As a certified professional mediator,I appreciate the mediation process, because,it saves time and resources for the parties,and at the end it is hopeful to restore relationship.
So if a plaintiff has a open and shut case why mediate and be dissatisfied in any way shape form or fashion if all you have to worry about is time 🤔 the defendant pays the Bill's they caused period . The damage is life lasting why would I do the defendant any favors ?
Good opposing council can poke holes in any case no matter how good the plaintiff thinks it is. I know, I am over 3 years in and will gladly mediate to avoid another 3 years of appeals and being in terrible financial straights because of what happened to me, even though I was completely NOT at fault. You are up against insurance company and attorneys who don't care about right or wrong, just paying nothing or as little as possible. I would rather reach a settlement I can live with than be out on the street, lose my home and have my wife getting worse each day from the stress. Getting out of hell is worth some give and take, don't like it, but will settle if I can reach a certain point
Mediation or Arbitration is great.... if both sides are represented by counsel. If you're a Pro Se, I wouldn't suggest it.
