  • The single most important development in American politics over the last 10 days is not the one that's received the most attention, i.e. President Joe Biden's disastrous confirmation in last Thursday's debate that he is 'simply to old' to be an effective president for another four years. Instead, it was the Supreme Court's six-three decision in the case of Donald J. Trump v. United States to create a wide range of action for which the President of the United States is immune from criminal prosecution. This fundamentally alters not only the balance of power within the three branches of the American government but also substantially weakens the systems of checks and balances and the rule of law that have allowed us to use institutions to stabilize our politics for the last 200 years. Bringing these two developments together, we now have a likely future President Trump with plans, outlined in Project 2025 and in his occasional remarks, to substantially expand the range and use of executive power and a Supreme Court relinquished its Constitutional responsibility to check the autocratic abuse of executive power.
