do, but they are not acting legally or lawfully. They aren't aware what their powers are. As I said, I have never attended a call like that and if I had it would ONLY be to prevent and Breach of the Peace. Their legal presence would have to be verified.

    Here's a simpler explanation: you only need a TV licence if you watch live TV, as it is aired. You do not need one for Netflix or Prime, providing you don't watch anything live like sports on Prime. There are no such thing as TV detector vans, that bit was misinformation which I find worrying coming from a barrister

    Haven't had a licence in over 12 years.
    In that time, I've had close to 140 letters, and at least a dozen visits.
    I'm delighted to have cost them some money.

    I don’t watch TV and cancelled my licence. How dare the TV companies charge £169 per year to watch repeats? I am 80 but I have a small private pension which precludes me from Pension Credit and now the winter fuel payment. People my age paid into the NAT in’s scheme for 40 years only to find we are being treated like a nuisance. If the government treats us badly, the younger generation will follow suit. It’s sad really

      we are treated like a nuisance! Also, if y,ou’re not on pension credit, you can no longer claim a free licence over 75. They changed the rules, previously you watch on catch up without a licence, now illegal. Also you are banned from watching TV from anywhere in the world.

    My cousin had a knock on the door by a rather rude 'inspector'. He said he had proof she watched TV as she had an ariel on the roof. She replied 'I have loads of birds on the roof but I don't have an aviary they just come and go as they please

    - "Enforcement officer" is just a Job Title - they have no statutory powers in their day-to-day work.
    - There are no TV detectors or Detector vans in routine use, and they have never been used to provide evidence for Court.
    - TVL Warrants are extremely rare (around 100 per year in England & Wales). There are none in Scotland.

      @@doru10922 I don't think they generally look through windows - it would be unlawful, and it wouldn't be practical to do at all for a significant number of properties. Camping outside the 15th Floor? I don't think so.
      TVL Warrants do not need a name. They are obtained by applying to a Magistrate (in England & Wales).

At best it is misleading and at worst it is absolutely incorrect false infomation.

      Warrants that are issued is because the householder becomes violent or difficult. So if you let someone in then abuse them, they can call the police to attend. Otherwise the police have no interest.

    I've recently stopped watching live TV. When I informed the BBC the online form states no tv even catch-up tv isn't allowed. I wondered how it would feel to give up tv in the traditional sense; relying on UA-cam films and topics of interest and Amazon films but It has been liberating! I waste a lot less time and the freedom to choose my own menu is great.

    From what I've read the average fine if it goes to court is approx the cost of the licence fee. Apparently the £1k is for people earning over £50k. Nearly all cases are people talking to much at the door or inviting them in. When someone knocks on your door asking who you are/are you the homeowner etc your response should always be who are you? Then close the door.

      Can anyone tell me what the issue is with letting them in if you genuinely don't need a licence? Surely it's easier than getting dozens of letters and threats to just say, yes come and see for yourself. Why does everyone insist on not letting them in? This genuinely confuses me.

      It was for this reason that I stopped paying for a licence over ten years ago. I was only seeing repeats. Surely that means their original "live broadcast" has already been paid for. Why am I paying for it again? TV Licence fee is nothing more than a legalised protection racket.

      I keep reading that there are 200,000 prosecutions a year for licence evasion - how do they do this when it's so difficult to prove/catch you at it? Are that many people really letting them in the door or stupidly answering questions and admitting it? Even when you do they only want you to buy a licence and use prosecution as a last resort. Are the numbers perhaps false?

    Forcing entry with a police officer present is meaningless if you are not actually using a TV at the time of their visit. You can have a 1000 sets in your house but if none are actually switched on during a forced visit then there is no offence committed.

      @@robwatts9437 I bought an aerial, it was subpar quality (think I need a roof aerial instead), so refunded it, and uninstalled all the BBC,Sky News, Now TV etc apps from the new Smart TV. Now, my 75” TV is genuinely my new PC monitor…. Just like my old 49” one was.

    Thank you - that was very clear and a comprehensive explanation. I didn’t buy a TV licence when I moved house (former licence was in someone else’s name) as I struggled to find anything to watch - miss the BBC news & current affairs programmes though but not on there own worth the annual fee.

    I rarely watch TV and I don't think BBC's got anything I want anyway.
    What irritates me is that I paid for a TV licence for years before learning I never had to, partly due to some of the stuff implied in the BBC's letters at the time.
    What now also annoys me is that the BBC wants to add a BBC button on all UK remotes. I'd find that an absolute turn off.

    Agree with all comments made regarding the detector Van.! even if such a Van existed, having TV receiving equipment DOES NOT mean you are watching "live TV" therefore you "DO NOT" need a licence unless you are watching live TV on said equipment...
    Be great if Daniel the Barrister can validate his detector van claim ?

    You do NOT need a licence to listen to ANY radio station, bbc or independant. It's also proven that there is no such thing as detection equipment.

    Daniel… Judge David Clarke in a landmark case in 2017. In this case, Judge Clarke ruled that individuals who only use the BBC iPlayer to watch on-demand content and do not watch or record live television broadcasts as they are being aired are not required to have a TV license. This ruling was significant because it clarified that the legal requirement to have a TV license in the UK is based on watching or recording live television broadcasts, rather than simply owning a television set.
    This ruling states you can watch iPlayer is the issue that the BBC should ask for a separate fee for iPlayer and we make a choice

    What about the demanding money with menaces aspect of sending red letters to people in old people's homes? Steaming live content is not illegal if it's not being broadcast - to check this you have to search the Ofcom database. The whole system is shite.

    You inconveniently forgot to mention a very important aspect of the police presence, i.e. that the police who accompany a TV Licence enforcement officer with a 'valid' warrant to enter your property, are only present to prevent a breach of the peace and not to assist with the execution of the warrant. And unsurprisingly, due to this type of widespread misinformation, the police who attend are often not aware of their lawful role in these situations either.

    I do not watch live TV. I have not watched any BBC service for 10 years. I can watch all I want on You Tube, some of it is only a week behind the TV.
    I love watching old movies and TV series too, all on You Tube.

    I'm a retireed electronics engineer - it was possible to detect the Line-output scan frequencies on older CRT TVs (they operated at approximately 10 kHz for 405-line TVs, and 16kHz for 625-line TVs); it's highly unlikely detector vans were used to actually detect this line-scanning signal - especially in places such as flats! As for modern flat-screen TVs, utterly impossible for a detector van (I'm sure they don't actually exist as working devices!), to detect whether you have a TV on your property - as others have stated, modern TVs are receivers, they don't transmit any signal which could be picked up any external device.

      If they are WiFi enabled Smart TVs then they will be detectable externally to the property, but that only shows that a TV is present, not what it is being used for. There is no law against owning a television......

    In short don’t buy a license- there are no such things as detector vans so you’re wrong there. The best way is to ring capita when you get a letter annually asking for update. My letter now is addressed to the occupier so don’t even store my name any longer...

    as a further point you do not go to prison for not having a tv licence it is not an custodial offence and no one goes to prison for not having a tv licence. If you are prosecuted for non tvl and a court issues you with a fine and you default on that fine then you could go to prison but that would be for non payment of a court fine and applies to any fine issued by a court in short you must pay any fine issued by a court

    It's not set to be abolished. Show me where that has been announced by the goverment. You mention they can use detection vans. They don't exist and have never ever been used. Do you really understand the processes involved in TV licence enforcement.

      The Royal Charter which allows the BBC to raise money expires at the end of 2027. The BBC have already been looking at proposals in preparation for the end of the licence fee.

    I've had two visits in 35 years the first ended in court and was thrown out as the goon presumed a 22" monitor was a TV set and faked the TVL 178 to say I watched live TV but I pleaded not guilty and took the monitor to the court and told them to find an aerial connection on it! The second was a goon who said he was afraid of dogs but tried to walk in uninvited and got shown the floor, even the police couldn't get me to open the door so they left saying there was nothing more they could do.
    I watch all the catch up and live TV I like and have monthly letters that I just bin unopened as I look for return addresses before anything else and DL98 letters go straight in the bin as I know it's a TVL letter.

    No license for over 10 years, don't need one. I have had a rainbow of letters from them, each time more threatening than the last! All go in the bin, Only had 1 visit that I know of as I opened my door, they guy said "I see you have a sky dish installed in your home" I said "I see you have been peeking over my 6ft fence" then proceeded to tell him the wire was cut at the other end, that he was welcome to come in and see, my 2 German shepherds were at this time barking like mad, he took 1 step over my threshold whilst I added I cannot guarantee that my male dog will stay in his crate as he hates unknown males, the guy quickly left! I never answer my door to anyone I don't know or am not expecting, peephole in door for a reason!

    Just tell them to "do one" at the door. Whether your Legally Licence free or not - it doesnt stop them harrassing you at your door. Im not legally obliged to do one of their poxy NLN Declarations either. When their "officers" (read salesman) are commision based, your hardly gonna get a fair response.

    we haven't had a licence for 4 years, got the harassing letters for about 6 months, husband emailed them again to explain we don't watch tv at all, they sent us a "green" letter saying we don't need a licence and it lasts for a few years. They sent a letter last week to ask if anything had changed, husband replied saying nothing changed and it was fine, will get another "green" letter in the next couple weeks which will again last a few years.

    I posted on another one of these type of videos: I was listening to an American radio station not long ago and an advert came on advertising some kind of Fire Stick to enable people in the USA to watch British TV, not mention they will need a licence to watch anything live, I wonder if the BBC are sending some of their guys over to knock on doors.

    The licence fee needs to be abolished. It’s got to be the most stupidest and outdated ways of funding the crappy services the BBC provides. To be honest I don’t think I even watch live tv anymore? PMQs questions are recorded? Netflix. Oh and LBC of course. 👍🏻

    The problem is these days once you have an address the big brain computer will send you a tv liscence bill.The big gray area is proving that you dont watch "live" Bbc channels.That is very difficult to pursue.Whether it be a freeview box or a cable view.Technically this cant be verified.Also you can watch anything on a device on a train or a pub etc with wifi.The BBC fee is corrupt and outdated.Its just a tax.Steve Wright on radio 2 was / is earining £400 000 a year for example.The average working guy earns less than a tenth of that at best.The BBC in my opinion no longer has a place and neither does having a liscence.Times have changed since the 70,s and 80,s where there were just 3 and then just 4 tv channels to choose from.And BBC entertainment now is terrible.Just to be even more obtuse didnt Mr Saville get paid huge ammounts back then at the BBC fee for fiddling with young kids?End of case.

      I believe it's something to do with part of the license fee funding the digital infrastructure, the transmitters etc, however it's never made clear. I'd like some channel to start transmitting over IPTV instead and to challenge this all in court.

      They can only enter your house with a search warrant. Very rare and only if you give them evidence, by talking to them, never talk to them just close your door if they come knocking.

      They can't unless you tell them, but they have been known to plug in TVs and aerials and put the TV on a live broadcast and then stitch people up
      This is why you should never let them in. I wouldn't even worry about a search warrant either because they would need evidence to get one, otherwise they would be trying to get one for every house that doesn't have a licence

      You can legally view live streams by private individuals on social media without a TV licence but not live streams by corporate companies.

      You can watch live streams on UA-cam as long as they are not from licensed broadcasters. At the moment, that's mainly Sky News live and GB News live.

    Please do a longer video stating the facts, you don't need a tv licence to watch prime video, but you do if you watch the live football or other live sport on there, you never stated that which people need to know if they're cancelling their tv licence. I'm 4 years licence free next month.

    2 things not quite correct. Firstly most fines are around 200quid, and tv vans cannot detect anything. They are simply a scare tactic.

    as far as i am.aware, tv detector vans are empty inside. they just use the list of who hasn't got a licence and knock on doors. BBB did a similar info vid on TV licensing, and one of the commenters used to drive one. First thing I did when moving 30yrs ago was take down the tv antenna on the property. haven't owned a tv in my life. I think the bbc should either go subscription model, rather than a license under false pretenses (ie it is a bbc benifit license, not a tv license, which although it applies to all live broadcasts, no broadcasters execpt for the bbc get revenue), or if it is deemed a national asset, then add it to the list of things our taxes pay for, like some countries do. Either way it is no more independant from government than the current system.

    If TV Licensing could use detectors vans, surely they would rather than keep knocking on doors when the resident is out! Equally they would drive said vans around a neighbour as a deterrent against evasion rather than send out letters.

    Daniel, it would be worth mentioning that when a person cancels a TV licence it is a good legal defence to do the following:-
    (1) Remove short TV connector cables between TV and wall sockets.
    (2) De-Tune Smart TVs of regular, live channels.
    (3) Blank off TV aerial and satellite wall sockets with cheap gang blanking plates.
    This still allows householders to legally view non-BBC, On-Demand content on a Smart TV via broadband internet but defends against any allegations of wrongdoing by TV Licensing, even in the highly unlikely event of a search warrant.

      Just because you can receive BBC signals or live TV, they can't do anything. No need cutting aerials or detuning
      A car is capable of being driven over the speed limit, it doesn't mean you have an intention to speed. The way the goons see it is if you can receive BBC1 then you must be watching it, even though this is aboslute nonsense

      Also reset your smart TV to factory settings click in English language, click on country your in example Germany, that will get rid of BBC iplayer being downloaded into your TV , I had a visit poor BBC goon couldn't work out why there was no BBC iplayer on my smart TV . Haven't had a visit for 5 years

    The is no such thing as an 'enforcement officer' they are self employed Capita agents working on commission, basically door to door salesmen with no powers under the PACE act, all you need to do if they visit is close the door on them. Simple as that. They can only bring a uniformed police officer and a warrant if you engage with them. You do not have to allow them into your property, and if you do having a TV or a recording device is not proof that you need a TV licence. All you need to say is you do not need a TV licence as you do not watch live TV or i-player.

Ok, so does that mean that i can have a TV license for my address, be legally watching iplayer on my phone at a friends house (who only uses tv for netflix and gaming so doesnt need a license).     Clearly, as a barrister, you know nothing about the way so-called 'Detector vans' used to work in the old days of CRT-TV sets (which do not exist anymore, except as museum pieces, possibly!), nor the fact that it is impossible to detect whether there is a modern flat-screenTV set being used in a property using any 'modern' TV detector van, (and I use the term sarcastically!). Even if there was a way to detect such a TV, (there isn't, except peeking through a window or open door!), it could still be being used perfectly legitimately to watch non-live transmitted broadcasts. You were giving incorrect information to your viewers in your video, and I don't believe you have corrected this false information since. Please correct me if I have wrongly accused you.

    I have move to a new place, I have been receiving letters to the " occupier" for the last months. The last one said I have until the 15th of this month to pay.
    The funny thing is that, I have a TV with a console PS4, I never never watched BBC , life TV.
    I am ignoring and putting them on the bin as I don't want to make their work easier. My question is if they come with the Police can they kick the door in, as other ways I work as a truck driver, so I am never there

    I have been licence free for more years than I can remember and never inform the BBC I do not need a Licence. I never call my Doctor and tell him I do not have the clap and therefore do not need antibiotics nor do I call or email Asda and tell them I do not need shopping from them this month so why would I call anyone of fill out a form to say I do not need their services ? Phuq the BBC.
