- I601 waivers for having previously committed immigration fraud or misrepresentation require proving extreme hardship to a U.S. citizen or Lawful Permanent Resident spouse or parent. When an individual who has been in the U.S. illegally leaves the U.S., the required waiver and accompanying standard depends on how long the person was in the U.S. illegally, and whether they left via their own decision or via a grant of voluntary departure, or based on an order of deportation.

Does this waiver only applies to green card applicants? or can it be used for a Non-immigrant visa application. This is related to inadmissibility due to a 212a2ci drug conviction, almost 30 years ago. Thanks

One of the reasons the I601 waiver is filed, is if your spouse is abroad. An applicant files the II601a waiver if the applicant is in the US.

U have to file it after you submit your documents on the portal and pay for the visa application
