Very interesting topic sir. My question is sugar land covered with the 5has rule? Our father's family in 1900 owned track of land used for sugar. The grandparents died & the administering of the land was alternately done by first 4siblings of our father..in approx 1960s He requested the CFI court that his share be given to him as he has a growing family - it was denied..they are now all dead but approx 9has share of our dad was never given.. Q: can we still contest it & get his share? Salamat,
this is a case of succession. if a person dies, the estate goes to his heirs, and when the heirs die, it will be passed on again and so on. the rule is that no one can be forced to continue to be in co-ownership with the other heirs, and therefore, judicial partiion is the remedy in case extrajudicial partition cannot be had

Hello sir,,ask ko lang po,kc po nagloan po ang tito ko sa bangko,tapos po pinabayaran niya ito sa isang tao kapalit ang lupa,may pinapirma po ang tito ko sa mga lola ko,,so ngaun po yung tao po na nagbayad ng kanyang loan sa bangko binenta naman po niya ung lupa sa ibang tao,,pero ung lupa po hndi pa po nakaregstr sa DAR,,ngaun po kami ay pinapaalis na po sa lupa namin,,may habol po ba kami dito sir,,sana po masagot sir,mga 1970's or 80's po cguro nangyari,,salamat po

So Attorney wala po bang limit ang fishpond na pwedeng maging pag-aari ng isang Filipino?
Hindi na kailangan ang DAR Clearance sa Fishponds irregardless of hectarage. What you are going to do is file an exemption invoking RA 7881
