  • Pano Patitulohan ang resedential Lot.
    Republic Act 10023 : An act authorizing the issuance of free patent for residential lands.
    Qualifications. - Any Filipino citizen who is an actual occupant of a residential land may apply for a Free Patent Title under this Act: Provided; That in highly urbanized cities, the land should not exceed two hundred (200) square meters; in other cities, it should not exceed five hundred (500) square meters; in first class and second class municipalities, it should not exceed seven hundred fifty (750) square meters; and in all other municipalities, it should not exceed one thousand (1,000) square meters; Provided, further, That the land applied for is not needed for public service and/or public use.
    Application. - The application on the land applied for shall be supported by a map based on an actual survey conducted by a licensed geodetic engineer and approved by the Department of Environment and Natural Resources (DENR) and a technical description of the land applied for together with supporting affidavit of two (2) disinterested persons who are residing in the barangay of the city or municipality where the land is located, attesting to the truth of the facts contained in the application to the effect that the applicant thereof has, either by himself or through his predecessor-in-interest, actually resided on and continuously possessed and occupied, under a bona fide claim of acquisition of ownership, the land applied for at least ten (10) years.
    Requirements for Department of Environmental and natural Resources
    1. Letter Request
    2. Any document Showing Identity of the Land. ( Ex: Lot No, Survey card, Tax Declaration, deed of Sale, Etc )
    3. Certified True Copy of Approved Survey Plan, technical description or Cadastral map
    4. Tax Declaration, Proof of payment of Taxes
    5. Certification from the Barangay that he/she is a residential in the area.
    Duly accomplished Free Patent Application and prescribed forms, with the following attached documents:
    1. Proof of Claims/Ownership of the Land
    2. Certified True Copy of Approved Survey Plan or Cadastral Map
    3.Copy of technical description
    4. Affidavit of two (2) disinterested persons residing in the barangay of the city or municipality where the land is located attesting that the applicant thereof has either by himself or through his predecessors-in interest, actually resided on and continuously possessed and occupied under a bonafide claim of acquisition of ownership, the subject land for at least ten (10) years
    5. Certification from LGU that the area applied for is zoned as Residential
    6. Certification from CENRO that the land is A and D
    7. Affidavit stating that the land is the only land applied for by the applicant.
    8. Government issued ID of applicant and representative (Postal, Voter’s, GSIS, LTO, PhilHealth, Senior Citizen’s, SSS, etc.)
    9. Latest photograph of land and house (preferably geo-tagged)
    10.Latest photograph of the applicant and representative
    NOTE:
    1. Approving Official: PENRO
    2. Maximum Area Allowed (See IRR of R.A. 10023):
    - 250 sq. m.
    - 500 sq. m.
    - 750 sq. m.
    - 1000 sq. m.
    3. Time Frame for the processing and approval of Residential Free Patent is 120 working days.

    Our lot is in a highly urbanized city and to qualify for free patent it has to be 200 sqm or less kava lang po 255 sqm. po lupa namin per survey at hindi po approved ng DENR sa free patent. Paano po ipa title? Meron po kaming deed of sale at tax declaration. Maraming salamat Sir.

    Good day po. Hope you are doing well. May itatanong po sana ako. May bibilin po ako na property na may kashare ako sa bilihan. Bali magiging business partner po kami. Pero since nasa abroad sya kelangan nya po mgprovide ng SPA para po sa pirmahan ng deed of sale. Pwede po ba ako na din ang gawin nya na authorized sa SpA kahit po ako ang ka business partner nya?
