- The plaintiff says she wouldn’t be in court today if the defendant hadn’t stolen and married her boyfriend. The defendant posted online that the plaintiff has a sexually transmitted disease, so the plaintiff is suing for slander and emotional distress. The defendant claims the plaintiff is the one who harasses her, so she’s countersuing.

If you say something like this about someone to a third party and it harms them, the burden of proof to show it is TRUE falls on the person who is defending against the claim of defamation. We don't need to know it's not true; the defendant didn't prove it was true and that's all the law requires.
