    This video got my disability journey started. Thanks to these tips, I was able to build a strong case. And when the VA redlined my submission without even really considering it, Mr. Studdard handled my appeal. We got approved this week! Thank you Mr. Studdard!!!!

    Very helpful video on sleep apnea , Before i retried from the service(2014 with 3 Deployments) i went to an army hospital to do an sleep apnea test, During the test i was told i have sleep apnea , but when i file for sleep apnea with the VA i was not rule as not service connection (2X). So this time i talk to Hospital to get records of the test which i took during while in the military and now have statement from my brother`s in arm . Plus i have the sleep apnea machine.

      +L.A.W 100442 sounds like an interesting claim. Sounds like it should be service connected based on what you have said. Visit our website www.WinYourVetClaim.com if you'd like more info or a consultation to see if we might be able to help.

    Currently, I hold a 60% rating. I have not seen those I served with since my honorable discharge in 1979, however, I have had sleep apnea forever. All I knew was that I have snored heavily for my entire life. I had no idea I even had a medical condition. All I knew what that I snored loud enough to cause them to sleep in another bedroom. I've also been told by my parents, my ex-wife and subsequent girlfriends that not only do I snore very loudly, but I would also stop breathing for periods long enough to scare them. I didn't even know what sleep apnea was until the VA diagnosed me with it after they recommended a sleep test where I spent the night at the South Georgia-North Florida VA Hospital in Gainesville, Florida a few years ago. My father told me I should ask the local VA about the fact that I stop breathing for long periods of time when sleeping. They've had me on a C-PAP since that time. I didn't even realize I could claim it. It never dawned on me to ask. I simply accepted what I was told about my condition. Do you have any advice? Thank you in advance.

    I was in the National Guard from 2012 - 2017. I had also served from 1986 - 2001 both on active duty and National Guard. I had a total of 20 years of service. I was diagnosed with Sleep apnea in 2014 during my National Guard service. I was denied because I wasn't diagnosed while I was on actual duty. Getting diagnosed while on duty would be impossible since you are working during duty time. Kind of a joke!
    I wish the video would address people in the National Guard especially ones with active duty. Not sure of my next move from here.
    Thanks!

    I have sleep apnea and use a cpap the VA diagnosed me with it. I requested my medical records and was informed that they were distorted by fire. I also have hearing problems and ringing of the ears so bad that it gives me headaches. What can I do?I have never filed a claim.

    Hello! I was tested while still in military service and they said I don't have it. Despite the symptoms I was having. Fast forward 19 years later. Symptoms much worse and now have a CPAP machine. They still denied even though I was tested in military and out. What do I do next? Thank you in advance.

      You can always appeal the decision if still within a year of that decision date. Even after a year you can still file another claim with new and relevant evidence. Sounds like you may need a medical opinion addressing whether your sleep apnea started in service despite the negative sleep study.

    I am a civilian now since 98 at 20% disability. My sleep apnea claim been denied even with my wife’s letter (a nurse) and a private physician (sleep study) diagnosis of me having one. I don’t have diagnosis while active but my physician suggested a constant headache after waking up in the morning is also a sign of sleep apnea which was in my military medical records several times, also sir do you do nexus letter? Your your response and advise much appreciated in advance. Thank you. Carlito.

    I have very severe sleep apnea. The va put me on medicine for my ptsd but we never used that word due to the stigma it held at the time. I am very confident that this is due to my deployment in 2005 to Kuwait/Iraq. I was subject to the oil fires and burn pits near the base. Looking back on the whole situation it now makes sense . what are my next steps. I am on a cpap .

    How do I ask a Doctor to write a Lay statement if I have always gone to the VA? None of them so far said they would write a statement like this.

    • @Veterans_Lawyer
      @Veterans_Lawyer  7 років тому

      +Russet Burbanks you are correct that it will be hard if not impossible to get a VA doctor to help with your benefits claim. I'm not totally clear what you are wanting the doctor to address in a written statement. A lay statement refers to something written by a lay witness which is someone who is not a medical expert. If you are wanting the doctor to address the severity of your symptoms, he or she may do a DBQ for you. If you need a nexus opinion, which relates your disability to your military service, you'll probably need a private doctor. If you need help, go to our website www. WinYourVetClaim.com. Best of luck.

    I am currently on active duty and have a service connected sleep apnea with a CPAP machine. With that said I have an 8 on the sleeping scale which is above avg sleep apnea. I heard from many that a CPAP machine constitutes a 50% rating, is this true? I filed last week for my VA disability claim.

    Not sure if you still read this, hope so. If sleep apnea and daytime hypersommulence is listed as an issue on your military exit exam, then later diagnosed with sleep apnea. Is that enough to prove service connected.

    • @Veterans_Lawyer
      @Veterans_Lawyer  7 років тому

      +1titans you have some good evidence there it sounds like, but you will probably need some medical evidence to be granted service connection. Contact us through our website www.winyourvetclaim.com so we can do it privately. Look forward to hearing from you.

    Do they call witnesses to your hearings when lay evidence is provided? I have buddies across the country that are willing to write a letter but I have a hard time believing they'd make it out to me VA hearing.

    • @Veterans_Lawyer
      @Veterans_Lawyer  5 років тому +2

      VA will not require them to appear in person. A lay statement is sufficient.

    Hi Travis. Question. Do disabilities diagnosed during a General Medical Exam (within one year after discharge) consider as an in-service event?

  • @jayjay269
    @jayjay269 8 років тому +3

    Which doctor is allowed to write a letter stating that your lay evidence is describing service connection for sleep apnea? My VA phycologist and VA PCP said that they aren't allowed to determine these statements.

      Jason Turner As a nurse, I would have to guesd that the letter would have to be from a cardiologist, or pulmonologist. Cardio-Pulmonary Clinic

      Cheers for the Video! Apologies for the intrusion, I would appreciate your thoughts. Have you heard the talk about - Letochy Fast Apnea Plan (probably on Google)? It is an awesome exclusive guide for getting rid of Sleep Apnea minus the headache. Ive heard some pretty good things about it and my cousin after a lifetime of fighting got excellent success with it.
