A long long time ago I was on probation fro something ki of stupid for 1 1/2 years, I missed reporting one time, (I was out of town and didnt remember until late in the day about provation) I called the phone number which was answered 24hrs and left a message for my probation officer, drove back home that night and showed up at 7am at the probation office, when my probation officer walked in he saw me and ask what I was doing, I told him about the message, and what had happened and I would set there all day every day until he had a time to squeaze me in, if I could make it up. He said give me a few mins to get settled in( I really thought I was getting taken into custoy) a little while later, he came out got me, we talked for a little bit, he took the paper I had to fill out every month, stating I hadnt moved, changed jobs etc... and told me If I missed, just to call him the next day and he would reschedule it, a few months later he put me on a program where I mailed or dropped off the paper everymonth for the remaining year. My probation was be cause when charged by a judge with contempt, I said "you have not even seen the contempt I have for this court" I wasnt being prosecuted, and complained that we (the witnesses in the case were having to show up every couple of weeks to find out the trial was postponed for a few weeks, 6 times at that point and it was really a waste of my time, let me know when they will start the trial and I will be there. I was charged with contempt, put on probation and given every thing the judge counld check off, I had to get a copy of my diploma from highschool my college degree wasnt good enough, I had to attend parenting classes - I didnt have kids, I had to go to AA thing to get screened - I didnt drink, I had to remove all the booze from the bar at my house, I had attend a vicitm impact seminar- I never comitted a crime , I had to do stuff that I dont even remember. The probation officer kind of saw what was happening and felt sorry for me. I made it thru.
If he followed to the letter and then started additional proactive actions, I’ve seen early end on probation. Not common, but going forward and requesting every thing probation offers to get ahead of the curve…
Why was he trying to get custody of his newborn? The judge had said he couldn't be primary custodial parent and that he couldn't heve unsupervised contact with minors
I'm sure I'll be corrected if I'm wrong, but I believe at that time adjudication had been withheld so he wasn't a convicted felon yet. He is now that he was sentenced to prison so he lost the privilege to be custodial parent.
So basically if the mom fights it she would win because he automatically becomes the less admirable choice. But since mom doesn't want anything to do with the child, it seems, there is only one person to designate. He's gonna have to do a lot of work to do with CPS to get there.
She tried to help him, she put it all on him & his flirting & stories lost their gloss! No1 to blame but himself, mistook the handbag + flowers as signs of being soft!

most probation officers will reschedule you if you miss and call them around the day you miss, this guy was gone for months- it all sounded like excuses - a tracheostomy is a pretty common thing, cousin cleatus Im sure everyone saw coming from a mile away.
Have these folks never heard of cell phones? I find it hard to believe that he didn't have a phone to call his PO and let him/her know what was going on. He's in even worse shock now having to do 6 years. Judge said it his baby won't even know him when he gets out

I was a day late calling my PO at the very beginning of probation years ago and left a long message saying how sorry I was, and she called back and said, "Hey, it happens. Don't do it again." They're so swamped with people who just don't report that they're happy if you just make an effort.

How would you like to be Judge Boyd and evry 6 months or so you have to rewrite all the conditions over again- essentially doing the same job multiple times until you just put them in jail.
It's crazy that every single one of them always has a death in the family or someone sick and they couldn't report.. all you have to do is report and they're not even doing that but want the court to show them mercy and give them a fourth chance.

They don't get jail for not calling into probation. They got probation instead of jail for their crime and lose that privilege because they do not comply with the rules of probations. So in that case he got the jail time for the initial crime of assault and drug possession not for not calling into probation, probation was just a chance given to him to avoid the jail time and he blew it.

He got 6 years for each of 2 cases and they will be served concurrently (at the same time), so he serves a total of 6 years.
