  • I601 waivers for having previously committed immigration fraud or misrepresentation require proving extreme hardship to a U.S. citizen or Lawful Permanent Resident spouse or parent. When an individual who has been in the U.S. illegally leaves the U.S., the required waiver and accompanying standard depends on how long the person was in the U.S. illegally, and whether they left via their own decision or via a grant of voluntary departure, or based on an order of deportation.

    Does this waiver only applies to green card applicants? or can it be used for a Non-immigrant visa application. This is related to inadmissibility due to a 212a2ci drug conviction, almost 30 years ago. Thanks

    Hi, and that thanks for this very informative video.
    *Do we need file the i-601 application for our 12 year kid as well?* My wife and her son are already in the United States and we need to apply for the vaccine waiver, but the USCIS website does not mention minors at all in the i-601 application or instructions. We want to apply waiver under Religious and moral beliefs.

    Hello. I need to file i-601 form because I don't want to get vaccinated and I don't have any supporting documents as a proof. will I get denied with no proof and also will filing this for slow down the prosses of getting green card that I already applied for and now just waiting for the interview call.     thank you so much for this info, i have a question my mom came to visit 2 yrs ago and stayed i file her last year when i became a citizen she got a social ,work permit but the denied the green card, should i file a I-601 for her? I ask this because a friend told me i should've file the I-601 with the I-485 adjustment of status,

    Can the petitioner file the I-601 waiver in the US if the applicant is abroad?

      One of the reasons the I601 waiver is filed, is if your spouse is abroad. An applicant files the II601a waiver if the applicant is in the US.

      U have to file it after you submit your documents on the portal and pay for the visa application

    Hi. Is this case appropriate if the US citizen (let's say his name Alex) has got cancer and his relative (John) is living abroad and should move to US to help Alex?

      If the applicant is a qualifying relative medical hardship can be part of the legal arguments to demonstrate extreme hardship to a USC.
