Beware Durable Partners, Get married or your EU Settled Status will be refused

If you have Presettled Status as a Durable Partner and you have not yet got married to your Partner or you don’t have a relevant document under the EEA Regulations, then your Settled Status application is highly likely to be Refused.

Hi Thanks so much for this amazing informative video :) I've been married to EU citizen for 6years (got married in the UK) and my Pre- settlement is about to end.. I know it's been extended but it seems like not for non EU spouse because I can't renew my BRC unless I apply for settlement. do I still need to provide proof of cohabitation when I apply for settlement? I'm concerned that we haven't living together for so long.

Yes, you will have to prove that your relationship has been subsisting throughout the 5 year period, usually with Cohabitation evidence, unless there are any genuine reasons which you can evidence as to why you cannot provide such evidence.

Hi, can I confirm at what point after marriage (if the marriage was before 2020) a non-EU citizen durable partner becomes eligible for Settled status?
Is that after 5 years of marriage OR after 5 years of UK residence?
