Too many people running around with machine guns
I know 3 guys personally who have no idea any of this is going on, and they own AR pistols. With 2 of them, it's the only AR they own. And the other one just doesn't use social media or watch gun content on UA-cam. Gun stores don't tell you that you're buying a "pistol". My first AR was an AR pistol and I had no idea until I started watching UA-cam videos 5 or 6 years ago. The overwhelming majority of pistol brace owners have no idea. They assume they just bought an AR15. That's a dangerous situation

There's no way to know that the majority of pistol brace owners are clueless. Myself and everyone I know are members of the gun community and own many AR pistols. Those that are not as informed are more likely to own 1 or 2 at most. I would find that very ironic if there were more soccer moms that owned 1 gun outnumbered the gun community but if that is the case its your responsibility to inform your 3 friends so they are aware of the new ruling. Being unaware of the speed limit doesn't exempt you from adhering to it.
@@realtyrocks1969 to use your analogy, everyone is aware of the speed limit. Just not very many are aware that theres a handful of patrol cops who have decided by themselves that the speed limit isnt what the sign says. But regardless of what those cops say, their word is not law and we should all continue doing the speed limit.

I get a notice when my car has a recall, I get a letter if there's any changes in zoning in my area.

According to the Forgotten Weapns channel the NFA originally included handguns because of how consealable they are. Then they thought someone could shorten a riffle to conseal it. So they had to include SBR's to plug the loophole. Then they had to remove hand guns to pass it but left the SBR's

I got a friend who's an RSO at a range and they say people come in quite often with SBRs and have no idea what SBR means because they simply wanted a shorter gun.
@DucknCoverin they change rules every 2 minutes and try to use the "ignorance of the law is no excuse to break the law!" Especially with all the BS they're doing
The other day I had an RSO come up to me and ask me if my 18" AR with a telescoping stock was a pistol, so it goes both ways I think.

My brother in law bought a AR pistol with a brace not knowing the difference and put a normal Magpul stock on it. When he showed it to me I'm like bro, you do know this is a illegal SBR right? This is how you had this built? He was like no it had this on it and found the SB brace and showed it to me. I was LMFAO. I had to explain the whole thing to him and of course he thought it was completely dumb AF and I agreed. Perfectly shows why the NFA is dumb AF. He of course put the brace back on it. But the whole thing literally convinced me even more that the entire SBR law is bullshit and dumb. He doesn't keep up with this type of BS and he shouldn't have to. He is completely safe with firearms and has properly been trained and takes his firearms to the range. How many millions of people are just like him? There are going to be millions of people who are felons in 4 months according to the ATF. I think this entire BS is going to be thrown out. Its too common. There are too many. It might even defeat SBR's as NFA items.
That also makes me think of all the southern farmers in the 30's and 40's who were sawing off shotgun barrels having no clue of the law that infringed on their rights.
Watch the ruling get yoinked last minute and the ATF end up with a bunch of info because people fell for it.

I've heard there is actually a concern with some atf agents because they have these braces and they aren't exempt either. Some internal conflict with the rule.
Well let us dive into privileged people for a moment. We should probably start with Hunter Biden and his illegal purchase of a sidearm. Then we can look at Brandon himself who has become a serious international gun runner. Arming the cartels and of course the good ole Taliban.
Exempt is a word they commonly use.
Most don’t have them, they hire people who are against 2A, they don’t like having employees that actually support constitutional rights.
@@cnsgains5506 I've heard the same. Also some LEOs are affected by this. Might be a great way to bring that into the mix as another shining example of defunding the police by this ridiculous rule taking their tools away from them. Alot of smaller depts don't want to mess with NFA items at a dept level so the officers provide their own equipment. Many individual officers don't want to deal with the NFA either so they have opted to run with braced pistols.
Imported pistols had to get approval before coming in to the country. That means there is a paper trail with the ATF approving them. Legal documents that can be used as evidence in court. “Ignore the evidence judge we changed our mind that doesn’t count any more.”
Pretty much, their argument isn't "ignore the evidence" it has always been this way. It's "that evidence is irrelevant now as the rule has changed"
When attorneys are arguing and in disagreement of what all this crap says and means, the AFT has done their jobs perfectly!
Great point. Its so confiusing trying to purchase, carry or transport a firearm with all of the layers and conflicting laws, policies and precedents. it should should not be difficult to exercise a CONSTITUTIONALLY PROTECTED RIGHT.
When I went to a gun show. There was a gun on a dealers table i asked the dealer why some odd feature was on the gun and I asked if it could be taken off. And the delaer jumped back from the table and was like No No No that is illegal! and he's losing his mind liek I am some maiacal criminal for asking a logical honest questoion.

We are living in a culture and time that nurtures and promotes silliness, stupidity, and incompetence. Only the worst of incompetent fools can rise to positions of power and authority here in the U.S.A. This strange ATF "ruling" is just one example of the way everything is going in our whole culture.

I have been avoiding any 40+ minute video on the ATF changing their rules on pistol braces. I enjoyed the rational discussion in this 40+ minute discussion regarding some of the issues that are wrong about them changing their rules.

I have strong feelings about the fact that turning all of the braced pistols into rifles sharply increases the number of short barreled rifles in the US. At that time, I think that there is potentially the strongest case to date against the regulation of SBR's in accordance with the NFA/GCA. Perhaps this oppression is exactly what we needed to aid in making the SBR no longer "Dangerous AND Unusual" because even 3 million new SBR's seems to make it rather "Usual". 3 million is more than 200,000, so I think that we would be in good shape. So I think that maybe rather than being super upset and outraged, we look forward to perhaps using this to get one of the bigger 2A wins that we have seen in a long time. P.S. this skirts all of those states that do not allow NFA items, because SBR's wouldn't be on that list any longer...
That's nice, I have strong feelings that the atf will make a rule to ban all semi automatic pistols next.
Conversely everyone doing a run around of the regulations on SBR and using braces that were only approved for the disabled caused this.

Aside from the issue itself, what about the 10,000’s if not more who are in the military, out of the country, bought a gun 10 years ago etc and won’t find out about this “ruling?” I only know about it cuz I watch guntubers but most gun owners don’t…

I asked Mark, of the Four Boxes Diner, about the ATF's FAQ section regarding the fact in reference to NFA items, 3 days ago now, that reads something like: only the owner of an NFA item or co-owners (trustees) can use their NFA item independently or constructively! You are, now, not allowed to lend your NFA item, say, to your friend (in sight) or, worse, leave it in your safe and your wife has the ability to access it, unless she is a partial owner/trustee, or worse, even allowing a customer to hold an NFA item... Thoughts?

That is good news on one front. I wonder if it was their NFA FAQ section having been looked over about 1 million times+/- overt the past few days and some attorneys contacting to verify?

I was watching "Washington gun laws" and he was taking about the brace ruling and he mentioned that the 88 day automatic rejection only applied to form 4473 that forms 1 and 4 doesn't have that rule

NICS is used on a form 1 and 4, not just the 4473. If that background check takes 88+ days, you're done. Its rare, it's a 1% or less chance, but that's with the current load.
@@tenchraven True, but different set of folks conducting the 4473 background checks. Some states use FBI and others have their own law enforcement do it. That, and the fact that a 4473 for an NFA item is only to document the transfer from the dealer; no back ground check is processed since it was completed during the NFA review, which doesn't have the 88 day rule, hence us having to wait many months and sometimes over a year to get approved.
@@Falcons17 ATF does the 4473 background checks now.
@@stevietaylor3695 FDLE does them in Florida for firearms transfers. No 4473 BGC for NFA, only filled out to document the transfer from dealer to buyer.
Who wants to class 3 an SBR? Are you more than likely have a gun collection, think about the demographic of people who want SBR's...your not just some random farmer with a rifle...Its a smart idea for the ATF to get that registry of "special" gun owners...

It almost sounds like the ATF didn't write the rule.
Like some other Agency or Department (that doesn't have the ability to make firearm "rules" or the votes to pass laws) wrote it for the ATF and they just rubber stamped it.
Don’t give them that much credit.
I've interacted with an atf agent and he told me they make the rules gray instead of black and white for a reason. That way everyone is confused and it's up to each agent to interpret the rule themselves.

All the neophytes are saying pistol braces are banned’ when in fact they are not banned. The aft is now saying an ar pistol with a brace is now an sbr because they now consider a brace a stock. This might be because of the 1000’s of videos on the internet of people shouldering their pistol braces.
William Kirk over at Washington Gun Law has some good info on the 88 day auto-denial rule. It would appear that this only applies to non-NFA background checks under form 4473. There is no automatic disallowance for time frames under forms 1 or 4, as many know from the time periods which it sometimes takes when filing for NFA items.

I have a Tactical Solutions barrel for a 10/22 takedown. They have a shroud extending the barrel to a legal 16”. The suppressor goes into the shroud and screws onto the barrel that’s 12-12 1/2” long. A Guinness idea I think. The suppressor sticks out beyond the shroud a 1/2” or so.
Does it keep standard ammo subsonic? If so I'll raise a Guinness to that idea as well.
Has the "final rule" even been posted to the federal register yet? None of it applies until it's published there. I can't find it on the federal register website.

If 2 guys sit in a closet and make a “rule” who has to follow it? Laws are supposed to be passed and published by congress! Whats the point of making a rule/law and not officially posting it so people are aware of the new rule/law? Nobody will comply with your rule/law if they don’t know it exists!
People also said "They CANT say something is legal (brace) and then turn around and say it's not. They did. They will do it again.
They said it was legal for disabled shooters. How did so many get sold?
ATF: "I am under no obligation to make any sense to you." As far as "good" ATF agents doing their job, many German soldiers at the end of WW2 said they were just following orders. That excuse didn't fly them and it does nor fly now.
The 88 day background check thing (which is actually 90 days but they clear it a day early) is only for form 4473s. It does not apply to form 1 or form 4 background checks, otherwise every single form 1 and form 4 would be rejected for the last decade or more because it takes 6-18 months to get those back.
This has been cleared up in detail by Washington gun law as well, actual attorneys.

My thoughts are along the lines of, in any interaction with the ATF, they can and will use ANY gray area to be additive to any charges, whether those charges end up being valid or not makes no difference, the ATF will use them at the start to gain the upper hand in negotiations for what the ultimate charges you will agree to as part of any settlement negotiation and use against you in the court of public opinion before any trial actually begins.

Hey. I am a gunsmith in NJ. In my state as well as CT, we have a braced firearm called “others”. Basically they are ar pistols with a min 2” vertical fore grip and a min OAL if 26”. Also this firearm is not subject to the assault weapon ban which force’s compliance work to be done on all ar style rifles. For example no flash hider, pinned muzzle brake. No bay lug. No adjustable stock. Any way. How is this brace nonsense going to affect us. We can not have SBR in Nj.
If they can't prosecute you, they can still come loaded for bear to confiscate the offending SBR. All they need is a rubber stamp warrant to seize it.
That’s the real danger… No knock warrants.
Rubber stamps with Judge’s signatures do not exist. Don’t give bad judges that easy pass.
This item has been legal by ATF rules for 15 to 20 yrs. To make a retroactive law, and therefore label 20 - 40 million Law Abiding Americans criminals, merely by a 3 letter agency rule, not a law, just a random nonsensical rule.

The Illinois issue with Sheriffs is spreading. There was an article that came out today, that there are sheriffs that are starting to talk about non-compliance with this rule.

88 days is an interesting amount of time. The amount of days between September 11 and December 7th.
That has to do with the requirement that background check information has to be purged from the system at 90 days. The 88 days gives them leeway to include weekends or holidays in the 90-day number to purge the data without violating federal law. Stop attempting to make some kind of conspiracy out of a very simple requirement.

The form 1 is a different version that is specifically for the pistol braces. You can’t use it just to get a free SBR unless you have a pistol with a brace specifically and have to submit pictures

The pistol grip shotgun issue popped up today on guns and gadgets but I haven't seen it yet... The ATF is going to Infringe themselves out of a job.

Remember. Under 922R, there is a 5 year statute of limitations. So if you changed the configuration of your pistol or rifle over 5 years ago, and it still doesn't comply with 922R, it's past the statute of limitations for you to be charged. Mark, from Four Boxes Diner brought this up.
They purposefully make these things confusing. They want to make owning guns more of a headache than it's worth
It allows them to benefit from the ambiguity of the ruling. They can pick and choose who they want to criminalise and what for.

I've looked it up. I know of 3 civilian 922r charges but only as a tacked on charge with a bigger list of more serious gun charges.

I just hope not many people are submitting form 1s for these braces. I just bought my first suppressor and I’m hoping to get it by my birthday in late October. But I’m not holding my breath.
They wrote phrases in their rule change like "NOT WITHSTANDING ANY OTHER LAW" , This means they can apply any existing law, if you do not have your tax stamp at the end of that 120 days, you are in possession of an illegal SBR. Dio not send them a picture with that brace attached.

So the ATF would be able to say starting this day in 120 days you won't be able to buy a brace without a tax stamp correct? But the line is crossed when they decided it would be a felony to own one that was purchased before the day the new rule goes into affect? Do I have that right?

The 88days only applies to 4473 delays, so it isn't.
All this riffle, pistol, shotgun, pcc, sbr, stock, no stock, brace, pistol grip, fore-grip, mag capacity, caliber, suppressor, tax stamp, registration, import limitations or restrictions are all a big pile of BS! There should be only one question... Is it a gun or not? If it is a gun then call it a gun and under the 2nd Amendment it is all allowed regardless of shape, size or form. All these headaches are created by trying to classify things that cross over into other areas making the definition itself a gray area. Then they try to put restrictions or bans on the grey areas they themselves created. They do this in illegal and confusing manners that makes it very hard for legal gun owners to stay compliant to their bull-crap ideas.
I used to see this compliance as a chance for a free SBR but not anymore. The fundamental difference with compliance is that you are submitting an already built sbr. I would take the pistol, without a pistol brace every being installed (wink wink) and submit it through a normal title 1 to get approval to build the sbr. Basically look at the tax stamp fee as insurance.
It's quite simple.
Remove your braces.
Keep it stored somewhere very separate from your pistol.
Do not apply for amnesty.
Wait for court cases to proceed.
If you want an SBR apply independent of the brace and when approved apply a regular stock AFTER you are approved.

Anyone who registers there braced pistol deserves whatever happens. I refuse. They would have to find mine. The atf can not make law. They can just suddenly decide this. Congress must pass a new law. The atf was never meant to serve in this function. If ppl would just say NO. This would end quickly. Just like they taught u in school about drugs. Just say no ppl
