@McBeanImmigrationLaw During the pandemic of covid-19 back in 2022, I was in the USA under the B2 visa, but I got sick and needed medical treatment, so I requested an extension for my visa, but before USCIS had an answer for my case (which later I had the answer that it was approved for more 6 months), I left the USA, but overstayed my visa for 11 days, but I claimed for an extension for my visa before it expired and I overstayed. What can I do now to solve this situation?
Every time I went to the US they give me six month. In 2018 I spent 5 month 2 weeks with the intention I wasn't going back or for many years, I went bk in 2024 in order to renewing my visa as it would end in lest than 3 months and when I went to get the renewal they turn me down, why? I didn't spend six month My son and daughter lives there wanted to file for me for years and I told them no because I don't want to live there, they both have 3 children each which is my 6 grandchildren, I don't want to live there just wanted to see my family when I feel like I wanted to be with them for a while. Everyone is not the same, so they can't judge everyone the same. ❤

A big difference between someone who overstays their VISA and someone who sneaks into your Country without a Passport and one is classified as an invader

@alphiaflavien1622 . . . You can travel ANY time during that ten years. When it expires, you would need to apply for a new visa. Period. It ain't brain surgery. But if you are a citizen of certain countries you don't need a visa at all to travel to the US as a visitor. You just need to go online and follow the instructions for a Visa Waiver.
Visa Misconceptions A lot of people misconceptionally confuse the visa expiration date with the length of stay in the USA. Let’s clarify this with an example: If your nonimmigrant visa expires tomorrow, and you came to the USA today , you should be technically welcome and you have up to 183 days to stay legally in the USA EVEN IF YOUR VISA EXPIRES TOMORROW. On the other hand, if your visa expires tomorrow and you tried to enter the country on the day after tomorrow, the immigration officer will not let you in EVEN IF YOU INTEND TO VISIT FOR ONE DAY, ONE HOUR OR 183 days. You won’t be let in because your visa is out of date for presentation. This is one reason why I hate the terminology “overstay your visa” because while it supposed to mean overstaying in the USA and becoming out of status, it confuses people to think that the visa expiration date means that such is the time you become an illegal undocumented immigrant If you’re still in the country after your visa expires! Not true! Visa expiration dates don’t tell you how long you should be in the USA. Visa expiration dates tell you up to what date you can present it to the immigration officers for any legal length of stay because visas are permit document to enter a country. On a side note, if you have a 10 year B1-B2 visa, it does not mean you can enter and stay in the USA for ten years either! It means you can present your visa any time within that ten year period visiting the United States and limiting your stay from just a transit bypass up to a legal stay of 183 days.

You don't need to renew the visa . . . Your I-94 merely needs to be extended if it does not already say D/S (Duration of Status) on it. However, you must still be in J-1 Status with the same employer and comply with ALL other terms of your J-1, which since you are asking this questions I would assume you have not and are already overstayed and are not smart enough to consult an immigration lawyer.

I'm from the Congo. I had asylum status. I was able to apply for a green card after 3 years and I got it. After that, I waited 5 years to apply for citizenship this year and I got it. I hope it helps.

A visitor visa is for about 5 to 10yrs. When a person is granted a visa and arrives in the US, they are given a specific time to remain in the US, mostly 6 months. What happens if they overstay this time? If they overstay that 6 months, aren't they illegal now?

Good day Mrs Pompy question. If one went to the US legal but had an accident hospitalised overstay a month. rite to the USCIS they request documents pictures ect which was sent. Then they sent you to do biometric after which they sent ok for an extended month but you came home before the month up. Is there a problem going bk to the USA or for renewal of visa. just don’t over stay the visa. you know what visa u came with and finish the purpose N go back. because these visa overstayers the actual legit travelers who want to come visit and go back are struggling to get visa.

I am m not a lawyer. But you have not broken any laws so it should not be a problem. However, you are granted a visa at the discretion of the Consular Officer at the Embassy. Even law abiding applicants are denied.
Interesting but in the Bay Area back in 2019 I left being a US citizen because many who overstayed their Visa and were able to get housing when Americans could not rent at some places in particular. They did not qualify and were not legally in the US and were living the dream.

I don't have a comment I have a question. Someone I know had a visitor's visa and use to work every time he travels I guess Someone brought it to the attention of the authorities they investigated and found it was true. Immigration stamped her book with a No EOS and a No AOS stamp. No EOS and No AOS means (No EOS) means No Extention of Status and (No AOS) means No Adgustment of Status. He was allowed to enter the country still until his visa expired but he could only spend one month. When his visa expired and he went to the Embassy to get it renewed he was denied. My question is will he ever get back his visa status?

The little I know, if you are from Africa,before your J1 Visa expires, ask your Embassy for: Letter of no objection, they will mail it to State Department and wait for their response! You even pay anything!
You will have to submit all the docs.the Embassy will ask you for, then the Embassy will put them together and add their letter and mail the package to State Department, that one is very straight you don't have to pay any money,unless if it has expired,still go to your Embassy for more advice!

I think so, if on file you're employed in your home country. I know someone who visits every year and stays for 4 months and his visa never got renewed. He submitted his documents and passport, which they called him in for an interview a few weeks after and denied him the visa renewal. They have it as overtsay because on file he had a full-time job but leaves every year for 4 months which no job gives 4 months' leave yearly. So I think they assumed he might be working all those times being there. Probably if he didn't have on file that he has a full-time job or even stay for a month each year things would've been different I guess. Not a legal advice but if you stay 4 months say this year, don't stay for that long the following year. Be safe and enjoy your time👍

Lawyers are just looking for money. Lawyers charges are exorbitant. USCIS is extremely difficult. I was removed in Sept 2008 for violating voluntary departure.I was in US for over 21yrs I have a 33 yrs old son born in US. I went to US in 1987 on B1 / B2 and overstayed. I tried to use family petition. Affidavit of support is creating disadvantage for me now. My son is getting government subsidy I am currently outside US

Yes they are, and lately those people overstaying, with the use of technology are getting their VISAS cancelled.

That person should have known it was going to be lights out after their passport was stamped.

The little I know, if you are from Africa,before your J1 Visa expires, ask your Embassy for: Letter of no objection, they will mail it to State Department and wait for their response!
You even pay anything!
You will have to submit all the docs.the Embassy will ask you for, then the Embassy will put them together and add their letter and mail the package to State Department, that one is very straight you don't have to pay any money,unless if it has expired,still go to your Embassy for more advice!
If you overstay your visa, it is common sense that you are breaking a law.

I think so, if on file you're employed in your home country. I know someone who visits every year and stays for 4 months and his visa never got renewed. He submitted his documents and passport, which they called him in for an interview a few weeks after and denied him the visa renewal. They have it as overtsay because on file he had a full-time job but leaves every year for 4 months which no job gives 4 months' leave yearly. So I think they assumed he might be working all those times being there. Probably if he didn't have on file that he has a full-time job or even stay for a month each year things would've been different I guess. Not a legal advice but if you stay 4 months say this year, don't stay for that long the following year. Be safe and enjoy your time👍

Lawyers are just looking for money. Lawyers charges are exorbitant. USCIS is extremely difficult. I was removed in Sept 2008 for violating voluntary departure.I was in US for over 21yrs I have a 33 yrs old son born in US. I went to US in 1987 on B1 / B2 and overstayed. I tried to use family petition. Affidavit of support is creating disadvantage for me now.

How about for a J1 Visa holder? Visa stamp is only for 3 years but the DS2019 is extended to another 2 years. What happen if the holder will not renew his Visa.
