Naidoo: Zondo's absence at ConCourt is not a worry

  • The ConCourt has reserved judgment in the IEC case seeking clarity on former president Jacob Zuma’s eligibility to contest the elections as the MK Party’s presidential candidate. Judgment is expected to be handed down before the May 29 elections. Executive Secretary of the Council for the Advancement of the South African Constitution Lawson Naidoo weighs in on the matter.

    Electoral Court, having decided through a Bunch of Three Judges, if I am not mistaken, was the IRRATIONAL. This Court has no right to dispute and correct a decision by the Concourt, which is the Appex Court. It is a NON-SENSE for Judges to state that the Appex Court did not allow ZUMA an opportunity for appeal.

      Is a fact that ConCourt violated section 19 which talks qbout the bill of rights 🙄🙄🙄🙄🙄 just because ApexCourt made a huge mistake, doesn't mean other judges have to follow something which is clearly wrong according to our constitution.

      @@BrianWilliams03 We are just debating or sharing our views. The aim here is for us to predict the outcome of the Justices of the Concourt, based on what is stated by law. The problem here is probably some ambiguity or omission related to the issue being discussed. So far I haven't seen any one, including Lawyers, making reference of parts of the law that states how to deal with this particular situation. The concept of remission you mentioned here is not clear at the Constitution, so, tests will be needed by the Judges to reach a decision. PAROLE CONCEPT is easy to deal with. However remission, MUST simply answer the question on whether it cancels the court decision or not. Remember that the President had to bring on certain factual reasons to send ZUMA and others out of jail. For me it means it needs to be a circumstantial reason and therefore the President decision is nothing related with the sentence but rather with the fact there was a need to reduce the number of prisoners' due to the pandemic effects. Therefore, the records of the sentence by the Court stands.

      @@BrianWilliams03 The law doesn't work this way whereby a Lower Court intends to make adjustments for a higher Court's decision. At some stage cases must have a final point and in fact decisions from the Appex Court (Constitutional Court) are final ones and cannot be appealed, whether WRONG or WRITE. The Court heard the exceptional appeal from ZUMA and maintained the decision. He committed the contempt of the Concourt, refused to appear before the court and a sentence was taken on his absence. There is no need to conduct a trial for cases of contempt of court. Try to insult a Court during a trial and you will see a decision to send you immediately to jail without a trial for your action.

      @@thefairobserver97 it seems like you are confused... the latest case is not about reversing the decision of the higher court. Electoral court explained thar section 47 doesn't apply to Zuma since he didn't have the right to appeal as the section stipulate.
      Secondly thar remission means reduction of the sentence which we all know that. Either way based on those two, Zuma qualifies to be on the ballot.
      Now IEC thinks Zuma does not qualify because of the sentence and they claim to want clarity on who has the powers to exercise section 47, basically jurisdiction 🤞💯
      Electoral court didn't reverse the ConCourt judgement, it only ruled on the candidature of Zuma 🤷🏻🤷🏻🤷🏻
      You must learn to differentiate the two

      @jameskillu9171. Being a foreign national, what do you know about "qualified." Second, what do you mean by saying that Justice Zondo is " not qualified to sit as a JUDGE on Zuma matters? You're not well upstairs. Go back to Zimbabwe and study more.

    Justice Leona Valerie Theron must be appointed chief justice, as for Lawson Naidoo, he must slow down, he himself is not eligiable to participate in this case, he must shutdown

      Being bad on interview doesn't make him a bad judge. The expertise, experience and commitment could determine whether you are good candidate or not.
