The half-hearted singing "New York" made me laugh more than it should have
As someone who grew up going to church, those three girls strike me as people who didn't want anything to do with the church production but their parents threatened to ground them.

@@guilhermecastro9893nah it’s probably because Hamilton is still super successfully running on broadway/touring. It’s normal for them to not start licensing competition in the market when the original official performances are still so lucrative, whether Disney is or isn’t involved.

The thing is, they never claimed it was parody. The church, or at least the head pastor, claimed that the hamilton cast allowed them to do it. Then they filmed it, distributed it, and they in charged people money to see it. So they exploited the popularity of the most famous musicals to come out in the past decade in order to promote their own social agenda and honestly thought they would get away with it.
About the first bit on them never claiming it was a parody. Having to state something is a parody kinda ruins the point of it being a parody. It should be self evident, like how you don't have to say, "Guys I am about to make a joke!" Before making a joke.
There's was a recent legal case where someone made a parody Facebook account of their local police to make fun of them for their awful behavior. The police department sued, and it was brought all the way to the Supreme Court. The Onion (yes that parody site) sent a letter (an amicus brief) to SCOTUS on their opinion and said just that: parody and satire shouldn't require you to have to state that it is parody or satire. (I think Legal Eagle covered it -- and their amicus brief was filled with jokes to hammer the point home.

I feel like when Lin Manuel Miranda said it wasn't okay to change the notes, he wasn't talkimg about their creative liberties. He was just insulting them for being off key for the entire performance.

It also implies that he agrees with/endorses their message as well. The church who put on the show presented it as Hamilton with no implications of it having been changed, and they also explicitly lied and said that they did get permission to put on the play. I'm very confident in saying that it wasn't meant to be a parody, it's just blatant propaganda under the guise of a play that they didn't have permission to put on.

This exactly. It’s one thing to change lyrics and make your own version, it’s another to claim it to be something it isn’t and don’t have the rights to. If I made a bunch of smiley face sponges out of cheap foam and called them Scrub Daddys it would be the same thing as they’re doing: copyright infringement.

Technically they’re not supposed to be brought into and sold in the US, but often it’s small independent shops that are selling ones that are so blatantly not official and at such rock bottom prices that the companies don’t bother to track down and sue them because there’s no point and it wouldn’t stop the source anyway. Plus they often change the name. It’s one thing to make a ripoff Chanel bag and try to sell it as the real deal for a comparable price, it’s another to make a “Panama Canal” bag and sell it for $5. Both are technically illegal, but one is more illegal and will have lawyers after you.
@@BryanM86 nah in the theatre world, even when you do get a license to put on a show by the licensing company, most of them explicitly put into contracts that they cannot change certain or any aspects of the show, or record/stream it in any capacity. via licensing companies, every single show, from elementary schools to broadway, is at danger of being sued if it is revealed they breached contract. not only are you actively homophobic, you have no clue what you’re talking about.

The problem with this argument is that they never claimed it was a parody. I have seen videos of this performance where before the show starts the minister THANKS LMM and the Broadway team for “allowing” them to perform this show. If people didn’t know much about Hamilton this message might make them think that these are the messages the show conveys.
So also potentially defamation or false representation?
And even if they had claimed it was a parody, making that claim doesn't make it true.
It might fall under fair use if it was a criticism of the original. I’d really want to read the play (both plays, actually) before jumping to a conclusion either way.
There used to be a famous bookstore called Samuel French that published and sold playbooks. Inside the booklet, in addition to the play, was the terms and royalties for performing it.
If you have a theater group in your town and they put on plays that aren’t original, it’s highly likely that they are paying a royalty for each performance.
The copyright holder can choose not to permit anyone from performing their play.
Regardless of whether this Christian performance was fair use or not, the possibility is high that they’re going to get sued.

I know he married into the Schuyler family and did help in financial transactions involving slavery, but do we know if he himself own any slaves? Information about that is pretty conflicting.
He also led the New York Manumission Society and helped pass laws in New York that would lead to abolishing slavery there.
When talking about slavery he definitely isn’t as innocent as the musical and people make him out to be. However, I wouldn’t say he fought to keep slavery active, but I do believe he willing made compromises on the issue to achieve certain goals.

I'm no lawyer, but the general rule-of-thumb for fair use is if it works as a replacement. Big Hairy Woman and Pretty woman are VERY different narratives. This production is just Hamilton but shittier and with more homophobia.

If somebody could walk away satisfied that they "saw Hamilton" after watching this, then yup, they done broke the law. In actual cases of parody, the new work is not intended to substitute the original, but just riff off it. Any reasonable person would say "oh gee, I better go pay to consume the original work if I want to get the real scoop."

What people generally forget is that parody requires you to comment ON THE WORK, not just on anything. The way I typically explain it, Smells Like Nirvana is parody. Like a Surgeon is not. That's why Weird Al always gets permissions.
Fortunately, you can always watch Sarah Z's review of this church's play. THAT is fair use.
A parody may simply be for comedic effect according to definition so commentary on the original work is unnecessary. Also, Weird Al doesn't always get permission and Amish Paradise is a famous example, as he was explicitly denied permission yet did it anyway without legal consequence. Like a Surgeon is a parody because the imitation is for comedic effect, as is the case with most of his parodies.
Weird al did get permission from the record company for Amish paradise but didnt ask coolio.
Coolio was mad for awhile, but I read that he and Al eventually made peace.

Yeah as a Theater kid, ive had teachers quietly remove jokes (ie. Musical comedy murders of 1940 has a racist Japanese taxi drive joke that we cut) I feel like sometimes it is ok to remove line (though few and far between) so long as it doesn't change or add messages to the play.

I totally agree. But don’t pretend that “real theatre communities”(assuming off Broadway, Broadway etc) haven’t had plagiarizing, stealing and just all around down-low behavior in the past. I can think of a story off the top of my head where “And The Ice Man Cometh” had intellectual property issues. Literature, music, they all have bad apples.

He'd probably have the same reaction to the actual musical as well, according to more recent research, Hamilton very likely owned slaves and it was well known before that Hercules Mulligan did as well. The musical is actually fairly dishonest in spinning the group in Hamilton as abolitionists, whilst some were part of an abolitionist society, the societies did very little and only campaigned on ending slavery regionally, mostly for business and financial reasons, and cared little for the actual wellbeing of the slaves, since notably a lot of the members were still slave owners.

My hs did "The Diary of Anne Frank" when I was there. It included monologs of actual passages from Anne's diary. That is obviously amazing, powerful, and the whole point of the play. However, I grew up in a pretty small town. There is a passage where Anne talks about having homosexual feelings, and my teacher(fearing backlash from the community) put in an official request to remove the passage from our rendition. This request was denied(as it should have been), and it ended up being one of the best shows the department had done. It was a powerful show, and opened a lot of doors to expand the shows the school puts on. Plays, musicals, one acts, etc. are made how they are for a reason. They are also art, and(especially in theatre) you cannot tweak the work of an artist without permission. It is considered incredibly disrespectful, and, as you said, illegal. It's a BIG no no
Our high school almost did The Laramie Project, which is a play expressly about the rejection of homosexuality which leads to a tragic suicide of a student.
The show was casted, rehearsed and had sets built before a large group of facility and parents got the play shut down and the drama teacher got canned. The drama club was able to switch heels to a student directed modern rendition of midsummer's night dream, and reused all the costumes and sets from the other play. They did that in 2 weeks before opening night, in a high school.
Fortunately, there wasn't a tragic reaction to the play getting pulled, and the drama teacher was warned before hand to not put on the play and he thought he could get away with it if he kept it secret, but the drama club had a huge chip on their shoulder with the facility after that, to the point where facility could no longer get free admission to plays like they used to.

If it’s similar to my church experiences, it’s probably because half the kids there didn’t want to take part and they were forced by an older sibling who’s way too into youth group or by their parents who threatened to ground them if they didn’t participate.
Also, they probably didn’t hold auditions and just assigned people parts at random and swapped around the casting a few times for strange reasons two weeks before the show.
Church people
All the theater people in the church are techies and designers, and the actors are the kids who are in the Sunday School Christmas musical every year, cast by age over ability.
