@nsquezada27 when I filter on surface streets I typically pull up infront of the first cars. When it's time to go I stay in the middle until I see it's clear to get into a lane. Good question!
What about a two-lane road? Had a motorcyclists freak off on me because I was driving to the left on a mountain road to avoid tree branches. Also there was no on coming traffic.

Why the hell would you ever think it is safe to get so near them while at speeds where you could die? Sorry but I see no reason for lane splitting. If lane splitting was originally intended for air-cooled bikes and for safety reasons (It makes no sense for a bike to be caught in an auto traffic jam when they can easily escape it), I honestly think the emergency lane should be the only lane allowed and at reduced speed. I am 57 now. No longer ride after losing three friends to motorcycle crashes. Lane splitting is extremely startling when in a car and dangerous AF on a bike, no matter what you claim about escape routes. I can't believe it's allowed. I used to try and justify the right not to wear a helmet but the facts are, it's stupid not to. Same goes for lane splitting. Just not a great idea, but hey you do you and hope you don't go down like those that I knew.
The government where I live recently changed the motorcycle helmet laws so that people with turbans don't have to wear a helmet. The insurance companies raised everyone's insurance for future claims. Insurance companies are going to have to raise insurance rates because of lane splitting because of the increased risk. Splitting lanes seems to be a good idea at stop lights, but not while traffic is moving. There are way too many people that can't drive properly as it is and having faith or hoping the driver ahead doesn't change lanes is not a good strategy. Besides who determines who has the right of way and when? It comes down to risk vs reward. Too many bad drivers and too many people that make bad choices. In a perfect world I say go for it, but this world is far from perfect.
I actually found out that it was legal between any lanes when I had my accident splitting lanes last October. I honestly thought I was going to be considered at fault because I wasn't splitting between the #1 and #2 lane. I was all the way on the right, which for that highway, was I think #5 and #6 lane. Probably not the smartest thing I've done but I came out unharmed and the driver's insurance covered everything, so, it wasn't all bad. The driver was considered at fault because she suddenly closed, which caused me to react with panic brake and low side the bike. The sad part was that car never actually touched my bike but I submitted my video evidence to my insurance and they said it was the driver's fault, and the drivers insurance assumed responsibility. We are just lucky that its legal on California and we have protections, even when we do dumb things like split lanes on the right side at 6 AM in October when its dark during that time. Lol
A “Vehicle” is defined in section 670 of the California Vehicle Code. No mention of the number of wheels in the definition of a “vehicle”. Also, no mention of the number of wheels in 21658(a). I’m still looking for the section you are relying upon to grant you the authority?? Do some research and let me know. I looked for a section defining “Well Known Fact” but couldn’t find anything. Maybe you can help me out with that one, too.
Citations for 21658(a) for lane splitting have been tested in California courts for the last 40+ years. It has been the same result every time - Guilty! Just because you haven’t been cited for that doesn’t mean it doesn’t apply. But, maybe there is some section of the code that gives the authority. In the last 40 years I haven’t found a single person that can provide the section that gives the authority. That is probably why people keep getting ran over while lane splitting. Stupid, Dangerous, and Illegal.
The biggest misconception is that so many riders think its legal everywhere.

More States are passing legislation for lane filtering but California is still the only state that allows for lane splitting.
Arizona just passed the law for lane filtering. But filtering can open the door to lane splitting.

I don't care if it's legal . It's not safe and someone could not see you and accidentally hit you. Defense driving is best.
