Once he found out he was wrong he removed the mis-info from his video.. But the guy still got all kinds of hate from the synth community. thats not cool. The internet is savage, not sure why you would think the synth community would be any different. Have you never been to reddit before? Try recommending that people learn some theory or bitwig instead of ableton or even recommend some paid plugins. So many people lose their minds. All of a sudden you become a shill, or you are an elitist, or someone that can't make good music because you "think" a good paid plugin might actually sound better. This community is just as tribal as any other community, and i'm not saying everyone is, but the vocal minority definitely thinks they are the majority.

I think Scott got his info from the comments of Florian’s latest Bad Gear video. The copyright strike was mentioned and it was assumed that it was about the samples. Florian then set the record straight on Patreon.
Also, they had a Mega Man and Street Fighter motion pack that they silently took off the app, and still had it advertised on their website. Apparently someone just said that they put them back after enough people complained. That’s false advertising right there. Their quality control is also atrocious.

This was without a doubt the most mean spirited takedown of a fellow synth youtuber that I have ever seen. He was wrong about the reason for the strike and has admitted that in follow up. What is your problem?

I was a professional illustrator for a long time, so I learned Intellectual Property law, and I wouldn't trust a contract like that in a million years. What did you want to buy? I owned the OP-1 and K.O. II and first one got sent back and the other one I sold. I’m a closet hipster but apparently too broke to justify their prices. The OP-1 is fun though. Just whip it out and jam a little is nice but €750 too expensive alas.
The other commenter was checking the details of the license they apply to their samples though. Was he wrong about that too? The second half of the license covering usage *seems* to imply that TE could claim your work using their samples if they felt like it. I agree with that guy on his interpretation.
No that interpretation is not correct. That clause is specifically to stop people reselling the samples unedited. You're completely free to use the samples in your own compositions, even if the composition consists only of their sounds. What you don't own is the rights of the samples. They are not yours. You have a license to use them, not a claim of ownership
@ That may be the intention, but that isn’t the way the second half of the license, the usage section you can see in the video, is worded. It is slippery legalese which could in theory allow TE some kind of hold over work created using their samples. I reckon a lawyer, a courtroom, would be the only way to settle this. Or maybe, just don’t buy their gear. I know which is easier, and cheaper. Besides, Florian rocks, and trying to copystrike him off UA-cam is shitty any way you slice it.
@@svetlovskathere's nothing slippery about it. "Substantially transformed" and "Original Creation". Meaning you can't just chuck a high pass on it and upload/sell the samples/patterns/etc. This is a very common clause in sample packs and has been proven time and time again to not be nefarious. This isn't some masterplan for TE to claim your work, it's to prevent people profiteering from their own. The copyright strike will be an accident and cleared up soon, I'm sure of it, these automated takedowns happen all the time. Use the samples to make music, not to resell as your own sample packs and there will be no legal grounds to go after you

Yeah, AudioPils did a review of the instrument. The part of his video that got cited was just the first 1:05. The rest was what I would call his normal review and demo. Any company that wants to market their products to creatives, ie. musicians, must establish trust - that they have a sense of humor. If they take such offense to the short parody and call a strike on Florian, then will musicians trust them in the future? Now the points called out by ScottsSynthStuff become really pertinent! If TE has a group of legal hounds going around calling strikes on someone for what really seems to be a gray area, then how do I know if they'll attack me for use of their sounds? If their grant of license is actually more restrictive, and if they're more concerned with being offended than being creative, then all musicians should be very wary!
I didnt hear from TE until fall 2024, when I started getting interested in hardware synths. Overpriced devices like an OP-xy and an recycled Alu Desk for 1600 😳? The most products are ugly af to me and they strike youtubers because of their samples, or using em in a review ? Wow. What a weird company.

B&H Photo Video Pro Audio also did a Monte Python-esque parody about TE Medieval and it didn't get taken down. So TE probably didn't go after Audio Pilz specifically because they didn't like the parody or recognise it as such. They still look bad for getting the video taken down. Scott's Synth Stuff also earns a bad mark for misinformation in service of outrage/ engagement farming. Only one coming out smelling of roses is Audio Pilz for creating the parody and posting his clarification/correction comment debunking Scott.
A slippy point in this is that those legal agreements are only binding if you agreed to them, which you do buy purchasing the unit new. But if you borrow one, or acquire one second hand, or steal one or find one one laying around, you never agreed to said license and it would be impossible to litigate. Sure, you could go to trial, but if the person had the $$ to lawyer up it would fall apart right away, since it wasn't even actually an agreement. Best they could do is prove chain of ownership and go after the original party that agreed to the license. These are legal agreements, universally applied laws to all humans who exist. It would be like selling a car and making the first purchaser agree that "this car will never be driven on 31st street in Boston". Impossible.
i personally disagree about "hipster" or "status" thingies, as I was lusting op-1 since the reveal many years ago as I just thought it's pretty damn awesome. However, back in days I chose to purchase a different gear instead, and nowodays when I remember about TE stuff, I still consider op-1/op-z pretty good for what they do, however pricing is atrocious expecially when you consider all the drama and screw ups about the company itself, so yeah... I still dont have anything by TE (though I almost got PO-32 at some point lol), and I doubt I ever will... but still... I don't agree idea that their gear is not good or just for bloggers or something, maybe because I grew up in days when you didn't have anything comparable except monomachine or spectralis, idk. But I still don't believe there is a true replacement for either. I don't care for their new stuff like that sampler though (as I'm happy with my roland sp404 haha).
You state that "Scott's Synth Stuff" is "completely made up" or "wrong", but then you state "I have not heard this part yet"....not exactly the ideal of fair reporting. I had seen Scott's video before this vid. He is not breaking down the Bad Gear situation, as much as giving us a breakdown of what is a "sample" in use and how its usage is viewed legally. He spends a lot of the video, breaking down how a sample can be a section of a song (MIA's "Paper Planes" or Vanilla Ice's "Ice Ice Baby") vs a single note of a multisampled instrument (G3 at velocity 119 on a piano library off of the Montage). The discussion is more about how presets, demo songs/sequences and included samples on any given device are (or should be) assumed as "free to use" and NOT copywriten material. Where Scott brings it back to Bad Gear, is when he breaks down "fair use" in regards to a review. Watch Scott's video again and keep the "sample definition" and "sample usage" in mind. As far as Teenage Engineering VS Bad Gear and Scott's reporting on that situation....who knows. Their lawyers.
if this whole copyright thing has become such a big element in play here on youtube, then youtube should be more open about their policies. Sometimes it looks like they favour some channels and others get copyright claims. In the interface of youtube there should be a big button "legal issues helpdesk". I dont have an active channel here on youtube, but how do you go about if you've got a copyright claim and you want contact with youtube about it? Is it easy to get in contact with youtube "helpdesk" employees or is it still shady as it was? Is their copyright search system still doing weird things? But then again, with the monetization options here, people are bound to get some problems with it. Hm if you think about it, youtube is moderating itself. Teenage engineering is very good in making original (but overpriced) stuff. I think if behringer were to make an op-1 clone, they immediately would get all kinds of lawsuits from teenage engineering against them. Partly logical, but TE is really good in protecting their unique pieces of equipment they sell, and also for the same prices. They do not want anyone making something like that for a cheaper price. But how good their new OP-XY is, and i do think its really good and has lots of dope features (actually the op-1 field should have been the op-xy). But at 2300 euros, man thats just a ridiculous price. I would like to have one, but not at that price point. When the op-1 first came out it was priced at 899 euro i think. Thats already a steep price, but still reasonable. Now that same op-1 costs 1400euros, why? And if you want to spend big monies, you better get an op-xy, because for 300 more you get a lot of more tracks to work with. The op-1 field is 2000, and has 4 tracks, just like the original. They shouldve expanded it. 32bit float is really great, but i'd rather had more tracks and like a 24bit internal workflow. It is what it is, i would love to have an op-xy, but not for that price. I just saw on reddit, that with its introduction in 2011, the op-1 was 799. I dont even name the op-z, how can one work on that thing without a tablet or something?

Bad Gear, the show, doesn't even exist to shit on gear. It's there to show that even much maligned gear can be useful and every piece of gear has it's own quirks in a light-hearted way while also showing memes. That first video is for sure sensationalizing, and I am on board with this being some sort of ContentID bs. However, while content claims can be fully automated, to actually strike a channel is a manual process. It is certainly possible TE didn't like his review and due to ContentID lining up like this they chose to pursue striking Florian's channel. As a creator, I would certainly be careful using their materials in the future, even if it's just watching a trailer on stream.
Man, I wanted to watch this. HOWEVER the rough video edits/cuts, & random zoom ins & outs, make it hard to continue watching. Suggest investing some time into video editing tutorials...& better vid-editing software.

So now I'm curious, who does what? When youtube issues such a strike, will TE have a say about it? Who takes the initiative, is confirmation required etc? I've seen video on copyright strikes before, mainly by original content makers that saw their product claimed by other. This self-regulation by a commercial hype-based business to me seems (inherently) not to have the most well organized (and by that fair) procedures.
youtube basically stays out of it for the most part. audiopilz has the option to contest it, but then teenage engineering has the ability to take him to court over it. i personally think it was probably incompetence and it woudn't get taken that far.
What I find very likely that no one talked about us monty python isnt in the public domain. He spliced the TE add with monty python. Movie studios are notorious about copyright striking. I can't find anything that says who actually flagged it

Pitch of salt with this, I’m no lawyer, but few thoughts.. 1) bad gear is in the format of a review, but it’s not a journalistic review or claiming so. It’s satire (fair use). …2) If you’ve got an instrument that’s entirely sample based, well, you don’t want the samples redistributed? Think kontakt. Fair, but people have to use it in order for it to work as advertised…. And EULA is weaker and consumer rights are stronger in the eurozone than America, generally speaking… call me out if I’m missing something.

If Scott got it wrong he apologised and explained his mistake. But it is sure not okay to threaten him, neither online nor and especially in private, and that happening in this scene is highly disturbing to me. Especially about such a sill product, in essence a pocket calculator making medieval sounds. Not worth all the bad vibes and it's in no way a beneficial move by TE to strike anyone. Why can't everyone just make awesome music on great synths an be nice to each other. It costs nothing and gains so much.
Then they say that Behringer has no ethics, but they are really a gang of hitmen. I find it hard to believe that Teenage Engineering has no bad intentions, for me they are already dead, I have a second-hand OP-1, and that was when I still had no reason to go against them. But now I am clear that I will never buy any of their new material in a store, I will make sure that they do not take a single coin from me, buying from individuals. I will no longer take them as something interesting.

I can't get excited by TE products, perhaps it's me? If you want a proper copyright strike investigate Mend It Mark vs Tom Evans Audio. The price of the amp makes the TE paste table look like a bargain.
"You are prohbitied from ... publicly displaying the material in its original ... form". To me, that explicitly says you can't create a video (or even live demonstration!) which demos their product by walking through sounds, presets, patterns, etc. Whereas "your own original creation"... which I take to mean a music product... is OK. In my experience with sample-based products like hardware workstations and (of course) sample libraries, the license prohibits derivative products... i.e., you can't create a VST or sample library using the dumped or sampled waveforms of, say, a Roland D-50. In fact, somebody got in trouble for that a few years back. Anyway... maybe TE didn't intend that interpretation... but the wording is very broad.
legal wording is almost always very broad. i'd bet if someone uplaoded a video going thru the sounds as part of a review it would not get struck down. (unless they went around copyright claiming everyone else using the same sounds)
Cooyright statute/fair use overrides anything someone tries to unilaterally force upon you via their user manual, etc, especially without prior notice …
This is textbook fair use. TE is literally the worst, and they messed up here. They already have a history of being crybabies when their users (understandably) criticize their overpriced toys.
I’m not a TE fan. But Roland also has some copy right disclaimer about factory sounds and pattern. I think this is a downside of factory sounds which has been submitted by users and artists.

While I admit posting a comment following what Scott says in his video in the proverbial “heat of the moment”, without watching the original video that was not available any more at that time… I stand by the content of that comment. And, sincerely, Weaver, legal terms and wording are never “funny”, these terms are absolutely binding and may be used in court, including their ambiguous and unclear definition of “substantial”. Point is, they could have simply used, as Scott mentions, the same ToS of all the other Synth manufacturers and decided not to. I have nothing against TE, I am really just disgusted with their EULA - I am not a lawyer, so my opinion may be flawed, Ill be glad to publicly apologize if this is the case.

I think Scott got his info from the comments of Florian’s latest Bad Gear video. The copyright strike was mentioned and it was assumed that it was about the samples. Florian then set the record straight on Patreon.

I love that scott went hard and fast on this, because I sure as fuck would not read those pos terms out of my own volition, and now that people are talking about TEs terms ans conditions in public, TE is shitting their pants and attacking those in the talk with vitriol and defamatory insults. So I find it weird that weaver offers this kind understanding towards TE in this situation, while scotts actions are treated as completely unreasonable and hostile, which they obviously aren't for anyone that is actually paying attention.

The other commenter was checking the details of the license they apply to their samples though. Was he wrong about that too? The second half of the license covering usage *seems* to imply that TE could claim your work using their samples if they felt like it. I agree with that guy on his interpretation.
No that interpretation is not correct. That clause is specifically to stop people reselling the samples unedited. You're completely free to use the samples in your own compositions, even if the composition consists only of their sounds. What you don't own is the rights of the samples. They are not yours. You have a license to use them, not a claim of ownership
@ That may be the intention, but that isn’t the way the second half of the license, the usage section you can see in the video, is worded. It is slippery legalese which could in theory allow TE some kind of hold over work created using their samples. I reckon a lawyer, a courtroom, would be the only way to settle this. Or maybe, just don’t buy their gear. I know which is easier, and cheaper. Besides, Florian rocks, and trying to copystrike him off UA-cam is shitty any way you slice it.
@@svetlovskathere's nothing slippery about it. "Substantially transformed" and "Original Creation". Meaning you can't just chuck a high pass on it and upload/sell the samples/patterns/etc. This is a very common clause in sample packs and has been proven time and time again to not be nefarious.
This isn't some masterplan for TE to claim your work, it's to prevent people profiteering from their own. The copyright strike will be an accident and cleared up soon, I'm sure of it, these automated takedowns happen all the time.
Use the samples to make music, not to resell as your own sample packs and there will be no legal grounds to go after you

Any company that wants to market their products to creatives, ie. musicians, must establish trust - that they have a sense of humor. If they take such offense to the short parody and call a strike on Florian, then will musicians trust them in the future?
Now the points called out by ScottsSynthStuff become really pertinent! If TE has a group of legal hounds going around calling strikes on someone for what really seems to be a gray area, then how do I know if they'll attack me for use of their sounds?
If their grant of license is actually more restrictive, and if they're more concerned with being offended than being creative, then all musicians should be very wary!

B&H Photo Video Pro Audio also did a Monte Python-esque parody about TE Medieval and it didn't get taken down. So TE probably didn't go after Audio Pilz specifically because they didn't like the parody or recognise it as such. They still look bad for getting the video taken down. Scott's Synth Stuff also earns a bad mark for misinformation in service of outrage/ engagement farming. Only one coming out smelling of roses is Audio Pilz for creating the parody and posting his clarification/correction comment debunking Scott.
Scott probably didn't see the original video, if it has been taken down then how can you? he just assumed it was a normal Bad Gear episode.

A slippy point in this is that those legal agreements are only binding if you agreed to them, which you do buy purchasing the unit new. But if you borrow one, or acquire one second hand, or steal one or find one one laying around, you never agreed to said license and it would be impossible to litigate. Sure, you could go to trial, but if the person had the $$ to lawyer up it would fall apart right away, since it wasn't even actually an agreement. Best they could do is prove chain of ownership and go after the original party that agreed to the license. These are legal agreements, universally applied laws to all humans who exist. It would be like selling a car and making the first purchaser agree that "this car will never be driven on 31st street in Boston". Impossible.

i personally disagree about "hipster" or "status" thingies, as I was lusting op-1 since the reveal many years ago as I just thought it's pretty damn awesome. However, back in days I chose to purchase a different gear instead, and nowodays when I remember about TE stuff, I still consider op-1/op-z pretty good for what they do, however pricing is atrocious expecially when you consider all the drama and screw ups about the company itself, so yeah... I still dont have anything by TE (though I almost got PO-32 at some point lol), and I doubt I ever will... but still... I don't agree idea that their gear is not good or just for bloggers or something, maybe because I grew up in days when you didn't have anything comparable except monomachine or spectralis, idk. But I still don't believe there is a true replacement for either. I don't care for their new stuff like that sampler though (as I'm happy with my roland sp404 haha).

You state that "Scott's Synth Stuff" is "completely made up" or "wrong", but then you state "I have not heard this part yet"....not exactly the ideal of fair reporting. I had seen Scott's video before this vid. He is not breaking down the Bad Gear situation, as much as giving us a breakdown of what is a "sample" in use and how its usage is viewed legally. He spends a lot of the video, breaking down how a sample can be a section of a song (MIA's "Paper Planes" or Vanilla Ice's "Ice Ice Baby") vs a single note of a multisampled instrument (G3 at velocity 119 on a piano library off of the Montage).
The discussion is more about how presets, demo songs/sequences and included samples on any given device are (or should be) assumed as "free to use" and NOT copywriten material.
Where Scott brings it back to Bad Gear, is when he breaks down "fair use" in regards to a review. Watch Scott's video again and keep the "sample definition" and "sample usage" in mind.
As far as Teenage Engineering VS Bad Gear and Scott's reporting on that situation....who knows. Their lawyers.

if this whole copyright thing has become such a big element in play here on youtube, then youtube should be more open about their policies. Sometimes it looks like they favour some channels and others get copyright claims. In the interface of youtube there should be a big button "legal issues helpdesk". I dont have an active channel here on youtube, but how do you go about if you've got a copyright claim and you want contact with youtube about it? Is it easy to get in contact with youtube "helpdesk" employees or is it still shady as it was? Is their copyright search system still doing weird things? But then again, with the monetization options here, people are bound to get some problems with it. Hm if you think about it, youtube is moderating itself. Teenage engineering is very good in making original (but overpriced) stuff. I think if behringer were to make an op-1 clone, they immediately would get all kinds of lawsuits from teenage engineering against them. Partly logical, but TE is really good in protecting their unique pieces of equipment they sell, and also for the same prices. They do not want anyone making something like that for a cheaper price. But how good their new OP-XY is, and i do think its really good and has lots of dope features (actually the op-1 field should have been the op-xy). But at 2300 euros, man thats just a ridiculous price. I would like to have one, but not at that price point. When the op-1 first came out it was priced at 899 euro i think. Thats already a steep price, but still reasonable. Now that same op-1 costs 1400euros, why? And if you want to spend big monies, you better get an op-xy, because for 300 more you get a lot of more tracks to work with. The op-1 field is 2000, and has 4 tracks, just like the original. They shouldve expanded it. 32bit float is really great, but i'd rather had more tracks and like a 24bit internal workflow. It is what it is, i would love to have an op-xy, but not for that price. I just saw on reddit, that with its introduction in 2011, the op-1 was 799. I dont even name the op-z, how can one work on that thing without a tablet or something?

Bad Gear, the show, doesn't even exist to shit on gear. It's there to show that even much maligned gear can be useful and every piece of gear has it's own quirks in a light-hearted way while also showing memes. That first video is for sure sensationalizing, and I am on board with this being some sort of ContentID bs. However, while content claims can be fully automated, to actually strike a channel is a manual process. It is certainly possible TE didn't like his review and due to ContentID lining up like this they chose to pursue striking Florian's channel. As a creator, I would certainly be careful using their materials in the future, even if it's just watching a trailer on stream.

So now I'm curious, who does what? When youtube issues such a strike, will TE have a say about it? Who takes the initiative, is confirmation required etc? I've seen video on copyright strikes before, mainly by original content makers that saw their product claimed by other. This self-regulation by a commercial hype-based business to me seems (inherently) not to have the most well organized (and by that fair) procedures.
youtube basically stays out of it for the most part. audiopilz has the option to contest it, but then teenage engineering has the ability to take him to court over it. i personally think it was probably incompetence and it woudn't get taken that far.
What I find very likely that no one talked about us monty python isnt in the public domain. He spliced the TE add with monty python. Movie studios are notorious about copyright striking. I can't find anything that says who actually flagged it

Pitch of salt with this, I’m no lawyer, but few thoughts.. 1) bad gear is in the format of a review, but it’s not a journalistic review or claiming so. It’s satire (fair use). …2) If you’ve got an instrument that’s entirely sample based, well, you don’t want the samples redistributed? Think kontakt. Fair, but people have to use it in order for it to work as advertised…. And EULA is weaker and consumer rights are stronger in the eurozone than America, generally speaking… call me out if I’m missing something.

If Scott got it wrong he apologised and explained his mistake. But it is sure not okay to threaten him, neither online nor and especially in private, and that happening in this scene is highly disturbing to me. Especially about such a sill product, in essence a pocket calculator making medieval sounds. Not worth all the bad vibes and it's in no way a beneficial move by TE to strike anyone. Why can't everyone just make awesome music on great synths an be nice to each other. It costs nothing and gains so much.

It's all a bit handbags at 10 paces. TE are not going to ingratiate themselves with this sort of behaviour with Florian, it's their 'cork sniffer' moment. I'm not sure why Scotty felt compelled to speak about TE. He's done much more interesting videos in the past. Now he's quitting (possibly), and they've beamed him up. Bit of a shame really. I can't get excited by TE products, perhaps it's me? If you want a proper copyright strike investigate Mend It Mark vs Tom Evans Audio. The price of the amp makes the TE paste table look like a bargain.
"You are prohbitied from ... publicly displaying the material in its original ... form". To me, that explicitly says you can't create a video (or even live demonstration!) which demos their product by walking through sounds, presets, patterns, etc. Whereas "your own original creation"... which I take to mean a music product... is OK. In my experience with sample-based products like hardware workstations and (of course) sample libraries, the license prohibits derivative products... i.e., you can't create a VST or sample library using the dumped or sampled waveforms of, say, a Roland D-50. In fact, somebody got in trouble for that a few years back. Anyway... maybe TE didn't intend that interpretation... but the wording is very broad.
Of course, the license discussion is totally ironical to begin with...
legal wording is almost always very broad. i'd bet if someone uplaoded a video going thru the sounds as part of a review it would not get struck down. (unless they went around copyright claiming everyone else using the same sounds)
Cooyright statute/fair use overrides anything someone tries to unilaterally force upon you via their user manual, etc, especially without prior notice …

I’m not a TE fan. But Roland also has some copy right disclaimer about factory sounds and pattern. I think this is a downside of factory sounds which has been submitted by users and artists.

"Fair use" is a concept exclusive to US copyright law. There's no such concept in EU/Swedish/Austrian law.

And, sincerely, Weaver, legal terms and wording are never “funny”, these terms are absolutely binding and may be used in court, including their ambiguous and unclear definition of “substantial”. Point is, they could have simply used, as Scott mentions, the same ToS of all the other Synth manufacturers and decided not to. I have nothing against TE, I am really just disgusted with their EULA - I am not a lawyer, so my opinion may be flawed, Ill be glad to publicly apologize if this is the case.
